Royal Decree 51/2002 Amending Some Provisions of the Insurance Companies Law

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Insurance Companies Law issued by Royal Decree 12/79 and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

The text of article 59 of the mentioned Insurance Companies Law is hereby replaced with the following text:

The minister may impose on insurance companies subject to the provisions of this law a proportional fee calculated on the total direct premiums due to the company for all policies during the year, provided that this fee does not exceed 4% for all insurance operations.

Article II

A new article numbered 59bis is hereby added to the mentioned Insurance Companies Law with the following text:

A fund named the “Insurance Emergency Fund” is hereby established in the ministry to assist in resolving crises facing the insurance sector in the Sultanate.

This fund must be financed by a percentage of the fees stipulated in article 59 of this law. The minister shall issue a decision specifying this percentage and any other resources for the fund, stating the cases in which assistance is provided, and governing work in the fund.

Article III

This decree must be published in the Official Gazette, and comes into force on the date of its publication.
