Royal Decree 10/2023 Allocating Some Lands for the Purposes of Renewable Energy and Clean Hydrogen Projects

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 5/81 Governing the Usufruct of the Lands of the Sultanate of Oman,

Royal Decree 88/82 Adopting the Executive Regulation Governing the Usufruct of the Lands of the Sultanate of Oman,

the Oil and Gas Law promulgated by Royal Decree 8/2011,

Royal Decree 93/2020 Amending the Name of the Ministry of Housing to the Ministry of Housing and Urban Planning, Determining Its Competences, and Adopting Its Organisational Structure,

Royal Decree 96/2020 Amending the Name of the Ministry of Oil and Gas to the Ministry of Energy and Minerals, Determining Its Competences, and Adopting Its Organisational Structure,

and Royal Decree 128/2020 Establishing a Closed Omani Joint Stock Company Named Energy Development Oman SAOC,

and in pursuance of public interest,

have decreed as follows

Article I

Lands owned by the state and specified in the masterplan attached to this decree are hereby allocated for the purposes of renewable energy and clean hydrogen projects.

Article II

It is not permitted to grant any rights over the lands stipulated in article I of this decree or to dispose of them by the relevant government entities in any manner of disposal except with the prior written approval of the Ministry of Energy and Minerals.

Article III

The grant of usufruct of the lands stipulated in article I of this decree shall be to Hydrogen Oman Company on the basis of a request by the Ministry of Energy and Minerals detailing the area of the land subject of the usufruct in accordance with the legally prescribed procedures.

Article IV

Oman Hydrogen Company may divide the lands subject of the usufruct granted to it, and may contract with others to use these divided lands for the purposes of renewable energy and clean hydrogen projects by way of an auction subject to the principles of openness, equal opportunity, equality, and freedom of competition.

Article V

The Minister of Energy and Minerals may, within 30 (thirty) days from the date of the issuance of this decree, approve some projects allocated for renewable energy and clean hydrogen which have been signed without carrying out the auction stipulated in article IV of this decree.

Article VI

The Minister of Energy and Minerals shall issue the principles and controls for practising activities relating to renewable energy and clean hydrogen projects.

Article VII

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article VIII

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Ministry of Higher Education, Research, and Innovation: Ministerial Decision 13/2023 Amending Some Provisions of the Executive Regulation of the Educational Scholarships, Grants, and Aid Law

Based on the Educational Scholarships, Grants, and Aid Law promulgated by Royal Decree 83/2002,

and the Executive Regulation of the Educational Scholarships, Grants, and Aid Law issued by Ministerial Decision 8/2003,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

Annexes 1 and 2 attached to the aforementioned Executive Regulation of the Law of Educational Scholarships, Grants, and Aid Law are hereby replaced with the attached annexes.

Article II

All that is contrary to this decision, or in conflict with its provisions, is hereby repealed.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Ministry of Transport, Communications, and Information Technology: Ministerial Decision 47/2023 Amending Some Provisions of the Executive Regulation of the Law of Carriage by Land

Based on the Law of Carriage by Land promulgated by Royal Decree 10/2016,

and the Executive Regulation of the Law of Carriage by Land issued by Ministerial Decision 2/2018,

and in pursuance of public interest,

it is hereby decided

Article I

The attached amendments are hereby made to the aforementioned Executive Regulation of the Law of Carriage by Land.

Article II

All that is contrary to the attached amendments, or in conflict with their provisions, is hereby repealed.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Based on Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, Determining Its Competences, and Adopting Its Organisational Structure,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to governing the licensing of the national product brand.

Article II

Those addressed by the provisions of the attached regulation shall rectify their status within 1 (one) year from the date of its entry into force.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Small and Medium Enterprises Development Authority: Decision 56/2023 Issuing the Regulation of the Registration of Micro, Small, and Medium Enterprises and the Issuance of Riyada Card

Based on Royal Decree 107/2020 Establishing the Small and Medium Enterprises Development Authority, Determining Its Competences, and Adopting Its Organisational Structure,

Decision 69/2017 Determining the Fees and the Financial Consideration for Services Provided by the Small and Medium Enterprises Development Authority,

and Decision 70/2021 regarding the Assignment of Privileges, Facilities, and Incentives Relating to the Riyada Card,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the registration of micro, small, and medium enterprises and the issuance of the Riyada card.

