Royal Decree 8/2023 Appointing an Undersecretary to the Ministry of Commerce, Industry, and Investment Promotion for Investment Promotion

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Civil Service Law promulgated by Royal Decree 120/2004,

and in pursuance of public interest,

have decreed as follows

Article I

Ibtisam bint Ahmed bin Said Al-Faroujiya is hereby appointed Undersecretary of the Ministry of Commerce, Industry, and Investment Promotion for Investment Promotion.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Ministry of Labour: Ministerial Decision 75/2023 Amending Some Provisions of Decision 8/2011 Determining Jobs of Special Nature Exempted from the Vacancy Announcement Requirement when Appointing

Based on the Civil Service Law promulgated by Royal Decree 120/2004,

Royal Decree 89/2020 Establishing the Ministry of Labour, Determining Its Competences, and Adopting Its Organisational Structure,

and Decision 8/2011 Determining Jobs of a Special Nature Exempted from the Vacancy Announcement Requirement When Appointing,

and in pursuance of public interest,

it is hereby decided

Article I

The positions of “Director and Assistant Director of Educational Studies and International Cooperation in the Ministry of Education” is hereby replaced by the positions of “Director and Assistant Director of the Technical Office for Studies and Development in the Ministry of Education” provided in article I of the aforementioned Decision 8/2011, and the positions of “Director and Assistant Director of Innovation and Science Olympiad in the Ministry of Education” is also hereby replaced by the positions of “Director and Assistant Director of Knowledge Development and International Studies in the Ministry of Education” provided in the aforementioned article I.

Article II

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Ministry of Social Development: Ministerial Decision 42/2023 Changing the Name of the Oman Society for Petroleum Services to the “Oman Society for Energy (OPAL)”

Based on the Civil Associations Law promulgated by Royal Decree 14/2000,

Ministerial Decision 322/2001 Founding the Oman Society for Petroleum Services,

and the approval of the Extraordinary General Meeting on 14 November 2022 regarding Changing the Name of the Oman Society for Petroleum Services to the Oman Society for Energy (OPAL),

and in pursuance of public interest,

it is hereby decided

Article I

The name “Oman Society for Petroleum Services” provided in article I of the aforementioned Ministerial Decision 322/2001 is hereby amended to its new name “Oman Society for Energy (OPAL)”.

Article II

This decision shall be published in the Official Gazette, and comes into force on the date of its issuance.

Supreme Judicial Council: Decision 38/2023 Establishing an Office to Provide Public Notary Services in the Invest in Oman Lounge at the Building of the Civil Aviation Authority in the Wilayat of Seeb

Based on the Law Governing the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

Royal Decree 35/2022 regarding the Governance of the Administration of Judicial Affairs,

and the Law of Public Notaries promulgated by Royal Decree 40/2003,

and in pursuance of public interest,

it is hereby decided

Article I

An office for providing public notary services is hereby established in the “Invest in Oman Lounge” located in the building of the Civil Aviation Authority in the Wilayat of Seeb subordinate to the Directorate of the Public Notary in Seeb.

Article II

Records and stamps used in the office mentioned in article I shall be identified with the label “Directorate of the Public Notary in Seeb (B)”.

Article III

This decision shall be published in the Official Gazette, and comes into force after 30 (thirty) days from the date of its publication.

it is hereby decided

Article I

Sabra bint Hamad bin Salim Al-Aufiya hereby replaces Maryam bint Rashid bin Said Al-Mishaqriya in the membership of the Municipal Council of the Governorate of Dakhiliya.

Article II

This decision shall be published in the Official Gazette, and comes into force on the date of its issuance.

