Royal Decree 1/2021 Adopting the Tenth Five-Year Development Plan 2021-2025

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the Economic Development Law of the Year 1975,

and Royal Decree 94/2020 Establishing the Ministry of Economy and Determining Its Competences,

and after presentation to Majlis Oman,

and in pursuance of public interest,

have decreed as follows

Article I

The Tenth Five-Year Development Plan 2021-2025, the objectives of which are outlined in the attached annex 1, is hereby adopted.

Article II

The Tenth Five-Year Development Plan shall be implemented in accordance with its financial framework as outlined in the attached annex 2 on the basis of the fiscal balance plan issued by the Ministry of Finance.

Article III

The national economy strategic directives for the plan outlined in the attached annex 3 are hereby adopted.

Article IV

The projects of the plan shall be adopted in accordance with the plan projects general directives set out in the attached annex 4.

Article V

The Ministry of Economy shall publish details of the plan in reports for this purpose.

Article VI

All units of the administrative apparatus of the state and other public legal persons shall implement the Tenth Five-Year Development Plan, without prejudice to the provisions of the applicable laws and systems.

Article VII

The Ministry of Economy shall issue a volume for strategic programs for the plan during the first quarter of 2021, provided that the projects of the first year of the plan are identified in coordination between the Ministry of Economy and concerned bodies.

Article VIII

The Ministry of Economy shall conduct a periodic evaluation of the plan in light of local, regional, and global developments.

Article IX

This decree shall be published in the Official Gazette, and comes into force on 1 January 2021.

Royal Decree 3/2021 Reinstating Omani Nationality

Arabic We, Haitham bin Tarik, the Sultan of Oman after perusal of the Basic Statute of the State, and the Omani Nationality Law promulgated by Royal Decree 38/2014, and in pursuance of public interest,

have decreed as follows 

Article I 

Omani nationality is hereby reinstated to Obaid bin Salim bin Said Al-Shehi.

Article II 

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance. Issued on: 17 Jumada Al-Awwal 1442 Corresponding to: 1 January 2021

after perusal of the Basic Statute of the State,

and the Judicial Authority Law promulgated by Royal Decree 90/99,

and in pursuance of public interest,

have decreed as follows 

Article I 

Those named in the attached list are hereby appointed judges to the Supreme Court.

Article II 

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 131/2020 regarding the Water and Wastewater Sector

Arabic We, Haitham bin Tarik, the Sultan of Oman after perusal of the Basic Statute of the State, the Law Granting the Concession of Salalah Electricity Facility promulgated by Royal Decree 20/2001, the Law on Granting the Concession of the Wastewater Facility in the Governorate of Dhofar promulgated by Royal Decree 16/2004, the Law on the Regulation and Privatisation of the Electricity and Related Water Sector promulgated by Royal Decree 78/2004, the  Law on Granting the Concession of the Wastewater Facility in the Governorate of Muscat promulgated by Royal Decree 69/2005, the System of the Public Authority for Water promulgated by Royal Decree 58/2009, the Privatisation Law promulgated by Royal Decree 51/2019, Royal Decree 61/2020 Establishing the Oman Investment Authority, Royal Decree 78/2020 Amending the Name of the Electricity and Related Water Sector Regulation Authority to the Authority for Public Services Regulation and Assigning Some Competences to It, and Royal Decree 92/2020 Amending the Name of the Ministry of Agriculture and Fisheries to the Ministry of Agriculture, Fisheries, and Water Resources, Determining Its Competences, and Adopting Its Organisational Structure, and in pursuance of public interest,

have decreed as follows

Article I

The Ministry of Agriculture, Fisheries, and Water Resources shall undertake proposing policies, strategies, and plans relating to the water and wastewater sector and submitting them to the Council of Ministers for approval.

Article II

The Authority for Public Services Regulation shall undertake the competences relating to the regulation of the activities of water and wastewater sector.

