Royal Decree 22/2023 Declaring Public Benefit Status for the Project to Construct a Dam to Protect against Flood Risks (Z4C) in Wadi Al-Zuhaimi in the Wilayat of Liwa in the Governorate of Batinah North

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Law on the Expropriation for Public Benefit promulgated by Royal Decree 64/78,

and in pursuance of public interest,

have decreed as follows

Article I

The project for the construction of a dam to protect against flood risks (Z4C) in Wadi Al-Zuhaimi in the Wilayat of Liwa in the Governorate of Batinah North—specified in the attached note and masterplan—is hereby deemed a public benefit project.

Article II

The competent entities may seize, through direct execution, real estate and land necessary for the project specified in article I, and all establishments on them, in accordance with the provisions of the aforementioned Law on the Expropriation for Public Benefit.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

after perusal of the Basic Statute of the State,

and the Law on the Expropriation for Public Benefit promulgated by Royal Decree 64/78,

and in pursuance of public interest,

have decreed as follows

Article I

The project for the construction of a dam to protect against flood risks in Wadi Tahwa in the Wilayat of Al-Kamil Wal Wafi in the Governorate of Sharqiyah South—specified in the attached note and masterplan—is hereby deemed a public benefit project.

Article II

The competent entities may seize, through direct execution, real estate and land necessary for the project specified in article I, and all establishments on them, in accordance with the provisions of the aforementioned Law on the Expropriation for Public Benefit.

Article III

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Law on the Expropriation for Public Benefit promulgated by Royal Decree 64/78,

and in pursuance of public interest,

have decreed as follows

Article I

The project for the construction of dams to protect against flood risks (ANS02 and ANS03) in Wadi Al-Ansab in the Wilayat of Bawshar in the Governorate of Muscat—specified in the attached note and masterplan—is hereby deemed a public benefit project.

Article II

The competent entities may seize, through direct execution, real estate and land necessary for the project specified in article I, and all establishments on them, in accordance with the provisions of the aforementioned Law on the Expropriation for Public Benefit.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Ministry of Endowments and Religious Affairs: Ministerial Decision 181/2023 Amending Some Provisions of the Regulation of Masjid Mosques and Jami Mosques

Based on Royal Decree 6/99 Determining the Competences of the Ministry of Endowments and Religious Affairs and Adopting Its Organisational Structure,

the Regulation of Masjid Mosques and Jami Mosques issued by Ministerial Decision 955/2010,

and in pursuance of public interest,

it is hereby decided

Article I

The attached amendments are hereby made to the aforementioned Regulation of Masjid Mosques and Jami Mosques.

Article II

All that is contrary to the attached amendments, or in conflict with their provisions, is hereby repealed.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Based on the Civil Defence Law promulgated by Royal Decree 76/91,

Royal Decree 3/2013 Establishing the Civil Defence and Ambulance Authority,

the System of the Civil Defence and Ambulance Authority promulgated by Royal Decree 68/2014,

Royal Decree 39/2021 regarding the Civil Defence and Ambulance Authority,

Decision 159/2020 Determining the Fees for Licences and Certificates Issued by the Civil Defence and Ambulance Authority,

the approval of the Ministry of Finance,

and the approval of the Board of Directors of the Civil Defence and Ambulance Authority,

and in pursuance of public interest,

it is hereby decided

Article I

The fees for licences and certificates issued by the Civil Defence and Ambulance Authority are hereby determined in accordance with the attached annexes.

Article II

The aforementioned Ministerial Decision 159/2020 is hereby repealed, as well as all that is contrary to this decision or in conflict with its provisions.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Based on the Commercial Companies Law promulgated by Royal Decree 18/2019,

the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

and Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, Determining Its Competences, and Adopting Its Organisational Structure,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply to the governance of the practice of the activity of consumer cooperative.

Article II

This decision shall be published in the Official Gazette, and comes into force after 90 (ninety) days from the date of its publication.

Governorate of Dakhiliya: Decision 138/2023 Determining the Fees and Prices Collected by the Governorate of Dakhiliya

Based on the System of Governorates promulgated by Royal Decree 36/2022,

Ministerial Decision 32/2018 Determining the Fees, Prices, Insurances, and Financial Guarantees Collected by the Ministry of Regional Municipalities and Water Resources,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

The fees and prices collected by the Governorate of Dakhiliya are hereby determined in accordance with annexes 1-10 attached to this decision.

Article II

Without prejudice to any punishment more severe stipulated in another law, whoever fails to pay the fees due in accordance with this decision shall be fined a monthly delay fine of 6% (six percent) of the value of the fee due, calculated after the lapse of 30 (thirty) days from the due date, and the fine shall be doubled for each month for which the violation continues, provided that its total does not exceed the value of the fee due in accordance with the provisions of this decision.

Article III

All that is contrary to this decision, or in conflict with its provisions, is hereby repealed.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the date of its issuance.

Based on the System for the Handling and Use of Chemicals promulgated by Royal Decree 46/95,

the Criminal Procedures Law promulgated by Royal Decree 97/99,

the Law on Environment Protection and Pollution Prevention promulgated by Royal Decree 114/2001,

the Law on the Protection of Drinking Water Sources from Pollution promulgated by Royal Decree 115/2001,

the Nature Reserves and Wildlife Conservation Law promulgated by Royal Decree 6/2003,

and Ministerial Decision 118/2009 Conferring Judicial Enforcement Status to Some Employees of the Ministry of Environment and Climate Affairs,

and in pursuance of public interest,

it is hereby decided

Article I

Those occupying the positions provided in the attached schedule in the Environment Authority are hereby conferred—each within the scope of his competence—judicial enforcement status in the application of the provisions of the aforementioned System for the Handling and Use of Chemicals, the Law on Environment Protection and Pollution Prevention, the Law on the Protection of Drinking Water Sources from Pollution, the Law on Nature Reserves and the Conservation of Wildlife, and the regulations and decisions issued in the implementation of their provisions.

Article II

The aforementioned Ministerial Decision 118/2009 is hereby repealed, as well as all that is contrary to this decision or in conflict with its provisions.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Ministry of Social Development: Ministerial Decision 87/2023 Issuing the Governance Regulation for Practising the Profession of Psychological Counselling and Family Counselling

Based on Royal Decree 32/2003 Determining the Competences of the Ministry of Social Development and Adopting Its Organisational Structure,

the Governance Regulation for Private Counselling and Family Counselling Centres issued by Ministerial Decision 294/2013,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the governance of the practice of the profession of psychological counselling and family counselling.

Article II

Those addressed by the provisions of the attached regulation shall rectify their status in accordance with its provisions within 6 (six) months from the date of its entry into force.

Article III

The aforementioned Decision 294/2013 is hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 19/2023 Promulgating the Maritime Law

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the Maritime Law promulgated by Royal Decree 35/81,

and the Law Governing Maritime Navigation in Territorial Waters promulgated by Royal Decree 98/81,

and after presentation to Majlis Oman,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached Maritime Law shall apply.

Article II

The Minister of Transport, Communications, and Information Technology shall issue the necessary regulations and decisions for implementing the provisions of the attached law, and until they are issued, the regulations and decisions in force continue to operate to the degree that they do not contradict with its provisions.

Article III

The Maritime Law promulgated by Royal Decree 35/81 and the Law Governing Maritime Navigation in Territorial Waters promulgated by Royal Decree 98/81 are hereby repealed, as well as all that is contrary to the attached law or in conflict with its provisions.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.
