Ministry of Commerce, Industry, and Investment Promotion: Ministerial Decision 105/2021 regarding the Ban on Selling, Buying, Trading, Advertising, or Promoting Goods, Products, and Services through Network or Pyramid Marketing

Based on the Commercial Law promulgated by Royal Decree 55/90,

and Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, Determining Its Competences, and Adopting Its Organisational Structure,

and in pursuance of public interest,

it is hereby decided

Article I

In the application of the provisions of this decision, network or pyramid marketing means any method used by the supplier, advertiser, or promoter to invite the consumer to select a list of other consumers with the intention of buying the good or receiving the service in exchange for a benefit obtained by the first consumer, and placing them all in pyramid or network groups with the intention of collecting money from the largest number of participants in the network or pyramid.

Article II

Selling, buying, trading, advertising, or promoting any good, product, or service through network marketing or pyramid marketing for it, through any electronic or non-electronic means, is hereby banned.

Article III

An administrative fine of 5,000 (five thousand) Rial Omani shall be imposed on whoever violates the provisions of this decision, and the fine shall be doubled if the violation is repeated.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.
