Royal Decree 44/2020 Approving the Accession of the Sultanate of Oman to the International Convention for the Protection of All Persons from Enforced Disappearance

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the International Convention for the Protection of All Persons from Enforced Disappearance done in New York on 20 December 2006,

and in pursuance of public interest,

have decreed as follows

Article I

The accession of the Sultanate of Oman to the International Convention for the Protection of All Persons from Enforced Disappearance is hereby approved in the form attached, subject to the following reservation:

First: The Sultanate of Oman declares that it does not recognise the competence of the Committee on Enforced Disappearances stipulated in article 33 of the aforementioned convention.

Second: The Sultanate of Oman declares that it is not bound by the provisions of paragraph 1 of article 42 of the aforementioned convention.

Article II

Competent bodies shall deposit the instrument of accession to the aforementioned convention in accordance with its provisions, subject to the aforementioned reservation.

Article III

This decree shall be published in the Official Gazette and shall come into force on the date of its issuance.

COVID-19 Supreme Committee Decision of 31 March 2020

Statement of the Supreme Committee

The Supreme Committee for Dealing with COVID-19 issued a new decision during its meeting today. It has decided to:

– Exempt employees of the government bodies from attending to workplace except for those whose nature of their jobs requires their presence to complete the necessary work. The rest of the employees shall carry out their work remotely as determined by the body at which the employee works.

– Some employees may be called to perform any necessary work at the workplace in case the public interest demands that. Heads of government units should take the necessary measures to ensure that the basic work is not affected by reducing the number of employees. They should, also, take the precautionary and preventive measures necessary to prevent the spread of the virus. As for the private sector, institutions and enterprises should take the necessary measures to reduce the number of employees to the minimum necessary for the sector to continue performing its basic work so that it cannot not be affected.

– The Committee stresses the absolute necessity of abiding by the procedures and measures established to prevent the spread of the virus. This decision shall take effect starting from tomorrow, Wednesday, April 1st, 2020.

– In the context of the efforts exerted to reduce the movement of citizens and residents aiming to curb the spread of the virus. the military and security services will take the necessary measures accordingly.

Therefore, the Committee calls on everyone to adhere to these procedures and to cooperate with these bodies in implementing them.

Royal Decree 43/2020 Ratifying the Multilateral Convention to Implement Tax Treaty Related Measures to Prevent Base Erosion and Profit Shifting

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Multilateral Convention to Implement Tax Treaty Related Measures to Prevent Base Erosion and Profit Shifting signed by the Sultanate on 26 November 2019,

and after presentation to Majlis Al-Shura,

and in pursuance of public interest,

have decreed as follows

Article I

The aforementioned convention is hereby ratified in the form attached.

Article II

Competent bodies shall deposit the instrument of ratification of the aforementioned convention in accordance with its provisions.

Article III

This decree shall be published in the Official Gazette and shall come into force on the date of its issuance.

Royal Decree 42/2020 Issuing the System of the Tax Authority and Approving Its Organisational Structure

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Income Tax Law promulgated by Royal Decree 28/2009,

the Excise Tax Law promulgated by Royal Decree 23/2019,

and Royal Decree 66/2019 Establishing the Tax Authority,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached Tax Authority System shall apply.

Article II

The organisational structure of the Tax Authority is hereby approved in accordance with the attached annex.

Article III

The Chairman of the Tax Authority shall exercise the competences prescribed to the Minister Responsible for Financial Affairs set out in the aforementioned Income Tax Law and Excise Tax Law, as well as any competences relating to issuing exemptions from income tax wherever they occur in the laws, systems, and royal decrees.

Article IV

The Chairman of the Tax Authority shall issue the necessary regulations and decisions for implementing the provisions of this decree and the attached system, and until they are issued, the regulations and decisions in force shall continue to operate to the degree that they do not contradict with their provisions.

Article V

All that is contrary to this decree and the attached system, or in conflict with their provisions, is hereby repealed.

Article VI

This decree shall be published in the Official Gazette and shall come into force on the date of its issuance.
