Royal Decree 100/2004 Amending Some Provisions of the System of Pensions and End of Service Gratuity for the Personnel of the Ministry of Defence and the Sultan’s Armed Forces

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the System of Pensions and End of Service Gratuity for the Personnel of the Ministry of Defence and the Sultan’s Armed Forces issued by Royal Decree 3/2002,

and in pursuance of public interest,

have decreed as follows

Article I

The text of the article 15(2) and (3) of the mentioned System of Pensions and End of Service Gratuity for the Personnel of the Ministry of Defence and the Sultan’s Armed Forces is hereby replaced with the following text:

The period of service that the personnel has spent in any of the government agencies or the private sector and for which no pension or gratuity has been paid must also be included in its calculation, provided that all the contributions that make up his pension rights for those periods are transferred to the fund.

The personnel shall pay the mentioned contributions for the periods of secondments and leave without pay. The minister may, on the basis of a recommendation by the board of directors of the fund, exempt the personnel from all or some of the contribution of the state in cases where this is necessary.

Article II

This decree must be published in the Official Gazette, and comes into force on the date of entry into force of the mentioned Royal Decree 3/2002.
