Case Summary: Supreme Court (Rent Circuit) Contestation 106/2014 (Waiver of Arbitration Clause and Standing of Successor in Title)

The Supreme Court held that a party's right to invoke an arbitration clause is waived if they fail to raise it before submitting any substantive defence on the merits of the case, in accordance with article 13 of the Arbitration Law in Civil and Commercial Disputes.
