Royal Decree 27/2023 Promulgating the Higher Education Law

Arabic

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the System of Private Universities promulgated by Royal Decree 41/99,

Royal Decree 42/99 regarding the Establishment of Private Colleges and Higher Institutes,

the Educational Scholarships, Grants, and Aid Law promulgated by Royal Decree 83/2002,

Royal Decree 104/2005 Establishing the Unified Admission Centre,

Royal Decree 98/2020 Amending the Name of the Ministry of Higher Education to the Ministry of Higher Education, Research, and Innovation, Determining Its Competences, and Adopting Its Organisational Structure,

and Royal Decree 9/2021 regarding the Oman Authority for Academic Accreditation and Quality Assurance of Education,

and after presentation to Majlis Oman,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached Higher Education Law shall apply.

Article II

The Minister of Higher Education, Research, and Innovation shall issue the executive regulation of the attached law and the necessary decisions for implementing its provisions within a year from the date of its entry into force. Until they are issued, the existing regulations and decisions continue to operate to the degree that they do not contradict with its provisions.

Article III

Those addressed by the provisions of the attached law shall rectify their status in accordance with its provisions within one year from the date of its entry into force.

Article IV

The aforementioned royal decrees 41/99, 42/99, and 83/2002 are hereby repealed, as well as all that is contrary to this decree and the attached law, or in conflict with their provisions.

Article V

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 25/2023 Amending Some Provisions of Royal Decree 6/2006 regarding the Oman Plant and Trees Garden

Arabic We, Haitham bin Tarik, the Sultan of Oman after perusal of the Basic Statute of the State, the Nature Reserves and Wildlife Conservation Law promulgated by Royal Decree 6/2003, and Royal Decree 6/2006 Establishing the Oman Plant and Trees Garden, and in pursuance of public interest,

have decreed as follows

Article I

The texts of articles 1 and 3 of the aforementioned Royal Decree 6/2006 are hereby replaced with the following texts:

Article I

The area specified in the attached map is hereby made a protected natural site named “Oman Botanical Garden”, subordinate to the Ministry of Heritage and Tourism.

Article III

The Minister of Heritage and Tourism shall exercise all the powers stipulated in the aforementioned Nature Reserve and Wildlife Conservation Law in regard to the Oman Botanical Garden, and he shall issue the regulations and decisions implementing this decree in coordination with the relevant entities.

Article II

Royal Decree 26/2023 Reinstating Omani Nationality

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Omani Nationality Law promulgated by Royal Decree 38/2014,

and in pursuance of public interest,

have decreed as follows

Article I

Omani nationality is hereby reinstated to those named in the attached list.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 24/2023 Amending Some Provisions of the Law on Combating Narcotic Drugs and Psychotropic Substances

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Law on Combating Narcotic Drugs and Psychotropic Substances promulgated by Royal Decree 17/99,

and in pursuance of public interest,

have decreed as follows

Article I

The attached amendments to the aforementioned Law on Combating Narcotic Drugs and Psychotropic Substances shall be implemented.

Article II

All that is contrary to the attached amendments, or in conflict with their provisions, is hereby repealed.

Article III

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 23/2023 regarding the Marriage of Omanis to Foreigners

Arabic We, Haitham bin Tarik, the Sultan of Oman after perusal of the Basic Statute of the State, the Personal Status Law promulgated by Royal Decree 32/97, the Law of Public Notaries promulgated by Royal Decree 40/2003, the Omani Nationality Law promulgated by Royal Decree 38/2014, Royal Decree 58/93 Delegating in the Issuance of the Provisions Governing the Marriage of Omanis to Foreigners and Amending the Law Governing Omani Nationality, and Royal Decree 37/2022 Determining the Competences of the Ministry of Interior and Adopting Its Organisational Structure, and in pursuance of public interest,

have decreed as follows

Article I

The aforementioned Royal Decree 58/93 and the decisions issued in the implementation of its provisions are hereby repealed.

