Royal Decree 75/2022 Approving the Exploration and Mining Concession Agreement between the Sultanate of Oman and Minerals Development Oman First for Block 11B

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the Mineral Resources Law promulgated by Royal Decree 19/2019,

and the Exploration and Mining Concession Agreement between the Sultanate of Oman and Minerals Development Oman First LLC for Block 11B signed on 17 October 2022,

and in pursuance of public interest,

have decreed as follows

Article I

The aforementioned exploration and mining concession agreement is hereby approved.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Ministry of Agriculture, Fisheries, and Water Resources: Ministerial Decision 240/2022 Suspending the Receipt of Applications for the Approval for Obtaining the Licence for the Activity of Retail Sale in Specialised Stores of Fish, Other Sea Foods, and Their Products

Based on the Aquatic Living Resources Law promulgated by Royal Decree 20/2019,

Royal Decree 92/2020 Amending the Name of the Ministry of Agriculture and Fisheries to the Ministry of Agriculture, Fisheries, and Water Resources, Determining Its Competences, and Adopting Its Organisational Structure,

and the Executive Regulation of the Law of Sea Fishing and Protection of Aquatic Living Resources issued by Ministerial Decision 4/94,

and in pursuance of public interest,

it is hereby decided

Article I

The receipt of applications for the approval for obtaining the licence for the activity of retail sale in specialised stores for fish, other sea foods, and their products shall be temporarily suspended for a period of 6 (six) months.

Article II

This decision shall be published in the Official Gazette, and comes into force after 7 (seven) days from the date of its publication.

Telecommunications Regulatory Authority: Decision TRA/1152/2/3/2022-4 Amending Some Provisions of the Regulation Governing the Registration and Use of Radio Frequencies and Devices and Determining Their Prices

Based on the Telecommunications Law promulgated by Royal Decree 30/2002,

the Executive Regulation of the Telecommunications Law promulgated by Decision 144/2008,

the Regulation Governing the Registration and Use of Radio Frequencies and Devices and Determining Their Prices issued by Decision 133/2008,

the approval of the Board of Directors of the Telecommunications Regulatory Authority,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

The text of article 11 of the aforementioned decision 133/2008 is hereby replaced with the following text:

“The authority shall issue the necessary annexes to implement the provisions of this regulation and to make periodic amendments to them in accordance with the recommendations and decisions of the International Telecommunication Union, international organisations, and market requirements, and they shall be published on the website of the authority.”

Article II

Schedules 51: Fee for Registration of International Telecommunications Services and Schedule 52: Fee for Usage of International Telecommunications Services provided in clause 8.6.2.3 of article 8 of the aforementioned Regulation Governing the Registration and Use of Radio Frequencies and Devices and Determining Their Prices are hereby replaced with the following schedules:

Registration Fee:

Registration fee = total bandwidth (megahertz) × coverage factor × 4,000 (four thousand) Rial Omani × frequency factor

Schedule 51: Registration Fee for International Telecommunications Services.”

Usage Fee:

Usage fee = total bandwidth (megahertz) × coverage factor × 10,000 (ten thousand) Rial Omani × frequency factor

Schedule 52: Fee for Usage of International Telecommunications Services.”

Article III

A new schedule numbered 53bis is hereby added to clause 8.6.2.3 of article 8 of the aforementioned Regulation Governing the Registration and Use of Radio Frequencies and Devices and Determining Their Prices as follows:

“And in accordance with this formula, the frequency factor is determined as follows:

Article IV

Annexes C, D, E, F, G, I, K, J, M, and N attached to the aforementioned Regulation Governing the Registration and Use of Radio Frequencies and Devices and Determining Their Prices are hereby repealed.

Article V

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Ministry of Labour: Ministerial Decision 437/2022 Amending the System of the Formation, Registration, and Work of Labour Unions, Labour Federations, and the General Federation for Workers of the Sultanate of Oman

Based on the Labour Law promulgated by Royal Decree 35/2003,

and the System of Formation, Registration, and Work of Labour Unions, Labour Federations, and the General Federation for Workers of the Sultanate of Oman issued by Ministerial Decision 500/2018,

and in pursuance of public interest,

it is hereby decided

Article I

The attached amendments are hereby made to the provisions of the aforementioned System of Formation, Registration, and Work of Labour Unions, Labour Federations, and the General Federation for Workers of the Sultanate of Oman.

Article II

The administrative bodies of labour unions and labour federations and the Board of Directors of the General Federation for Workers of the Sultanate of Oman existing on the date of the entry into force of this decision shall continue until the date of expiry of their term, unless terminated earlier for any other reason.

Article III

All that is contrary to the attached amendments, or in conflict with their provisions, is hereby repealed.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

the Executive Regulation of the Industrial Property Rights Law issued by Ministerial Decision 105/2008,

the Regulation Governing Domain Names issued by Decision 119/2012,

Decision 120/2012 Determining the Fees for Registrar Accreditation and the Fees for Registering Domain Names under the (.om) and (.عمان) Top-Level Domains,

the approval of the Ministry of Finance,

and the approval of the Board of Directors of the Telecommunications Regulatory Authority,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the governance of domain names.

Article II

The aforementioned decisions 119/2012 and 120/2012 are hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article III

This decision shall be published in the Official Gazette, and comes into force after the lapse of 4 (four) months from the date of its publication.

Royal Decree 73/2022 Adopting the Organisational Structure of the State Financial and Administrative Audit Institution

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the State Financial and Administrative Audit Law promulgated by Royal Decree 111/2011,

Royal Decree 6/2012 Adopting the Organisational Structure of the State Financial and Administrative Audit Institution,

and the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

and in pursuance of public interest,

have decreed as follows

Article I

The organisational structure of the State Financial and Administrative Audit Institution is hereby adopted in accordance with the attached annex.

Article II

The aforementioned Royal Decree 6/2012 is hereby repealed, as well as all that is contrary to this decree or in conflict with its provisions.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Supreme Judicial Council: Decision 196/2022 Specifying the Circumstances and Controls for the Witnessing of Documents

Arabic Consolidated Text Based on the Law of Public Notaries promulgated by Royal Decree 40/2003, and Royal Decree 35/2022 regarding the Governance of the Administration of Judicial Affairs, and in pursuance of public interest,

it is hereby decided

Article I

The circumstances in which the witnessing of documents is required are specified as follows:

– Powers of attorney including the sale, purchase, gift, or assignment of one or more real estate.

– Powers of attorney including the withdrawal or receipt of sums from banks.

– Acknowledgements of all kinds.

– Undertakings of all kinds.

– Contracts transferring ownership (contract of sale, contract of gift) which do not fall within the legal competences of other entities.

Article II

The controls for the witnessing of documents are specified as follows:

– That the witnessing is done by two persons.

– That the person witnessing is rational and adult.

– That the person witnessing understands the content of the document.

Article III
