Royal Decree 67/2003 Implementing the Unified Customs Law of the Cooperation Council for the Arab States of the Gulf

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

 the Customs System Law promulgated by Royal Decree 22/78 and its amendments,

the Financial Law promulgated by Royal Decree 47/98 and its amendments,

the Law on Customs Valuation of Imported Goods promulgated by Royal Decree 83/2000 and its amendments,

the Law of Free Zones promulgated by Royal Decree 56/2002,

Royal Decree 112/2000 Ratifying the Protocol of Accession of the Sultanate of Oman to the Marrakesh Agreement Establishing the World Trade Organization,

the decision of the Supreme Council of the Cooperation Council for the Arab States of the Gulf at the meeting held in the Kingdom of Bahrain during the month of December 2000,

the Unified Customs Law of the States of the Cooperation Council for the Arab States of the Gulf whose implementation was approved by the decision of the Supreme Council of the Cooperation Council at the meeting held in the Sultanate of Oman during the month of December 2001,

and the decision of the Supreme Council of the Cooperation Council for the Arab States of the Gulf at the meeting held in the State of Qatar during the month of December 2002,

and in pursuance of public interest,

have decreed as follows

Article I

The Unified Customs Law of the Cooperation Council for the Arab States of the Gulf shall apply, with the exception of:

1. The provisions of article 97, which shall apply from the issuance of the decision implementing its provisions.

2. The provisions of article 109, which shall apply from the date of the agreement of the financial and economic cooperation committee on permitting nationals of the states of the council to practise the profession of customs clearance.

The provisions stated in the attached annex shall be taken into consideration when implementing the aforementioned law.

Article II

The phrase "customs tax" hereby replaces the phrase "customs duties" wherever found in royal decrees, laws, and decisions in force.

Article III

The Law on Customs Valuation of Imported Goods and the Customs System Law are hereby repealed, with the exception of the provisions relating to the recovery of customs taxes in the case of re-export outside the states of the council, and the practice of the profession of customs brokerage or clearance, which shall continue to operate until the date specified in clauses 1 and 2 of article I of this decree. 

All that is contrary to this decree is also hereby repealed.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the date specified by the decision of the Supreme Council of the Cooperation Council of the Arab States of the Gulf issued during the month of December 2001.

Royal Decree 66/2003 Appointing a Non-Resident Ambassador

Arabic We, Qaboos bin Said, the Sultan of Oman after perusal of the Basic Statute of the State issued by Royal Decree 101/96, and the Diplomatic and Consular Corps Law issued by Royal Decree 40/86 and its amendments, and in pursuance of public interest,

have decreed as follows

Article I

Ambassador Ahmed bin Nasser bin Hamad Al-Mahrazi, Our ambassador to the People’s Democratic Republic of Algeria, is hereby appointed a non-resident ambassador extraordinary and plenipotentiary of Ours to the Republic of Ghana and the Gabonese Republic.

Royal Decree 63/2003 Regarding the National Security Council

Arabic

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Royal Order Establishing the National Security Committee and Determining Its Mandates,

and in pursuance of public interest,

have decreed as follows

Article I

The name of the mentioned “National Security Committee” is hereby amended to the “National Security Council”.

Article II

The council has the mandate to consider all matters relating to national security.

Article III

The council must be held under the chairmanship of His Majesty the Sultan when His Majesty deems appropriate, otherwise, it must be held under the chairmanship of the Minister of the Royal Office and the membership of:

– The Inspector General of Police and Customs.

– The Head of the Internal Security Service.

– The Chief of Staff of the Sultan’s Armed Forces.

– The Head of the Liaison and Coordination Agency.

The council may request the attendance of whomever it deems fit from non-members.

Article III

The council must have a secretary from among the personnel of the Royal Office appointed by the minister.

Article V

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

The mentioned amendment to the Air Transport Agreement Between the Government of the Sultanate of Oman and the Federal Government of Austria is hereby ratified.

Royal Decree 61/2003 Declaring Public Benefit Status to the Project to Beautify and Develop the Area Surrounding Bait Al-Baranda in the Wilayat of Muttrah

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Law on the Expropriation for Public Benefit issued by Royal Decree 64/78 and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

The project for beautifying and developing the area surrounding Bait Al-Baranda in the Wilayat of Muttrah specified in the attached note and masterplan is hereby deemed a public benefit project.

Article II

The competent entities may seize, through direct execution, lands necessary for the project stipulated in the preceding article, in accordance with the provisions of the mentioned Law on the Expropriation for Public Benefit.

Article III

This decree must be published in the Official Gazette, and comes into force on the date of its publication.

Royal Decree 60/2003 Amending the Law on Organising the Technical Positions in the Ministry of Legal Affairs and Specifying the Financial Treatment of Their Occupants

Arabic We, Qaboos bin Said, the Sultan of Oman after perusal of the Basic Statute of the State issued by Royal Decree 101/96, and the Law on Organising the Technical Positions in the Ministry of Legal Affairs and Specifying the Financial Treatment of Their Occupants issued by Royal Decree 90/2000 and its amendments, and in pursuance of public interest,

have decreed as follows

Article I

The text of the last paragraph of article 5 of the Law on Organising the Technical Positions in the Ministry of Legal Affairs and Specifying the Financial Treatment of Their Occupants is hereby replaced with the following text:

It is not permitted to promote advisors and senior advisors (B) before the lapse of at least four years in the position. However, it is permitted to reappoint to the higher position directly whenever the interest of the work so requires and the following conditions are met:

1. That they have spent at least three years in the position. It is permitted to reduce this period to two years if the person intended to be reappointed holds a higher educational qualification than the one prescribed to occupy the new position, or if he was loaned from a non-Omani entity and at least six months have passed since his promotion from it to a higher position if he occupied it when he is loaned to the Ministry of Legal Affairs to be appointed directly to the new position.

2. That the period of their service in the field of legal work exceeds by two years at least the prescribed periods for occupying the positions prior to the new position. The period may be reduced to one year if the person intended to be appointed holds a higher educational qualification than the qualification prescribed for occupying the new position and at least two years have passed since he obtained it.

3. That there is a vacant position or sufficient financial allocations are available.

Reappointment must be issued by a decision by the minister.

Article II

have decreed as follows

The mentioned agreement is hereby ratified.

and Royal Decree 64/78 Issuing the Law on the Expropriation for Public Benefit and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

The project for expanding Buraimi Souq specified in the attached note and masterplan is hereby deemed a public benefit project.

Article II

The competent entities may seize, through direct execution, real estate and land necessary for the project specified in article 1, and all establishments on them, in accordance with the provisions of the mentioned Law on the Expropriation for Public Benefit.

Article III

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.