Article II

The aforementioned Decision 70/2021 is hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article III

The owners of micro, small, and medium enterprises shall rectify their status in accordance with the provisions of the attached regulation within a period not exceeding 90 (ninety) days from the date of its entry into force.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Ministry of Social Development: Ministerial Decision 36/2023 Issuing the Regulation on the Supervision of Non-profit Associations and Organisations regarding Anti-money Laundering and Counter-terrorist Financing

Based on the Civil Associations Law promulgated by Royal Decree 14/2000,

Royal Decree 32/2003 Determining the Competences of the Ministry of Social Development and Adopting Its Organisational Structure,

the Law of Anti-money Laundering and Counter-terrorist Financing promulgated by Royal Decree 30/2016,

and the Regulation on the Conditions, Rules, and Procedures for Granting Licences to Collect Money from the Public issued by Ministerial Decision 53/2010,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the supervision of non-profit associations and organisations regarding anti-money laundering and counter-terrorist financing.

Article II

Non-profit associations and organisations shall rectify their status in accordance with the provisions of the attached regulation within 3 (three) months from the date of its entry into force.

Article III

All that is contrary to the attached regulation, or in conflict with its provisions, is hereby repealed.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Ministry of Education: Ministerial Decision 32/2023 Determining the Fees for the Services Provided by the Ministry of Education

Based on the Financial Law promulgated by Royal Decree 47/98,

Royal Decree 79/2020 Determining the Competences of the Ministry of Education and Adopting Its Organisational Structure,

Ministerial Decision 34/2018 Determining the Fees for the Services Provided by the Ministry of Education,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

The fees for services provided by the Ministry of Education are hereby determined in accordance with the attached schedule.

Article II

1. The following shall be exempted from the fee mentioned in clause 1 of the attached schedule:

(a) Students who are children of Omani women married to non-Omani men.

(b) Students from the states of the Gulf Cooperation Council on the condition of reciprocity.

(c) Students who do not hold identification documents confirming their nationality, provided that the exemption is limited to students of schools specified by the Ministry of Education in the border areas.

(d) Students from the Republic of Yemen.

2. 50% (fifty percent) of the value of the fee provided in clause 1 of the attached schedule shall be exempted for the children of non-Omanis working in the Ministry of Education.

3. Students from social security families, students at Al-Kifah Centre in the Central Prison in the Wilayat of Samail, and Al-Hoor Centre in Khuwair subordinate to the Directorate of Juvenile Affairs in the Ministry of Social Development shall be exempted from the fees provided in clauses 30, 31, 32, and 33 of the attached schedule.

Article III

The aforementioned Ministerial Decision 34/2018 is hereby repealed, as well as all that is contrary to this decision or in conflict with its provisions.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 7/2023 Approving the Accession of the Sultanate of Oman to the Treaty of Amity and Cooperation in Southeast Asia and its Amending Protocols

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the Treaty of Amity and Cooperation in Southeast Asia, done at Denpasar on 24 February 1976,

the First Protocol Amending the Treaty of Amity and Cooperation in Southeast Asia, done at Manila on 15 December 1987,

the Second Protocol Amending the Treaty of Amity and Cooperation in Southeast Asia, done at Manila on 25 July 1998,

and the Third Protocol Amending the Treaty of Amity and Cooperation in Southeast Asia, done at Vietnam on 23 July 2010,

and in pursuance of public interest,

have decreed as follows

Article I

The accession of the Sultanate of Oman to the Treaty of Amity and Cooperation in Southeast Asia and its aforementioned amending protocols is hereby approved in the form attached.

Article II

Competent entities shall deposit the instrument of accession to the aforementioned treaty and its amending protocol in accordance with its provisions.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Ministry of Education: Ministerial Decision 30/2023 Amending Some Provisions of the Governance Regulation of Private Schools

Based on Ministerial Decision 287/2017 Issuing the Governance Regulation of Private Schools,

and in pursuance of public interest,

it is hereby decided

Article I

The attached amendments are hereby made to the aforementioned Governance Regulation of Private Schools.

Article II

Private schools shall rectify their status in accordance with the provisions of the attached regulation within a period not exceeding one year from the date of its entry into force.

Article III

All that is contrary to the attached amendments, or in conflict with their provisions, is hereby repealed.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Civil Aviation Authority: Decision 116/2023 Issuing the Executive Regulation of the Civil Aviation Law

Based on the System of the Civil Aviation Authority promulgated by Royal Decree 43/2013,

the Civil Aviation Law promulgated by Royal Decree 76/2019,

and the Executive Regulation of the Civil Aviation Law issued by Ministerial Decision 44/T/2007,

and the approval of the Board of Directors of the Civil Aviation Authority,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached Executive Regulation of the Civil Aviation Law shall apply.

Article II

The Chairman of the Board of Directors of the Civil Aviation Authority shall issue the decisions and systems necessary to implement the provisions of this regulation.

Article III

The aforementioned Ministerial Decision 44/T/2007 is hereby repealed, with the exception of part three relating to the fees of aviation, air navigation, and meteorological services. All that is contrary to the attached regulation, or in conflict with its provisions, is also hereby repealed.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.
