Royal Decree 59/2002 Declaring Public Benefit Status to the Bishara Gold Mine Project in the Village of Sayya—Wilayat of Yanqul

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Law on the Expropriation for Public Benefit issued by Royal Decree 64/78 and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

The Bishara Gold Mine Project in the Village of Sayya in the Wilayat of Yanqul, specified in the attached note and masterplan, is hereby deemed a public benefit project.

Article II

The competent entities may seize, through direct execution, real estate and land necessary for the project specified in article I, and all establishments on them, in accordance with the provisions of the mentioned Law on the Expropriation for Public Benefit.

Article III

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 61/2002 Forming the Board of Governors of the Central Bank of Oman

Arabic We, Qaboos bin Said, the Sultan of Oman after perusal of the Basic Statute of the State issued by Royal Decree 101/96, Royal Decree 36/97 Recomposing the Board of Governors of the Central Bank of Oman, and Royal Decree 114/2000 Issuing the Banking Law, and in pursuance of public interest,

have decreed as follows

Article I

The Board of Governors of the Central Bank of Oman is hereby formed under Our chairmanship and the membership of the following:

1. Dr Ali bin Mohammed bin Moosa—Deputy Chairman

2. Sheikh Salim bin Hilal bin Ali Al-Khalili

3. Hamoud bin Sangour bin Hashim Al-Zadjali

4. Yahya bin Mohammed bin Naseeb

5. Salim bin Abdullah bin Said Al-Rawas

6. A representative of the Ministry of Finance

The membership is for a period of five years from the date of entry into force of this decree.

Article II

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article III

have decreed as follows

Article I

The mentioned Agreement Establishing a Free Trade Zone Between the Sultanate of Oman and the Republic of Iraq is hereby ratified.

Article II

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 60/2002 Increasing the Capital of the Central Bank of Oman

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

Royal Decree 10/99 Increasing the Capital of the Central Bank of Oman,

and Royal Decree 114/2000 Issuing the Banking Law,

and in pursuance of public interest,

have decreed as follows

Article I

The capital of the Central Bank of Oman is hereby increased from two hundred and fifty million Rial Omani to three hundred million Rial Omani.

Article II

The Central Bank of Oman shall transfer the increase stipulated in article I of this decree from the general reserve account of the bank.

Article III

This decree must be published in the Official Gazette, and comes into force on 1 April 2002.

Royal Decree 53/2002 Amending Article 7 of the Annex to the Constitutive Provisions of the Oman Development Bank SAOG Attached to Royal Decree 18/97

the Commercial Companies Law 4/74 and its amendments,

the Financial Law issued by Royal Decree 47/98 and its amendments,

and Royal Decree 18/97 Establishing an Omani Public Joint Stock Company Named “Oman Development Bank”,

and in pursuance of public interest,

have decreed as follows

Article I

The text of Article 7 of the Annex to the Constitutive Provisions of the Oman Development Bank SAOG attached to the mentioned Royal Decree 18/97 is hereby replaced with the following text:

The bank must be managed by a board of directors consisting of a chairman and four members representing the Ministry of Finance, Ministry of National Economy, Ministry of Commerce and Industry, and Ministry of Agriculture and Fisheries. It is permitted for two members of competence and experience nominated by the ordinary general meeting of the bank to be added to them.

The appointment of the chairman and members must be issued by a decision by the Council of Ministers on the basis of a proposal by the minister supervising the Ministry of Finance. The representative of this ministry must be the deputy chairman to replace him in the event of his absence or if he is unable to attend.

Article II

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 51/2002 Amending Some Provisions of the Insurance Companies Law

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Insurance Companies Law issued by Royal Decree 12/79 and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

The text of article 59 of the mentioned Insurance Companies Law is hereby replaced with the following text:

The minister may impose on insurance companies subject to the provisions of this law a proportional fee calculated on the total direct premiums due to the company for all policies during the year, provided that this fee does not exceed 4% for all insurance operations.

Article II

A new article numbered 59bis is hereby added to the mentioned Insurance Companies Law with the following text:

A fund named the “Insurance Emergency Fund” is hereby established in the ministry to assist in resolving crises facing the insurance sector in the Sultanate.

This fund must be financed by a percentage of the fees stipulated in article 59 of this law. The minister shall issue a decision specifying this percentage and any other resources for the fund, stating the cases in which assistance is provided, and governing work in the fund.

Article III

This decree must be published in the Official Gazette, and comes into force on the date of its publication.
