These terms of use govern your use of Decree:
Article 1
Definitions
For the purposes of these terms of use, the following definitions apply:
“Decree” means the web-based English language database for Omani legislation available on <https://decree.om/>. This definition does not include other products and sub-sites available on the <decree.om> domain name such as the Decree Blog, the Irfan Rulebook, and the Oman Legal Citation Standard (OLCS).
“Decree Content” means any content published on Decree and owned by the Licensor, such as translations, summaries, and other works.
“Licensee” means a legal entity subscribed to Decree.
“Licensor” means Decree Tech LLC.
Article 2
Licence
1. The Licensor hereby grants a limited, personal, non-exclusive, non-transferable, non-assignable licence to the Licensee to access and use Decree and Decree Content for the number of its authorised users for the licence period.
2. The Licensee shall use Decree Content only as part of its ordinary course of business. This includes the right to download insubstantial segments of Decree Content to storage devices under its exclusive control, the right to internally display Decree Content, and the right to quote segments of Decree Content in other electronic documents with appropriate attribution.
3. The Licensee may also create a reasonable number of printouts of Decree Content for its internal use and for distribution to third parties for purposes consistent with its ordinary course of business, provided that such third parties agree not to share Decree Content with any other party.
Article 3
Restrictions
1. The Licensee shall not copy, translate, publish, make available, communicate to the public, scrape, download, distribute, broadcast, circulate, sell, or otherwise use Decree Content in any form or by any means, except as permitted by these terms of use.
2. The Licensee shall not use Decree Content for training, developing, or testing artificial intelligence models or for using Decree Content as input for machine learning algorithms without signing a separate licensing agreement with the Licensor.
3. For the avoidance of doubt, the use of bots and other automation tools to extract Decree Content is not permitted.
Article 4
Passwords
The Licensee shall undertake all precautionary measures to protect the passwords given to its employees to access and use Decree and Decree Content and shall not share such passwords with any third parties. The Licensee shall notify the Licensor promptly if it becomes aware or suspects that any unauthorised person has obtained the passwords, and in this case, the Licensor will alter the password and inform the Licensee accordingly.
Article 5
Disclaimers
1. The Licensor is not a law firm and does not provide legal advice.
2. The Licensor is not a translation office and does not provide legal translation services or attestation services of legal translations.
3. To the extent permitted by applicable law, the Licensor disclaims any and all warranties concerning Decree and Decree Content whether express or implied, including any warranty of merchantability or fitness for a particular purpose.
4. Decree Content is provided on an as is basis with no guarantee in regard to the availability, completeness, or accuracy of any specific content. The Licensor reserves the right to make updates, corrections, or changes to Decree Content as required.
5. Decree Content is not official and has no legal standing under Omani law. The Licensee acknowledges the need to rely on the original Arabic text in legal proceedings.
Article 6
Limitation of Liability
The Licensor shall not be liable to the Licensee under these terms of use for any special, incidental, indirect, or consequential damages of any kind, including but not limited to, loss of profit, loss of business, depletion of goodwill, or any similar losses.
Article 7
Personal Data
1. The Licensee shall obtain the consent of any individual it designates as an authorised user to use Decree.
2. The Licensor shall process the personal data of the authorised users in accordance with the applicable laws and the Decree Privacy Policy available at <https://decree.om/privacy-policy/> as updated from time to time.
Article 8
Force Majeure
The performance of the Licensor under these terms of use may be subject to interruption and delay due to causes beyond its reasonable control such as acts of any government, civil disorder, fire, explosions, power failure, equipment failure, and industrial or labour dispute. In such cases, the Licensor shall be relieved from all liability resulting from such interruption and delay.
Article 9
Separate Agreement
If the Licensee signs a separate agreement with the Licensor for the use of Decree, the provisions of that agreement supersede these terms of use.
Article 10
Applicable Law
These terms of use are governed by the laws of the Sultanate of Oman.
Article 11
Dispute Resolution
Any disputes arising out of these terms of use shall be referred to the competent court in the Sultanate of Oman.
Article 12
Termination
1. The Licensor has the right to revoke the licence and terminate access to Decree in the following cases:
(a) The failure of the Licensee to comply with these terms of use.
(b) The abuse by the Licensee of Decree Content in a manner not envisioned by the Licensor.
2. Upon the end of the licence period, the Licensee shall destroy all physical and digital copies (backup or otherwise) of Decree Content. Notwithstanding the foregoing, the Licensee may retain segments of Decree Content included in the following cases:
(a) Decree Content included in presentation materials.
(b) Decree Content included in any correspondence.
(c) Decree Content included in routine electronic backups pursuant to the backup and archival procedures of the Licensee.
In all cases, any such retained Decree Content must remain subject to the confidentiality, non-use, and other terms of these terms of use until such Decree Content is destroyed.
