Royal Decree 37/98 Amending Some Provisions of Royal Decree 25/84 Governing the Criminal Judiciary

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and Royal Decree 25/84 Governing the Criminal Judiciary and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

The text of article III of the mentioned Royal Decree 25/84 is hereby replaced with the following text:

The criminal court in the capital, composed of the president of the court, the deputy president, or the most senior judge in it, and the membership of two judges, considers felony cases as defined in the Omani Penal Law. Its judgments are final after being reviewed and approved by the State Advisor for Criminal Affairs. It also considers appeals against judgments issued in misdemeanours, and its judgments in this case are final.

A committee must be formed of the State Advisor for Criminal Affairs, the State Advisor for Judicial Affairs, and the Grand Mufti of the Sultanate of Oman to express an opinion from a Sharia perspective on the death sentences before they are issued and ratified.

Article II

This decree must be published in the Official Gazette, and comes into force from the date of its issuance.

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the 1958 United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards,

and in pursuance of public interest,

have decreed as follows

Article I

The accession of the Sultanate of Oman to the mentioned 1958 United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards is hereby approved.

Article II

Competent entities shall undertake the procedures for acceding to the agreement in accordance with its provisions.

Article III

This decree must be published in the Official Gazette, and comes into force from the date of its issuance.

Royal Decree 31/71 Delegating the Application for the Accession of the Sultanate of Oman to the Membership of Certain International Financial Organisations,

the Banking Law 7/74 and its amendments,

Royal Decree 49/83 Ratifying the Increase of the Share of the Sultanate in the Special Drawing Rights of the International Monetary Fund,

Royal Decree 2/92 Ratifying the Increase of the Share of the Sultanate in the Special Drawing Rights of the International Monetary Fund,

the decision of the Board of Governors of the International Monetary Fund 98/2 issued on 6 February 1998,

and the decision of the Board of Governors of the Central Bank of Oman BG/1163/101/3/98/18 issued on 29 March 1998 regarding the approval of the increase of the share of the Sultanate of Oman in the International Monetary Fund,

and in pursuance of public interest,

have decreed as follows

Article I

The increase of the share of the Sultanate of Oman in the International Monetary Fund from 119.4 million to 194 million units of special drawing rights is hereby ratified. The Sultanate of Oman shall bear all the obligations arising from such increase in accordance with the laws in force in it.

Article II

All relevant entities shall implement this decree, each within its mandates.

Article III

This decree must be published in the Official Gazette, and comes into force from the date of its issuance.

Royal Decree 31/98 Issuing the System of Prevention and Protection of Agricultural Wealth

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and Royal Decree 30/92 Amending the Name of the Ministry of Agriculture and Fisheries and Determining Its Mandates,

Article I

The attached System of the Prevention and Protection of Agricultural Wealth hereby applies.

Article II

The Minister of Agriculture and Fisheries shall issue the executive regulation of this system.

Article III

Government entities shall implement the provisions of this system, each within its mandate.

Article IV

This decree must be published in the Official Gazette, and comes into force from the date of its publication.

Royal Decree 33/98 Amending the Civil Service Law

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Civil Service Law issued by Royal Decree 8/80 and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

The text of article 23 of the mentioned Civil Service Law is hereby replaced with the following text:

An officer may be reappointed to a vacant higher position if, during the service, he obtains a higher qualification in the field of specialisation required by the employing entity, the study that resulted with obtaining this qualification was carried out with the approval of the Ministry of Civil Service at the request of the employing entity, and the performance evaluation report of the officer for the year following his obtaining the qualification was at least Very Good.

Article II

This decree must be published in the Official Gazette, and comes into force from the date of its publication.
