Royal Decree 119/2008 Amending Some Provisions of the Law of the Practice of the Medical Profession and Dentistry Issued by Royal Decree 22/96

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

Royal Decree 24/75 on the Determination of Diyat and Arsh,

and the Law of the Practice of the Medical Profession and Dentistry issued by Royal Decree 22/96,

and in pursuance of public interest,

have decreed as follows

Article I

The text of article 20bis of the aforementioned Law of the Practice of the Medical Profession and Dentistry is hereby replaced with the following text:

Without prejudice to criminal and disciplinary liability, compensation for proven medical malpractice in cases of death, permanent total disability, partial disability, and wounds and injuries must be in accordance with the provisions of the Decree on the Determination of Diyat and Arsh, provided that the compensation in the event of permanent total disability must be of the same amount as compensation for death.

Compensation for medical malpractice resulting in moral damages must be provided only to the extent that it does not exceed the diyat stipulated in the Decree on the Determination of Diyat and Arsh.

Article II

This decree must be published in the Official Gazette, and comes into force on 1 December 2008.
