Royal Decree 51/2005 Declaring Public Benefit Status to the Project for Constructing a Groundwater Recharge Dam Wadi Al-Khub in the Wilayat of Dibba

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Law on the Expropriation for Public Benefit issued by Royal Decree 64/78 and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

The project for the construction of a groundwater recharge dam on Wadi Al-Khub in the Wilayat of Dibba specified in the attached note and masterplan to be implemented in the Wilayat of Dibba is hereby deemed a public benefit project.

Article II

The competent entities may seize, through direct execution, real estate and land necessary for the project, and all establishments on them, in accordance with the provisions of the mentioned Law on the Expropriation for Public Benefit.

Article III

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Note on Declaring the Public Benefit Status of the Project for Constructing a Groundwater Recharge Dam on Wadi Al-Khub in the Wilayat of Dibba

Based on the royal directives of His Majesty Sultan Qaboos bin Said—may God protect him and save him—regarding the mentioned project, this ministry has taken the necessary measures to implement the project in coordination with the competent entities, and the study resulted in the need to carry out the following works to implement the project:

– Preparing the land and its appurtenances.

– Constructing a dam for underground recharge with a length of 500 m and a maximum height of 17.4 m of compacted stones and earth.

– Supplying the dam with a concrete spillway with a length of 200 m.

– Supplying the dam with a network for hydrological monitoring (water level measuring device and monitoring wells).

– Diverting roads affected by the construction of the dam.

Considering that some real estate and land owned by citizens obstruct the implementation of the mentioned project, a royal decree is required to declare the public benefit status of the mentioned project and to take measures to expropriate those real estate and lands in accordance with the provisions of the Law on the Expropriation for Public Benefit issued by Royal Decree 64/78 and its amendments, in addition to allocating and reallocating some government land for the same purpose.
