Ministry of Labour: Ministerial Decision 3/2021 Governing the Practice of Some Professions

Arabic

Based on the Labour Law promulgated by Royal Decree 35/2003,

and Royal Decree 89/2020 Establishing the Ministry of Labour, Determining Its Competences, and Adopting Its Organisational Structure,

and in pursuance of public interest,

it is hereby decided

Article I

The practice of the following professions in private sector establishments is hereby restricted to Omanis:

1. Petrol Station Manager.

2. Professions Related to Optical Activities and Businesses and the Sale of Eyeglasses.

Article II

Labour authorisations for Non-Omani manpower and work permits issued for the professions specified in article I of this decision remain valid until their expiration date.

Article III

All that is contrary to this decision, or in conflict with its provisions, is hereby repealed.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 5/2021 Transforming Muscat Securities Market into a Closed Omani Joint Stock Company Named Muscat Stock Exchange SAOC

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 33/74 regarding Companies Established by Royal Decree,

the Capital Market Law promulgated by Royal Decree 80/98,

the Commercial Companies Law promulgated by Royal Decree 18/2019,

and the Privatisation Law promulgated by Royal Decree 51/2019,

and in pursuance of public interest,

have decreed as follows

Article I

A closed Omani joint stock company is hereby established by virtue of the provisions of this decree named Muscat Stock Exchange SAOC, owned by the Oman Investment Authority.

Article II

All allocations, assets, rights, obligations, holdings, and records of the Muscat Securities Market are hereby transferred to the Muscat Stock Exchange SAOC.

Article III

The employees of the Muscat Securities Market are hereby transferred to the Muscat Stock Exchange SAOC in accordance with the provisions of the aforementioned Privatisation Law.

Article IV

All competences of the Muscat Securities Market stipulated in the aforementioned Capital Market Law are hereby transferred to the Muscat Stock Exchange SAOC, provided that they do not contradict with the objectives of the company stipulated in its articles of association.

Article V

Muscat Stock Exchange SAOC shall undertake all its activities within the framework of the provisions of the Capital Market Law and shall be subject to the oversight and supervision of the Capital Market Authority. Muscat Stock Exchange SAOC shall issue all necessary regulations and decisions to exercise its competences and achieve its objectives and specify the fees for the services it provides, after the approval of the Capital Market Authority, and until those regulations and decisions are issued, the regulations and decisions in force shall continue to operate to the degree that they do not contradict with the provisions of this decree.

Article VI

The Capital Market Authority shall specify the general policy that Muscat Stock Exchange SAOC must adhere to. It shall also issue the regulations and decisions governing the licences granted to the company to undertake its activities, as well as the fees that it must pay to the authority.

Article VII

The Board of Directors of Muscat Stock Exchange SAOC shall be formed in accordance with its articles of association, and the Capital Market Authority may object to the decision appointing the board of directors within 15 (fifteen) days from the date it is notified of the decision.

Article VIII

Muscat Stock Exchange SAOC shall obtain the approval of the Capital Market Authority before appointing each of the chief executive officer of the company and the senior management employees.

Article IX

Oman Investment Authority shall draft the constitutive contract of Muscat Stock Exchange SAOC and its articles of association and complete its registration procedures in accordance with the provisions of the aforementioned Commercial Companies Law, prior to the date of the entry into force of this decree.

Article X

Muscat Securities Market is hereby abolished, and all that is contrary to this decree or in conflict with its provisions is hereby repealed.

Article XI

This decree shall be published in the Official Gazette, and comes into force after the lapse of 90 (ninety) days from the date of its publication.

Royal Decree 4/2021 Granting Class I Licence to Oman Future Communications Company to Provide Basic Mobile Public Telecommunications Services

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Telecommunications Law promulgated by Royal Decree 30/2002,

and in pursuance of public interest,

have decreed as follows

Article I

A Class I Licence is hereby granted to Oman Future Communications Company to provide basic mobile public telecommunications services in accordance with the provisions of the attached licence.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Ministry of Agriculture, Fisheries, and Water Resources: Ministerial Decision 6/2021 Banning the Import of Live Birds from Some States

Arabic Based on the Veterinary Quarantine Law promulgated by  Royal Decree 45/2004, the Executive Regulation of the Veterinary Quarantine Law issued by Ministerial Decision 107/2008, Ministerial Decision 292/2020 Banning the Import of Live Birds from Some Areas in the Russian Federation and the Kingdom of the Netherlands, and the recommendation of the competent veterinary entity regarding the prohibition of importing live birds and their products, derivatives, and residues from certain countries, and in pursuance of public interest,

it is hereby decided

Article I

The import of live birds, their products, derivatives, and residues from the Kingdom of Sweden, the Kingdom of the Netherlands, the French Republic, the Republic of Ireland, the Republic of Ukraine, Scotland in the United Kingdom, and the Tehran Province in the Islamic Republic of Iran is hereby banned until the reason for the ban ceases to exist and a decision is issued in this regard. Products that are heat treated in accordance with the Terrestrial Animal Health Code issued by the World Organization for Animal Health (OIE) are excluded.

Article II

The competent entities shall implement this decision, each in their fields of competence.

Article III

Tax Authority: Decision 1/2021 Determining the Threshold for Mandatory and Voluntary Registration

Based on the Value Added Tax Law promulgated by Royal Decree 121/2020,

and in pursuance of public interest,

it is hereby decided

Article I

The mandatory registration threshold in the application of article 55 of the aforementioned Value Added Tax Law is 38,500 (thirty-eight thousand five hundred) Rial Omani.

Article II

The voluntary registration threshold in the application of article 61 of the aforementioned Value Added Tax Law is 19,250 (nineteen thousand two hundred and fifty) Rial Omani.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 2/2021 Ratifying the General Budget of the State for Fiscal Year 2021

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Financial Law promulgated by Royal Decree 47/98,

and after presentation to Majlis Oman,

and in pursuance of public interest,

have decreed as follows

Article I

The General Budget of the State for Fiscal Year 2021 is hereby ratified in accordance with the attached schedules.

Article II

All units of the administrative apparatus of the state and other public legal persons shall implement the provisions of this decree each within its competence.

Article III

This decree shall be published in the Official Gazette, and comes into force on 1 January 2021.
