Royal Decree 13/91 Allocating a Site in Bawshar for Public Benefit

We, Qaboos bin Said, the Sultan of Oman

after perusal of Royal Decree 26/75 Issuing the Law Governing the Administrative Apparatus of the State and its amendments,

and Royal Decree 64/78 Issuing the Law on the Expropriation for Public Benefit and its amendements,

and in pursuance of public interest,

have decreed as follows

Article I

The site of the Organic and Chemical Fertiliser Factory in Bawshar—specified in the attached note and masterplan—is hereby allocated for public benefit.

Article II

The competent entities may seize, through direct execution, land and all establishments on them, in accordance with the provisions of the mentioned Law on the Expropriation for Public Benefit.

Article III

This decree must be published in the Official Gazette, and comes into force from the date of its issuance.

Note on the Request Submitted by the Supreme Committee for Town Planning Regarding the Allocation of a Site in Bawshar for Public Benefit

The Organic and Chemical Fertiliser Factory in Bawshar was established in 1981. When it was established, it was surrounded by buffers and environmental controls that prevented the establishment of any establishments around it. However, with the progress of urbanisation, residential establishments, schools, and other facilities were established, and the citizens living there were harmed by the odours that accompany the operation of the factory.

Therefore, the Council for Environmental Protection and Pollution Control issued a decision to relocate the factory to a location away from populated areas, and the Supreme Committee for Town Planning issued a decision to close the factory and stop production at its current location.

Whereas the safety of citizens and the preservation of public health and the protection of the environment from pollution are considered the most important matters related to the public interest, the matter requires the expropriation of the site and the establishments based on it in accordance with the approved planning, and the issuance of a royal decree allocating the mentioned site for public benefit.
