The Supreme Court held that the prior user of a trademark has the right to cancel a subsequent registration by another party within five years from that registration in accordance with the GCC Trademark Law. The court additionally affirmed that the sale of company shares inherently includes the transfer of intangible assets, such as trademarks, as part of the commercial store.
