We, Qaboos bin Said, the Sultan of Oman
after perusal of Royal Decree 26/75 Issuing the Law Governing the Administrative Apparatus of the State and its amendments,
and Royal Decree 56/82 Issuing the Financial Law,
and in pursuance of public interest,
have decreed as follows
Article 1
The following articles are hereby added to the mentioned Financial Law:
Article 30bis 1
In the application of the provisions of this law, and with the exception of the cases stipulated in any other law, the financial rights of individuals and private companies and establishments against units of the administrative apparatus of the state, public authorities, and their equivalent prescribe by the lapse of five Gregorian years. Financial rights of units of the administrative apparatus of the state, public authorities, and their equivalent against individuals, companies, and private establishments also prescribe by the lapse of seven Gregorian years. Prescription does not start to run except from the time at which the debt becomes due for payment.
Article 30bis 2
The prescription period does not run whenever there is an impediment preventing the creditor from claiming his right.
Article 30bis 3
The prescription period is interrupted by a legally recognised claim. A new prescription period starts to run from the date of the end of the effect resulting from the reason of the interruption. Its period is the period of the first prescription.
Article 30bis 4
Prescription results in the lapse of financial rights. As well as the transfer of the rights of individuals and private companies and establishments to the public treasury.
Article 30bis 5
The prescription starts to run for debts that became due before the entry into force of this decree from the date of its entry into force.
Article 2
This decree must be published in the Official Gazette, and comes into force from the date of its publication.