Consumer Protection Authority: Decision 1/2023 Amending Some Provisions of the Executive Regulation of the Consumer Protection Law

Based on Royal Decree 26/2011 Establishing the Consumer Protection Authority,

the System of the Consumer Protection Authority promulgated by Royal Decree 53/2011,

the Consumer Protection Law promulgated by Royal Decree 66/2014,

the Executive Regulation of the Consumer Protection Law issued by Decision 77/2017,

the approval of the Council of Ministers,

and the approval of the Board of Directors of the Consumer Protection Authority,

and in pursuance of public interest,

it is hereby decided

Article I

The text of article 2 of the Executive Regulation of the Consumer Protection Law is hereby replaced with the following text:

Relevant entities may propose amendments to the provisions of the regulation and present them to the Council of Ministers for approval. If they are approved, the chairman of the board shall undertake the procedures for the amendment.

Article II

All that is contrary to this decision, or in conflict with its provisions, is hereby repealed.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Small and Medium Enterprises Development Authority: Decision 56/2023 Issuing the Regulation of the Registration of Micro, Small, and Medium Enterprises and the Issuance of Riyada Card

Based on Royal Decree 107/2020 Establishing the Small and Medium Enterprises Development Authority, Determining Its Competences, and Adopting Its Organisational Structure,

Decision 69/2017 Determining the Fees and the Financial Consideration for Services Provided by the Small and Medium Enterprises Development Authority,

and Decision 70/2021 regarding the Assignment of Privileges, Facilities, and Incentives Relating to the Riyada Card,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the registration of micro, small, and medium enterprises and the issuance of the Riyada card.

Article II

The aforementioned Decision 70/2021 is hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article III

The owners of micro, small, and medium enterprises shall rectify their status in accordance with the provisions of the attached regulation within a period not exceeding 90 (ninety) days from the date of its entry into force.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Ministry of Social Development: Ministerial Decision 36/2023 Issuing the Regulation on the Supervision of Non-profit Associations and Organisations regarding Anti-money Laundering and Counter-terrorist Financing

Based on the Civil Associations Law promulgated by Royal Decree 14/2000,

Royal Decree 32/2003 Determining the Competences of the Ministry of Social Development and Adopting Its Organisational Structure,

the Law of Anti-money Laundering and Counter-terrorist Financing promulgated by Royal Decree 30/2016,

and the Regulation on the Conditions, Rules, and Procedures for Granting Licences to Collect Money from the Public issued by Ministerial Decision 53/2010,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the supervision of non-profit associations and organisations regarding anti-money laundering and counter-terrorist financing.

Article II

Non-profit associations and organisations shall rectify their status in accordance with the provisions of the attached regulation within 3 (three) months from the date of its entry into force.

Article III

All that is contrary to the attached regulation, or in conflict with its provisions, is hereby repealed.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Ministry of Commerce, Industry, and Investment Promotion: Ministerial Decision 45/2023 Deeming a Gulf Standard Specification as a Binding Omani Standard Specification

Arabic Based on Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, Determining Its Competences, and Adopting Its Organisational Structure, and in pursuance of public interest,

it is hereby decided

Article I

The Gulf standard GSO 2698:2022 for the technical requirements for electric vehicles is hereby deemed as a binding Omani standard specification.

Article II

An administrative fine not exceeding 1,000 (one thousand) Rial Omani shall be imposed on anyone who violates the provisions of this decision, and the fine shall be doubled if the violation is repeated.

Article III

Royal Decree 7/2023 Approving the Accession of the Sultanate of Oman to the Treaty of Amity and Cooperation in Southeast Asia and its Amending Protocols

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the Treaty of Amity and Cooperation in Southeast Asia, done at Denpasar on 24 February 1976,

the First Protocol Amending the Treaty of Amity and Cooperation in Southeast Asia, done at Manila on 15 December 1987,

the Second Protocol Amending the Treaty of Amity and Cooperation in Southeast Asia, done at Manila on 25 July 1998,

and the Third Protocol Amending the Treaty of Amity and Cooperation in Southeast Asia, done at Vietnam on 23 July 2010,

and in pursuance of public interest,

have decreed as follows

Article I

The accession of the Sultanate of Oman to the Treaty of Amity and Cooperation in Southeast Asia and its aforementioned amending protocols is hereby approved in the form attached.

Article II

Competent entities shall deposit the instrument of accession to the aforementioned treaty and its amending protocol in accordance with its provisions.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.