Article III

Oman Wastewater Services Company SAOC shall undertake the activities of water and wastewater in all governorates of the Sultanate, with the exception of the Governorate of Dhofar. Dhofar Power Company SAOC shall undertake the activities of water and wastewater in the Governorate of Dhofar.

Article IV

All assets, records, holdings, rights, and obligations of the Public Authority for Water are hereby transferred to Oman Wastewater Services Company SAOC. All assets, records, holdings, rights, and obligations of the General Directorate of Water in the Office of the Minister of State and Governor of Dhofar are hereby transferred to Dhofar Power Company SAOC. All assets, records, holdings, rights, and obligations relating to the water and wastewater sector in all units of the Administrative Apparatus of the State are also hereby transferred to Oman Wastewater Services Company SAOC and Dhofar Power Company SAOC, each according to its competence, in accordance with the provisions of the first and second paragraphs of this article. These transfers shall not affect the treatment of the legal commitments and contracts signed prior to the date of entry into force of this decree, and whose subject is any of the rights and obligations stated in the previous paragraph in terms of taxes and fees.

Article V

The employees of the Public Authority for Water are hereby transferred to Oman Wastewater Services Company SAOC, and the employees of the General Directorate of Water in the Office of the Minister of State and Governor of Dhofar are also hereby transferred to Dhofar Power Company SAOC, in accordance with the provisions of the aforementioned Privatisation Law. The employees of Salalah Wastewater Services Company SAOC are also hereby transferred to Dhofar Power Company SAOC, in accordance with the transformation methodology stipulated in article VI of this decree without prejudice to the benefits that may be prescribed to them by virtue of another law.

Article VI

The Ministry of Finance, in coordination with the Oman Investment Authority, shall prepare and implement the transformation methodology within a period not exceeding 6 (six) months from the date of entry into force of this decree.

Article VII

The Oman Investment Authority shall undertake the necessary measures to implement the provisions of this decree, in accordance with the provisions of the Commercial Companies Law.

Article VIII

Laws, royal decrees, regulations, and decisions relating to the water and wastewater sector in force on the date of issuance of this decree shall continue to operate until the law governing the water and wastewater sector is promulgated.

Article IX

The Public Authority for Water shall be abolished from the date of completion of the implementation of the transformation methodology stipulated in article VI of this decree, and all that is contrary to this decree or in conflict with its provisions is hereby repealed.

Article X

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance. Issued on: 23 Rabi Al-Thani 1442 Corresponding to: 9 December 2020

Royal Decree 128/2020 Establishing a Closed Omani Joint Stock Company Named Energy Development Oman SAOC

after perusal of the Basic Statute of the State,

Royal Decree 33/74 regarding Companies Established by Royal Decree,

the Oil and Gas Law promulgated by Royal Decree 8/2011,

and the Commercial Companies Law promulgated by Royal Decree 18/2019,

and in pursuance of public interest,

have decreed as follows

Article I

A closed Omani joint stock company is hereby established in accordance with the provisions of this decree and the attached annex named Energy Development Oman SAOC.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 129/2020 Transferring and Appointing in the Diplomatic Corps

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Law Governing the Foreign Ministry promulgated by Royal Decree 32/2008,

and in pursuance of public interest,

have decreed as follows

Article I

Sayyid Dr Ahmed bin Hilal bin Saud Al-Busaidi, Our ambassador to the Kingdom of Saudi Arabia, is hereby transferred, and is hereby appointed a non-resident ambassador extraordinary and plenipotentiary of Ours to the United Arab Emirates.

Article II

The following are hereby appointed:

1. Abdullah bin Nasser bin Musallam Al-Rahbi an ambassador extraordinary and plenipotentiary of Ours to the Arab Republic of Egypt, and a Permanent Representative for the Sultanate to the Arab League.

2. Moosa bin Hamdan bin Moosa Al-Tai an ambassador extraordinary and plenipotentiary of Ours to the United States of America.

