Royal Decree 93/99 Establishing the Supreme Judicial Council (Repealed)

Repealed by Royal Decree 9/2012.

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

the Judicial Authority Law issued by Royal Decree 90/99,

the Law of the Administrative Court issued by Royal Decree 91/99,

and the Public Prosecution Law issued by Royal Decree 92/99,

and in pursuance of public interest,

have decreed as follows

Article I

The Supreme Judicial Council is hereby composed under the chairmanship of His Majesty the Sultan and the membership of each of the following:

1. Minister of Justice—Deputy Chairman.

2. Inspector General of Police and Customs.

3. President of the Supreme Court.

4. President of the Administrative Court

5. Public Prosecutor.

6. The most senior Deputy President of the Supreme Court.

7. President of the Sharia Court Circuit in the Supreme Court.

8. Deputy President of the Administrative Court.

9. The most senior President of the Court of Appeal.

In the absence of a member from the mentioned judicial positions or the presence of an impediment to him, he is replaced by the person who is next in line in the entity he represents.

Article II

The Supreme Judicial Council shall meet under the chairmanship of His Majesty the Sultan, and it may convene under the chairmanship of the deputy chairman. In this case, it shall submit its recommendations to His Majesty the Sultan for approval.

Article III

The Supreme Judicial Council is competent to formulate the public policy of the judiciary, to ensure its independence, and to follow up on its development. For this purpose, it may:

1. Supervise the proper functioning of the courts and the Public Prosecution.

2. Follow up on the development of the courts and facilitate litigation and make it accessible to litigants.

3. Consider the nominations submitted by the competent entities to occupy judicial positions by appointment or promotion, which the law stipulates that their occupation is by royal decree.

4. Propose draft laws relating to the judiciary, consider the drafts submitted by the competent entities, and present matters it deems appropriate in this regard.

5. Express an opinion on draft agreements on judicial cooperation between the Sultanate and other states.

6. Other judicial matters that the law stipulates as falling within its mandates.

7. Any other matters that His Majesty the Sultan deems appropriate to present to the council for review and expressing an opinion on them.

Article IV

His Majesty the Sultan shall exercise the mandates of the Supreme Judicial Council during the period prior to the occupation of the judicial positions that form the council.

Article V

A coordination office must be established in the Diwan of Royal Court to present the matters and issues that fall within the mandates of the council, prepare the minutes of the sessions, and communicate the decisions and recommendations to the relevant entity to take the necessary measures to implement them.

Article VI

This decree must be published in the Official Gazette, and comes into force from the date of its publication.

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Law Governing Omani Nationality issued by Royal Decree 3/83 and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

Omani nationality is hereby granted to those named in the attached list.

Article II

This decree must be published in the Official Gazette, and comes into force on 5 June 1996.

Royal Decree 42/98 Approving the Petroleum Agreement Signed Between the Government of the Sultanate and Triton Oman Resources Inc,

the documents relating to the assignment by Triton Oman Resources Inc of part of its rights and obligations in the petroleum agreement signed on 10 June 1998 to Atlantis Holding Norway AS,

the assignment contract dated 1 January 1999, under which Triton Oman Resources Inc assigned part of its rights and obligations in the petroleum agreement signed on 10 June 1998 to Atlantis Holding Norway AS,

and the letter of the Minister of Oil and Gas dated 21 August 1999 approving the assignment,

and in pursuance of public interest,

have decreed as follows

Article I

The assignment by Triton Oman Resources Inc of fifty percent (50%) of its total rights and obligations in the petroleum agreement signed on 10 June 1998 to Atlantis Holding Norway AS is hereby approved,. which accepts this assignment, so that the final shares of the parties to the agreement are as follows:

50% Triton Oman Resources Inc

50% Atlantis Holding Norway AS

Article II

This decree must be published in the Official Gazette, and comes into force from the date of its issuance.

and the Labour Law issued by Royal Decree 34/73 and its amendments,

have decreed as follows

The Labour Law is hereby amended in accordance with the attached provisions.
