Royal Decree 85/2020 regarding the Public Authority for Civil Aviation

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 18/2008 Determining the Competences of the Ministry of Environment and Climate Affairs and Adopting Its Organisational Structure,

Royal Decree 33/2012 Establishing the Public Authority for Civil Aviation,

and Royal Decree 43/2013 Promulgating the System of the Public Authority for Civil Aviation,

and in pursuance of public interest,

have decreed as follows

Article I

The name of the “Public Authority for Civil Aviation” is hereby amended to the “Civil Aviation Authority.”

Article II

The competences relating to climate affairs are hereby assigned to the Civil Aviation Authority from the Ministry of Environment and Climate Affairs as specified in the attached annex.

Article III

All allocations, assets, rights, obligations, and holdings relating to climate affairs in the Ministry of Environment and Climate Affairs are hereby transferred to the Civil Aviation Authority “the Directorate General of Meteorology.”

Article IV

The employees concerned with climate affairs of the Ministry of Environment and Climate Affairs are hereby transferred to the Civil Aviation Authority “the Directorate General of Meteorology” with their same financial grades, in accordance with the rules specified by the Council of Ministers.

Article V

The text of article 5 of the aforementioned System of the Civil Aviation Authority is hereby replaced with the following text:

“The administration of the authority and the management of its affairs shall be undertaken by a board of directors formed by a decision of the Council of Ministers, and the term of membership of the board shall be 3 (three) years renewable for a single similar term.”

Article VI

The text of article 5 of the aforementioned Royal Decree 33/2012 is hereby replaced with the following text:

“The Civil Aviation Authority shall have a president with the special grade appointed by royal decree.”

Article VII

The phrase “Ministry of Environment and Climate Affairs” wherever it occurs in the laws and royal decrees relating to climate affairs is hereby replaced with the phrase “Civil Aviation Authority.” The phrase “Minister of Environment and Climate Affairs” wherever it occurs in laws and royal decrees relating to climate affairs is hereby replaced with the phrases “Chairman of the Board of Directors of the Civil Aviation Authority” or “President of the Civil Aviation Authority” as the case may be. The phrases “Public Authority for Civil Aviation” and “Executive President of the Public Authority for Civil Aviation” wherever they occur in the laws and royal decrees are hereby replaced with the phrases “Civil Aviation Authority” and “President of the Civil Aviation Authority.”

Article VIII

Article IV of the aforementioned Royal Decree 33/2012 is hereby repealed, as well as all that is contrary to this decree or in conflict with its provisions.

Article IX

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Annex
Competences Relating to Climate Affairs

1. Monitoring and evaluating climate change, in order to maintain the safety of environmental, social, and economic systems.

2. Contributing to the development of scientific research in climate fields, exchanging experiences, and collecting and making use of scientific data.

3. Raising awareness and instilling the understanding of the need to cope with exceptional climatic conditions among all segments of society.

4. Proposing draft laws and royal decrees relating to climate affairs and issuing regulations and decisions relating to them.

5. Enhancing and developing cooperation in climate fields with other concerned bodies in other states and with specialised regional and international organisations and institutions.

6. Implementing the decisions of international agreements relating to climate affairs to which the Sultanate is a party, in coordination with the concerned bodies.

7. Representing the Sultanate in regional and international conferences, events, and meetings relating to climate affairs.

8. Any other competences prescribed in laws and royal decrees.
