The Supreme Court held that an employee of a law firm who receives funds from clients to perform legal tasks acts as an agent for those clients. Consequently, misappropriating these funds constitutes the crime of breach of trust under article 360 of the Penal Law, regardless of whether the employee received the funds in a personal capacity or on behalf of the firm.
