Ministry of Manpower: Ministerial Decision 541/2013 Determining the Minimum Periodic Allowance for Omanis Working in the Private Sector and the Procedures and Conditions for Its Disbursement

Based on the Labour Law promulgated by Royal Decree 35/2003,

Royal Decree 76/2004 Determining the Competences of the Ministry of Manpower and Adopting Its Organisational Structure,

and Ministerial Decision 32/2012 Determining the Minimum Periodic Allowance and the Procedures and Conditions for Its Disbursement,

and in pursuance of public interest,

it is hereby decided

Article I

Without prejudice to any better benefit prescribed for the worker, the minimum periodic allowance for Omanis working in the private sector shall be 3% of the basic wage, due on 1 January of each year.

Article II

The following is required for the worker to be entitled to the periodic allowance:

1. The period of his service shall not be less than 6 (six) months with the employer.

2. He must not have obtained a rating of “poor” in the annual performance report.

Article III

The employer shall raise the minimum periodic allowance in accordance with article I of this decision.

Article IV

The aforementioned Ministerial Decision 32/2012 is hereby repealed, as well as all that is contrary to this decision or in conflict with its provisions.

Article V

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.