Article II

The provisions of this royal decree shall not prejudice the provisions of Islamic Sharia or public order, or any provision in applicable laws, royal decrees, and systems stipulating non-marriage to a foreigner as a condition for assuming and continuing in some public offices of special importance or nature.

Article III

Documents proving the marriage of Omanis to foreigners that takes place in the Sultanate of Oman shall be documented in accordance with the provisions of the relevant laws and royal decrees. Foreign documents proving such marriage shall be treated as official Omani documents after their attestation by the competent entities in the foreign state and the Omani Foreign Ministry.

Article IV

Documents proving the marriage of Omanis to foreigners issued by foreign official entities before the date of the entry into force of this royal decree in violation of the provisions governing the marriage of Omanis to foreigners applicable at the time shall be relied upon after their attestation by the Omani Foreign Ministry, to the degree they do not conflict with the provisions of article II of this decree.

Article V

The units of the administrative apparatus of the state and other public legal persons shall implement the provisions of this decree each in regard to its competence.

Article VI

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article VII

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication. Issued on: 25 Ramadan 1444 Corresponding to: 16 April 2023

Royal Decree 22/2023 Declaring Public Benefit Status for the Project to Construct a Dam to Protect against Flood Risks (Z4C) in Wadi Al-Zuhaimi in the Wilayat of Liwa in the Governorate of Batinah North

after perusal of the Basic Statute of the State,

and the Law on the Expropriation for Public Benefit promulgated by Royal Decree 64/78,

and in pursuance of public interest,

have decreed as follows

Article I

The project for the construction of a dam to protect against flood risks (Z4C) in Wadi Al-Zuhaimi in the Wilayat of Liwa in the Governorate of Batinah North—specified in the attached note and masterplan—is hereby deemed a public benefit project.

Article II

The competent entities may seize, through direct execution, real estate and land necessary for the project specified in article I, and all establishments on them, in accordance with the provisions of the aforementioned Law on the Expropriation for Public Benefit.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

have decreed as follows

Article I

The project for the construction of a dam to protect against flood risks in Wadi Tahwa in the Wilayat of Al-Kamil Wal Wafi in the Governorate of Sharqiyah South—specified in the attached note and masterplan—is hereby deemed a public benefit project.

Article II

The project for the construction of dams to protect against flood risks (ANS02 and ANS03) in Wadi Al-Ansab in the Wilayat of Bawshar in the Governorate of Muscat—specified in the attached note and masterplan—is hereby deemed a public benefit project.

Article II

The competent entities may seize, through direct execution, real estate and land necessary for the project specified in article I, and all establishments on them, in accordance with the provisions of the aforementioned Law on the Expropriation for Public Benefit.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 19/2023 Promulgating the Maritime Law

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the Maritime Law promulgated by Royal Decree 35/81,

and the Law Governing Maritime Navigation in Territorial Waters promulgated by Royal Decree 98/81,

and after presentation to Majlis Oman,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached Maritime Law shall apply.

Article II

The Minister of Transport, Communications, and Information Technology shall issue the necessary regulations and decisions for implementing the provisions of the attached law, and until they are issued, the regulations and decisions in force continue to operate to the degree that they do not contradict with its provisions.

Article III

The Maritime Law promulgated by Royal Decree 35/81 and the Law Governing Maritime Navigation in Territorial Waters promulgated by Royal Decree 98/81 are hereby repealed, as well as all that is contrary to the attached law or in conflict with its provisions.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 18/2023 Amending the Name of the Wildlife Reserve in the Governorate of Al-Wusta to the Arabian Oryx Sanctuary

Arabic We, Haitham bin Tarik, the Sultan of Oman after perusal of the Basic Statute of the State, and Royal Decree 4/94 regarding the Wildlife Reserve in the Governorate of Al-Wusta, and in pursuance of public interest,

have decreed as follows

Article I

The name of the “Wildlife Reserve in the Governorate of Al-Wusta” is hereby amended to the “Arabian Oryx Sanctuary” wherever it occurs in the aforementioned Royal Decree 4/94 and the annex attached to it.

Article II
