Royal Decree 40/2019 Establishing the Western Hajar Starlight Reserve in the Governorate of Dakhiliyah

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Natural Reserves and Wildlife Conservation Law promulgated by Royal Decree 6/2003,

and in pursuance of public interest,

have decreed as follows

Article I

A natural reserve named “Western Hajar Starlight Reserve in the Governorate of Dakhiliyah” is hereby established, and the area, of which the dimensions are specified in the attached annex and map, is hereby designated to it.

Article II

The Minister of Environment and Climate Affairs shall issue the regulations and decisions for implementing this decree in coordination with the concerned ministries and bodies, provided they include the manner for managing the reserve, rules governing public entry, prescribed fees, timing of visits, permitted activities, banned activities, and appropriate administrative penalties in each case.

Article III

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 39/2019 Issuing the Implementation System for the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction, signed in  the United Nations Headquarters on 2 February 1993, 

Royal Decree 122/94 Ratifying the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction,

the Implementation System for the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction promulgated by Royal Decree 21/97,

and the Penal Law promulgated by Royal Decree 7/2018,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached system shall apply in regard to the implementation of the aforementioned Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction.

Article II

The Minister Responsible for Foreign Affairs shall issue the decisions necessary for the implementation of the provisions of the attached system.

Article III

The aforementioned Royal Decree 21/97 is hereby repealed, as well as every provision contrary to the attached system or in conflict with its provisions.

Article IV

This decree shall be published in the Official Gazette, and comes into force after the lapse of 90 (ninety) days from the date of its publication.

Royal Decree 38/2019 Establishing Oman Credit and Financial Information Centre and Issuing Its System

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Banking Law promulgated by Royal Decree 114/2000,

and in pursuance of public interest,

have decreed as follows

Article I

A centre named “Oman Credit and Financial Information Centre” is hereby established subordinate to the Central Bank of Oman, and it shall be governed by the provisions of the attached system.

Article II

Oman Credit and Financial Information Centre shall enjoy legal personality, as well as financial and administrative independence to undertake its work.

Article III

All assets, data, and their systems in the Banking Credit Information Statistics Directorate of the Central Bank of Oman shall be transferred to Oman Credit and Financial Information Centre.

Article IV

The board of governors of the Central Bank of Oman shall issue the regulations and decisions necessary for implementing the provisions of this decree and attached system, and until they are issued, the regulations and decisions in force in the Central Bank of Oman shall continue to operate in regard to that which is not governed by a special text in this decree and the attached system, and to the degree that they do not contradict with their provisions.

Article V

All that is contrary to this decree, and the attached system, or is in conflict with their provisions, is hereby repealed.  

Article VI

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Capital Market Authority: Decision 2/2019 Issuing the Acquisition and Takeover Regulation

Based on the Capital Market Law promulgated by Royal Decree 80/98,

the Executive Regulation of the Capital Market Law issued by Decision 1/2009,

the approval of the Board of Directors of the Capital Market Authority,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the acquisition and takeover of the shares of a public joint stock company listed on the Muscat Securities Market.

Article II

All that is contrary to the attached regulation, or in conflict with its provisions, is hereby repealed.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 37/2019 Transferring the Competence of Geological Heritage Preservation to the Ministry of Heritage and Culture

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

Royal Decree 49/2014 Establishing the Public Authority for Mining and Issuing Its System,

and Royal Decree 40/2016 Determining the Competences of the Ministry of Heritage and Culture and Approving its Organisational Structure,

and in pursuance of public interest,

have decreed as follows

Article I

The Ministry of Heritage and Culture shall assume the competence of geological heritage preservation, and shall impose the necessary controls for its protection, by transfer from the Public Authority for Mining.

Article II

The records, obligations, and assets related to geological heritage shall be transferred from the Public Authority for Mining to the Ministry of Heritage and Culture.

Article III

The Minister of Heritage and Culture and the Chief Executive Officer of the Public Authority for Mining shall issue the decisions necessary to implement this decree.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 36/2019 Amending Some Provisions of the Capital Market Law

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Capital Market Law promulgated by Royal Decree 80/98,

and in pursuance of public interest,

have decreed as follows

Article I

The text of article 52 of the Capital Market Law promulgated by Royal Decree 80/98 is hereby replaced with the following text:

The board of directors of the authority shall be formed by a decision of the Council of Ministers on the basis of a proposal by the minister, and the term of the membership of the board shall be 4 (four) years renewable for a single term or similar terms.

Article II

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article III

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 35/2019 Issuing the Cultural Heritage Law

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the National Heritage Protection Law promulgated by Royal Decree 6/80,

and Royal Decree 40/2016 Determining the Competences of the Ministry of Heritage and Culture and Approving Its Organisational Structure,

and after presentation to Majlis Oman,

and in pursuance of public interest,

have decreed as follows

Article I

The attached Cultural Heritage Law shall apply.

Article II

The Minister of Culture and Heritage shall issue the executive regulation of this law within one year from the date of its entry into force, as well as the decisions necessary for implementing its provisions, and until they are issued, the regulations and decisions in force shall continue to operate to the degree that they do not contradict with its provisions.

Article III

The National Heritage Protection Law promulgated by Royal Decree 6/80 is hereby repealed, as well as every provision contrary to this law or in conflict with its provisions.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.
