Royal Decree 76/2010 Amending the Provisions of Some Laws concerning Land

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

Royal Decree 5/80 Issuing the Land Law,

Royal Decree 5/81 Governing the Usufruct of the Lands of the Sultanate,

Royal Decree 88/82 Adopting the Executive Regulation Governing the Usufruct of the Lands of the Sultanate,

Royal Decree 81/84 on the System for Government Land Entitlement,

Royal Decree 24/95 Amending the Provisions of Some Laws concerning Land,

Royal Decree 2/98 Issuing the Real Estate Register System,

Royal Decree 21/2004 Regulating the Ownership of Real Estate by Nationals of the States of Cooperation Council for the Arab States of the Gulf in Member States,

and Royal Decree 12/2006 regarding the System of the Ownership of Real Estate in Integrated Tourism Complexes,

and in pursuance of  public interest,

have decreed as follows

Article I

The attached amendments are hereby made to some laws concerning land.

Article II

All that is contrary to this decree is hereby repealed.

Article III

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 54/2010 Establishing the Oman Academic Accreditation Authority

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

the System of Public Authorities and Establishments issued by Royal Decree 116/91,

the Financial Law issued by Royal Decree 47/98,

Royal Decree 65/98 Establishing the Higher Education Council,

Royal Decree 74/2001 Establishing the Accreditation Council,

Royal Decree 6/2002 Determining the Competences of the Ministry of Higher Education and Adopting Its Organisational Structure,

and the Civil Service Law promulgated by Royal Decree 120/2004,

and in pursuance of public interest,

have decreed as follows

Article I

An authority named the “Oman Academic Accreditation Authority” is hereby established to replace the Accreditation Council, subordinate to the Higher Education Council, and the attached system applies in regard to it.

Article II

The chairman of the board of directors of the authority shall issue the necessary regulations and decisions to implement the provisions of the attached system.

Article III

Royal Decree 74/2001 Establishing the Accreditation Council is hereby repealed.

Article IV

This decree must be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 36/2010 regarding Oman Housing Bank SAOC

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Commercial Companies Law 4/74,

Royal Decree 51/77 Establishing Oman Housing Bank,

the System of Apartments and Floors Ownership promulgated by Royal Decree 48/89,

the System for the Collection of Taxes, Fees, and Other Amounts Due to Units of the Administrative Apparatus of the State promulgated by Royal Decree 32/94,

the Financial Law promulgated by Royal Decree 47/98,

the Banking Law promulgated by Royal Decree 114/2000,

and the Civil and Commercial Procedures Law promulgated by Royal Decree 29/2002,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached system shall apply in regard to Oman Housing Bank SAOC.

Article II

The duration of Oman Housing Bank specified in its articles of association attached to the aforementioned Royal Decree 51/77 is extended for twenty years starting from 1 August 2007.

Article III

All that is contrary to the provisions of the attached system, or in conflict with them, is hereby repealed.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication, with the exception article II, which comes into force on the date specified in it.

Royal Decree 38/2010 Amending the System of Oman Investment Fund issued by Royal Decree 14/2006

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and Royal Decree 14/2006 Establishing the Oman Investment Fund and Issuing Its System,

and in pursuance of public interest,

have decreed as follows

Article I

The attached amendments are hereby made to the mentioned System of Oman Investment Fund issued by Royal Decree 14/2006.

Article II

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article III

This decree must be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 37/2010 Issuing the Social Housing Law

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Social Residences Law promulgated by Royal Decree 35/77,

and Royal Decree 24/2000 on the Continuation of Granting Housing Loans and Assistance to Those with Low Income without Interest,

and in pursuance of public interest,

have decreed as follows

Article I

The attached Social Housing Law shall apply.

Article II

The provisions of this law shall apply to all applications for housing loans and assistance registered with the Ministry of Housing prior to the entry into force of its provisions and which have not yet been decided upon.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its publication.

Article III

The Minister of Housing shall issue the executive regulation for the attached law and the decisions necessary for its implementation, and until they are issued, the regulations and decisions in force shall continue to operate to the degree that they do not contradict with the provisions of this law.

Article IV

The aforementioned Royal Decree 35/77 is hereby repealed, as well as all that is contrary to the provisions of the attached law.

Article V

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 35/2010 Establishing the Higher Judicial Institute

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Judicial Authority Law promulgated by Royal Decree 90/99,

the Law of the Administrative Court promulgated by Royal Decree 91/99,

and the Public Prosecution Law promulgated by Royal Decree 92/99,

and in pursuance of public interest,

have decreed as follows

Article I

An institute named the “Higher Judicial Institute” is hereby established. It has legal personality and is subordinate to the Minister of Justice, and the provisions of the attached system apply in its regard.

Article II

The headquarters of the institute must be in the Wilayat of Nizwa.

Article III

The Minister of Justice shall issue a decision on the organisational structure of the institute and shall also issue the necessary regulations and decisions for implementing the provisions of the attached system, including the regulations and decisions relating to the system of study and training programmes, after the approval of the board of the institute and in coordination with the relevant entities.

Article IV

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article V

This decree must be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 18/2010 Declaring Public Benefit Status to the Ibri/Dreez/Maskan Road Dualisation Project

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Law on the Expropriation for Public Benefit issued by Royal Decree 64/78,

and in pursuance of public interest,

have decreed as follows

Article I

The Ibri/Dreez/Maskan road dualisation project specified in the attached note and masterplan is hereby deemed a public benefit project.

Article II

The competent entities may seize, through direct execution, real estate and land necessary for the mentioned project, as well as all establishments on them, in accordance with the provisions of the mentioned Law on the Expropriation for Public Benefit.

Article III

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 17/2010 Issuing the Law of Delegation and Substitution in Competences

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Law of Interpretations and General Provisions 3/1973,

and the Law Governing the Administrative Apparatus of the State promulgated by Royal Decree 26/75,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached law shall apply in regard to the delegation and substitution in competences.

Article II

The text of article 14 of the Law of Interpretations and General Provisions 3/1973 and the text of article 15 of the Law Governing the Administrative Apparatus of the State promulgated by Royal Decree 26/75 are hereby repealed, as well as all that is contrary to the attached law, or is in conflict with its provisions.

Article III

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Law on the Expropriation for Public Benefit issued by Royal Decree 64/78,

and in pursuance of public interest,

have decreed as follows

Article I

The project for removing occupancies and encroachments located within the buffers of the Salalah Free Zone specified in the attached note and masterplan is hereby deemed a public benefit project.

Article II

The competent entities may seize, through direct execution, real estate and land necessary for the mentioned project, as well as all establishments on them, in accordance with the provisions of the mentioned Law on the Expropriation for Public Benefit.

Article III

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.
