Case Summary: Supreme Court (Commercial Circuit) Contestation 894/2016 (Territoriality of Trademark Protection and Prior Registration Rights)

The Supreme Court ruled that trademark protection is strictly territorial, meaning foreign registration does not grant protection in Oman unless a priority right under international treaties is claimed. Under article 42 of the Industrial Property Rights Law, a registered trademark cannot be cancelled unless it was registered in bad faith or to damage a prior registered trademark in Oman.
