Telecommunications Regulatory Authority: Decision TRA/1152/2/3/2022-4 Amending Some Provisions of the Regulation Governing the Registration and Use of Radio Frequencies and Devices and Determining Their Prices

Based on the Telecommunications Law promulgated by Royal Decree 30/2002,

the Executive Regulation of the Telecommunications Law promulgated by Decision 144/2008,

the Regulation Governing the Registration and Use of Radio Frequencies and Devices and Determining Their Prices issued by Decision 133/2008,

the approval of the Board of Directors of the Telecommunications Regulatory Authority,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

The text of article 11 of the aforementioned decision 133/2008 is hereby replaced with the following text:

“The authority shall issue the necessary annexes to implement the provisions of this regulation and to make periodic amendments to them in accordance with the recommendations and decisions of the International Telecommunication Union, international organisations, and market requirements, and they shall be published on the website of the authority.”

Article II

Schedules 51: Fee for Registration of International Telecommunications Services and Schedule 52: Fee for Usage of International Telecommunications Services provided in clause 8.6.2.3 of article 8 of the aforementioned Regulation Governing the Registration and Use of Radio Frequencies and Devices and Determining Their Prices are hereby replaced with the following schedules:

Registration Fee:

Registration fee = total bandwidth (megahertz) × coverage factor × 4,000 (four thousand) Rial Omani × frequency factor

Schedule 51: Registration Fee for International Telecommunications Services.”

Usage Fee:

Usage fee = total bandwidth (megahertz) × coverage factor × 10,000 (ten thousand) Rial Omani × frequency factor

Schedule 52: Fee for Usage of International Telecommunications Services.”

Article III

A new schedule numbered 53bis is hereby added to clause 8.6.2.3 of article 8 of the aforementioned Regulation Governing the Registration and Use of Radio Frequencies and Devices and Determining Their Prices as follows:

“And in accordance with this formula, the frequency factor is determined as follows:

Schedule 53bis: Frequency Factor for International Telecommunications Services.”

Article IV

Annexes C, D, E, F, G, I, K, J, M, and N attached to the aforementioned Regulation Governing the Registration and Use of Radio Frequencies and Devices and Determining Their Prices are hereby repealed.

Article V

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Based on the Telecommunications Law promulgated by Royal Decree 30/2002,

the Executive Regulation of the Telecommunications Law issued by Decision 144/2008,

and the approval of the Board of Directors of the Telecommunications Regulatory Authority,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the governance of telecommunication towers.

Article II

Those addressed by the provisions of the attached regulation shall rectify their status in accordance with its provisions within one year from the date of its entry into force.

Article III

All that is contrary to the attached regulation, or in conflict with its provisions, is hereby repealed.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Telecommunications Regulatory Authority: Decision 1152/2/3/2022/1 Issuing the Regulation Governing the Provision of Voice or Video Telecommunications Service over Internet Protocol

Based on the Telecommunications Law promulgated by Royal Decree 30/2002,

the Executive Regulation of the Telecommunications Law issued by Decision 144/2008,

Decision 34/2012 regarding the Controls for Providing Public Voice Telecommunications Using Voice Over Internet Protocol Technology,

the approval of the Board of Directors of the Telecommunications Regulatory Authority,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the governance of the provision of voice or video telecommunications service over Internet Protocol.

Article II

Those addressed by the provisions of the attached regulation shall rectify their status in accordance with its provisions within 3 (three) months from the date of its entry into force.

Article III

The aforementioned decision 34/2012 is hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

the Regulation on the Service Quality Requirements That the Licensee Shall Provide issued by Decision 28/2016,

and the approval of the Board of Directors of the Telecommunications Regulatory Authority,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the quality of telecommunications services.

Article II

The aforementioned Regulation on the Service Quality Requirements That the Licensee Shall Provide is hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.
