Case Summary: Supreme Court (Commercial Circuit) Contestation 141/2017 (Applicability of Commercial Law to Mixed Contracts and Bank Loans)

The Supreme Court held that if a contract is commercial for one of the contracting parties, the provisions of the Commercial Law apply to the obligations of both parties, entitling a bank to charge interest on a loan granted to an individual even if the loan was personal in nature.
