Royal Decree 75/2005 Amending Some Provisions of the Omani Penal Law and the Criminal Procedures Law

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

the Omani Penal Law issued by Royal Decree 7/74 and its amendments,

and the Criminal Procedures Law issued by Royal Decree 97/99 and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

A paragraph is hereby added to article 163 of the Omani Penal Law, the text of which is as follows:

Every competent officer who wilfully refrains from, or obstructs, the execution of a judgment or order issued by a court, after the lapse of two weeks from his warning to execute it by a clerk, shall be punished by the same punishment stipulated in the preceding paragraph and by dismissal from office.

Article II

Article 4bis is hereby added to the Criminal Procedure Law, with the following text:

Without prejudice to the text of article 5, whoever suffers damage from the crime stipulated in the second paragraph of article 163 of the Omani Penal Law may directly summon the accused to appear before the competent misdemeanour court on the dates and in accordance with the procedures stipulated in articles 163 and 164, and the secretary of the court shall notify the Public Prosecution with a copy of the summons statement to appear to undertake the public lawsuit.

Article III

This decree must be published in the Official Gazette, and comes into force on the date of its publication.
