Royal Decree 5/98 Amending Some Provisions of the Vehicle Insurance Law

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Vehicle Insurance Law promulgated by Royal Decree 34/94,

and in pursuance of public interest,

have decreed as follows

Article I

A second paragraph is hereby added to article 2(a) of the mentioned Vehicle Insurance Law with the following text:

All vehicles must be insured to cover the expenses of treating injuries incurred by the insured, his equivalent, and their family members from the accident, in accordance with the provisions of this law and the rules issued by a decision by the minister to regulate its conclusion. The determination of the insurance premium in this case must be in coordination with the Ministry of Commerce and Industry.

Article II

The text of article 5 of the mentioned Vehicle Insurance Law is hereby replaced with the following text:

(a) It is not permitted for the insurer or the insured to cancel the compulsory insurance on the vehicle in accordance with the provisions of this law during its validity as long as the licence of the vehicle remains valid. If such cancellation occurs, it has no effect. An exception is made in the case of the submission of a new insurance policy or certificate for the rest of the validity period of such insurance.

(b) If the period of compulsory insurance of the vehicle expires, its owner remains solely responsible for any claim against the vehicle resulting from any accident that occurs during the period of the interruption of insurance.

Article III

This decree must be published in the Official Gazette, and comes into force from the date of its publication.

Royal Decree 7/98 Amending Some Provisions of the System of the College of Sharia and Law Issued by Royal Decree 26/97

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

Royal Decree 13/97 Amending the Name of the Commercial Dispute Resolution Authority and Its Composition, Mandates, and System for Examining Claims and Requests for Arbitration Made Before It,

the System of the College of Sharia and Law issued by Royal Decree 26/97,

Royal Decree 84/97 Amending the Names of Some Ministries, Establishing a Ministry of Endowments and Religious Affairs, and Abolishing the Ministry of Development,

and Royal Decree 85/97 Recomposing the Council of Ministers,

and in pursuance of public interest,

have decreed as follows

Article I

The text of the first paragraph of article 7 of the mentioned System of the College of Sharia and Law is hereby replaced with the following text:

The college must have a board of trustees chaired by the Minister of Higher Education and the membership of the following:

– The Minister of Justice

– The Minister of Legal Affairs

– The Minister of Endowments and Religious Affairs

– The Inspector General of Police and Customs

– The President of the Criminal Court

– The Undersecretary of the Ministry of Higher Education

– The President of the Commercial Court

Article II

This decree must be published in the Official Gazette, and comes into force from 16 December 1997.

Royal Decree 6/98 Amending the Social Insurance Law

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

Royal Decree 72/91 Issuing the Social Insurance Law and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

The text of article 6(a) of the mentioned Social Insurance Law is hereby replaced with the following text:

(a) The authority must have a board of directors, formed under the chairmanship of the minister and the membership of:

– The Undersecretary of the Ministry of Social Affairs, Labour, and Vocational Training as deputy chairman, and to replace him in his absence.

– The Undersecretary of the Ministry of Commerce and Industry for Commerce and Industry.

– A representative of the Ministry of Finance selected by the Minister Supervising the Ministry of Finance.

– The Director General of the Directorate General of Labour Affairs.

– Two representatives of employers selected by the Oman Chamber of Commerce and Industry.

– Two insured workers selected by the minister.

The board of directors may invite to attend its sessions whoever it deems necessary from experts and advisors to seek their assistance without having a counted vote.

Article II

This decree must be published in the Official Gazette, and comes into force from the date of its publication.

Royal Decree 2/98 Issuing the Real Estate Register System

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Land Law promulgated by Royal Decree 5/80 and its amendments,

Royal Decree 5/81 Governing the Usufruct of the Lands of the Sultanate and its amendments,

the Financial Law promulgated by Royal Decree 56/82 and its amendments,

the System for Government Land Entitlement promulgated by Royal Decree 81/84 and its amendments,

the System for Apartments and Floors Ownership promulgated by Royal Decree 48/89,

and Royal Decree 24/95 Amending the Provisions of Some Laws concerning Land,

and in pursuance of public interest,

have decreed as follows

Article 1

The provisions of the attached system shall apply in regard to the Real Estate Register.

Article II

The Minister of Housing shall issue the regulations and decisions necessary for the implementation of the provisions of this system. Until such regulations and decisions are issued, the existing regulations continue to operate to the degree they do not conflict with the provisions of this system.

Article III

All that is contrary to the attached system, or in conflict with its provisions, is hereby repealed.

Article IV

This decree shall be published in the Official Gazette, and comes into force from the date of its publication.
