Case Summary: Supreme Court (Labour Circuit) Contestation 427/2017 (Equal Treatment of Employees)

An employee sued his employer for failing to pay him a cost-of-living allowance that his colleagues receive. The Supreme Court confirmed that it has the power to re-adjust the salary of an employee to match the salaries of other employees in the same organisation in accordance with article 11 of the Labour Law if the employees are working in the same circumstances, have the same qualifications, and agree to the same work conditions. However, the Supreme Court decided that the employee was unable to establish that the facts of his employment met the requirements of article 11 of the Labour Law, and therefore rejected his claims.

Case Summary: Supreme Court (Labour Circuit) Contestation 792/2016

An employee of German nationality sued his employer for unlawful dismissal and claimed compensation. The Primary Court in Muscat sided with the employee and ordered the employer to pay the employee compensation, but this decision was later overturned by the Supreme Court in Muscat on the grounds that the Primary Court in Muscat had no jurisdiction to rule on this matter due to the existence of an arbitration clause between the employee and the employer. The Supreme Court ruled that the arbitration clause is invalid because it constituted a waiver of workers' rights that are guaranteed by the Labour Law and referred the case back to the Court of Appeal in Muscat to reconsider its merits.

Case Summary: Supreme Court (Labour Circuit) Contestation 717/2016 (Verbal Insult to Employer)

Royal Decree 7/2018 Promulgating the Penal Law

Consolidated Text Arabic

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Omani Penal Law promulgated by Royal Decree 7/74,

and after presentation to Majlis Oman,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached Penal Law shall apply.

Article II

The Omani Penal Law promulgated by Royal Decree 7/74 is hereby repealed, as well as all that is contrary to this law or in conflict with its provisions.

Article III

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 4/2018 Declaring Public Benefit Status to the Project of Flood Risk Protection System of Wadi Al-Jifnain (jif7) in the Wilayat of Seeb in the Governorate of Muscat

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Law on the Expropriation for Public Benefit promulgated by Royal Decree 64/78,

and in pursuance of public interest,

have decreed as follows

Article I

The project for flood risk protection system of Wadi Al-Jifnain (jif7) in the Wilayat of Seeb in the Governorate of Muscat—specified in the attached note and masterplan—is hereby deemed a public benefit project.

Article II

Competent bodies may seize, through direct execution, real estate and land necessary for the project, and all establishments on them, in accordance with the aforementioned Law on the Expropriation for Public Benefit.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 3/2018 Establishing the Media Training Centre and Promulgating Its System

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and Royal Decree 35/2009 Determining the Competences of the Ministry of Information,

and in pursuance of public interest,

have decreed as follows

Article I

A centre named the "Media Training Center" is hereby established under the supervision of the Minister of Information, and governed by the provisions of the attached system.

Article II

The Chairman of the Board of Directors of the Media Training Centre shall issue the necessary regulations and decisions for implementing the provisions of the attached system.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.
