Royal Oman Police: Decision 53/2023 Amending Some Provisions of the Executive Regulation of the Unified Customs Law of the Cooperation Council for the Arab States of the Gulf

Based on Royal Decree 67/2003 Implementing the Unified Customs Law of the Cooperation Council for the Arab States of the Gulf,

the Executive Regulations of the Unified Customs Law of the Cooperation Council for the Arab States of the Gulf issued by Decision 23/2005,

and the decision of the Committee for Financial and Economic Cooperation Council for the Arab States of the Gulf at its Meeting 114 held on 7 November 2021,

and in pursuance of public interest,

it is hereby decided

Article I

The text of article 29(3) of the aforementioned Executive Regulation of the Unified Customs Law of the States of the Cooperation Council for the Arab States of the Gulf is hereby replaced with the following text:

3. The use of the materials covered by the exemption or by a reduced customs tariff in accordance with the provisions of the system (law) and the relevant legislation issued within the framework of the council in a manner other than the purpose or objective for which they were imported, or their replacement, sale, or disposal without the approval of the administration and the payment of the customs taxes (duties) arising on them.

Article II

All that is contrary to this decision, or in conflict with its provisions, is hereby repealed.

Article III

This decision shall be published in the Official Gazette, and comes into force on 1 March 2023.

Ministry of Higher Education, Research, and Innovation: Ministerial Decision 19/2023 Amending Some Provisions of Ministerial Decision 19/2018 Establishing the National University of Science and Technology

Based on the System of Private Universities promulgated by Royal Decree 41/99,

Royal Decree 42/99 Regarding the Establishment of Private Colleges and Higher Institutes,

Royal Decree 98/2020 Amending the Name of the Ministry of Higher Education to the Ministry of Higher Education, Research, and Innovation, Determining Its Competences, and Adopting Its Organisational Structure,

and Ministerial Decision 19/2018 Establishing the National University of Science and Technology,

and in pursuance of public interest,

it is hereby decided

Article I

The text of article I of the aforementioned Ministerial Decision 19/2018 is hereby replaced with the following text:

Article I

A private university is hereby established through the merger of Caledonian College of Engineering and Oman Medical College named the National University of Science and Technology. It shall have legal personality, and its headquarters shall be in the Governorate of Muscat, and it shall comprised 5 (five) colleges, which are: College of Engineering, College of Medicine and Health Sciences, College of Pharmacy, College of Advanced Technology, and International Maritime College Oman.

Article II

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 12/2023 Ratifying the Agreement between the Government of the Sultanate of Oman and the Government of the Republic of Kazakhstan Establishing the Omani-Kazakh Joint Committee

We, Haitham bin Tarik, the Sultan of Oman,

after perusal of the Basic Statute of the State,

and the Agreement between the Government of the Sultanate of Oman and the Government of the Republic of Kazakhstan Establishing the Omani-Kazakh Joint Committee signed in the city of Muscat on 1 February 2023,

and in pursuance of public interest,

have decreed as follows

Article I

The aforementioned agreement is hereby ratified in the form attached.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Based on the System for the Collection of Taxes, Fees, and Other Amounts Due to Units of the Administrative Apparatus of the State promulgated by Royal Decree 32/94,

the Criminal Procedures Law promulgated by Royal Decree 97/99,

the Income Tax Law promulgated by Royal Decree 28/2009,

the Excise Tax Law promulgated by Royal Decree 23/2019,

and the Value Added Tax Law promulgated by Royal Decree 121/2020,

and in pursuance of public interest,

it is hereby decided

Article I

Those occupying the positions provided in the attached schedule in the Tax Authority are hereby conferred–each within the scope of his competence—judicial enforcement status in the application of the provisions of the aforementioned System for the Collection of Taxes, Fees, and Other Amounts Due to Units of the Administrative Apparatus of the State, the aforementioned Income Tax Law, the aforementioned Excise Tax Law, the aforementioned Value Added Tax Law, and the regulations and decisions issued in the implementation of their provisions.

Article II

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 10/2023 Allocating Some Lands for the Purposes of Renewable Energy and Clean Hydrogen Projects

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 5/81 Governing the Usufruct of the Lands of the Sultanate of Oman,

Royal Decree 88/82 Adopting the Executive Regulation Governing the Usufruct of the Lands of the Sultanate of Oman,

the Oil and Gas Law promulgated by Royal Decree 8/2011,

Royal Decree 93/2020 Amending the Name of the Ministry of Housing to the Ministry of Housing and Urban Planning, Determining Its Competences, and Adopting Its Organisational Structure,

Royal Decree 96/2020 Amending the Name of the Ministry of Oil and Gas to the Ministry of Energy and Minerals, Determining Its Competences, and Adopting Its Organisational Structure,

and Royal Decree 128/2020 Establishing a Closed Omani Joint Stock Company Named Energy Development Oman SAOC,

and in pursuance of public interest,

have decreed as follows

Article I

Lands owned by the state and specified in the masterplan attached to this decree are hereby allocated for the purposes of renewable energy and clean hydrogen projects.

Article II

It is not permitted to grant any rights over the lands stipulated in article I of this decree or to dispose of them by the relevant government entities in any manner of disposal except with the prior written approval of the Ministry of Energy and Minerals.

Article III

The grant of usufruct of the lands stipulated in article I of this decree shall be to Hydrogen Oman Company on the basis of a request by the Ministry of Energy and Minerals detailing the area of the land subject of the usufruct in accordance with the legally prescribed procedures.

Article IV

Oman Hydrogen Company may divide the lands subject of the usufruct granted to it, and may contract with others to use these divided lands for the purposes of renewable energy and clean hydrogen projects by way of an auction subject to the principles of openness, equal opportunity, equality, and freedom of competition.

Article V

The Minister of Energy and Minerals may, within 30 (thirty) days from the date of the issuance of this decree, approve some projects allocated for renewable energy and clean hydrogen which have been signed without carrying out the auction stipulated in article IV of this decree.

Article VI

The Minister of Energy and Minerals shall issue the principles and controls for practising activities relating to renewable energy and clean hydrogen projects.

Article VII

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article VIII

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Ministry of Commerce, Industry, and Investment Promotion: Ministerial Decision 67/2023 Deeming an Omani Standard Specification Binding

Arabic Based on Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, Determining Its Competences, and Adopting Its Organisational Structure, and Ministerial Decision 12/2012 Adopting the Gulf Technical Regulation 246/2011 regarding the Labels of Tobacco Products Packaging as a Binding Omani Standard Specification, and in pursuance of public interest,

it is hereby decided

Article I

Omani Standard Specification OS 1655:2022 for Plain Packaging of Tobacco Products is hereby deemed a binding Omani standard specification.

Article II

An administrative fine not exceeding 1,000 (one thousand) Rial Omani shall be imposed on anyone who violates the provisions of this decision, and the fine shall be doubled if the violation is repeated.

Article III

The aforementioned Ministerial Decision 12/2012 is hereby repealed, as well as all that is contrary to this decision or in conflict with its provisions.

Article IV