3. Sheikh Hilal bin Marhoon bin Salim Al-Mamari an ambassador extraordinary and plenipotentiary of Ours to the Hashemite Kingdom of Jordan.

4. His Highness Sayyid Faisal bin Turki bin Mahmood Al-Said an ambassador extraordinary and plenipotentiary of Ours to the Kingdom of Saudi Arabia, and a Permanent Representative for the Sultanate to the Organisation of the Islamic Cooperation.

Article III

The following are hereby appointed:

1. Saleh bin Sulaiman bin Ahmed Al-Harthi, Our ambassador to the Republic of Kenya, to be a non-resident ambassador extraordinary and plenipotentiary of Ours to the State of Eritrea.

2. Mubarak bin Salim bin Ali Al-Zakwani, Our ambassador to the Republic of South Africa, to be a non-resident ambassador extraordinary and plenipotentiary of Ours to the Republic of Madagascar.

3. Ali bin Abdullah bin Salim Al-Mahrouqi, Our ambassador to the United Republic of Tanzania, to be a non-resident ambassador extraordinary and plenipotentiary of Ours to the Republic of Seychelles.

4. Dr Mohammad bin Said bin Khalifa Al-Busaidi, Our ambassador to Japan, to be a non-resident ambassador extraordinary and plenipotentiary of Ours to Australia.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 127/2020 Transferring an Advisor from the Ministry of Health to the Private Office

after perusal of the Basic Statute of the State,

the Law concerning the Employee System of the Diwan of Royal Court promulgated by Royal Decree 97/97,

and the Civil Service Law promulgated by Royal Decree 120/2004,

and in pursuance of public interest,

have decreed as follows 

Article I 

Sayyid Dr Sultan bin Yarub bin Qahtan Al-Busaidi is hereby transferred from the Ministry of Health to the Private Office with his same financial and employment entitlements, and is hereby appointed an advisor with the special grade.

Article II 

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 126/2020 Issuing the Municipal Councils Law

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the Municipal Councils Law promulgated by Royal Decree 116/2011,

the Governorates and Municipal Affairs System promulgated by Royal Decree 101/2020,

and Royal Decree 102/2020 Determining the Competences of the Ministry of Interior and Adopting Its Organisational Structure,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached Municipal Councils Law shall apply.

Article II

The Minister of Interior shall issue the necessary regulations and decisions for implementing the provisions of the attached law, and until they are issued, the existing regulations and decisions continue to operate to the degree that they do not contradict with its provisions.

Article III

The aforementioned Municipal Councils Law is hereby repealed, as well as all that is contrary to the attached law or in conflict with its provisions.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication, with the exception of article 8 clause “Second” and article 15 of the attached law, which come into force starting from the first elections held to form municipal councils in accordance with the provisions of this law.

the Law of the Administrative Court promulgated by Royal Decree 91/99,

the Criminal Procedure Law promulgated by Royal Decree 97/99,

the Civil and Commercial Procedure Law promulgated by Royal Decree 29/2002,

the Labour Law promulgated by Royal Decree 35/2003,

the Law of Public Notaries promulgated by Royal Decree 40/2003,

the Law of Evidence in Civil and Commercial Transactions promulgated by Royal Decree 68/2008,

the Electronic Transactions Law promulgated by Royal Decree 69/2008,

Royal Decree 10/2012 Governing the Administration of Judicial Affairs,

and the Foreign Capital Investment Law promulgated by Royal Decree 50/2019,

and in pursuance of public interest,

have decreed as follows

Article I

The attached Law on the Simplification of Litigation Procedures regarding Some Disputes shall apply.

Article II

The Chairman of the Council of the Administrative Affairs for the Judiciary shall issue the necessary regulations and decisions for implementing the provisions of the attached law.

Article III

All that is contrary to the attached law, or in conflict with its provisions, is hereby repealed.

Article IV

This decree shall be published in the Official Gazette, and comes into force after the lapse of 3 (three) months from the date of its publication.
