Royal Decree 47/2016 Promulgating Amendments to Some Provisions of the Maritime Law

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Maritime Law promulgated by Royal Decree 35/81,

and in pursuance of public interest,

have decreed as follows

Article I

The attached amendments to the aforementioned Maritime Law shall be implemented.

Article II

All that is contrary to the attached amendments, or in conflict with their provisions, is hereby repealed.

Article III

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 45/2016 Reinstating Omani Nationality

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Omani Nationality Law promulgated by Royal Decree 38/2014,

and in pursuance of public interest,

have decreed as follows

Article I

Omani nationality is hereby reinstated to those named in the attached list.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 41/2016 Approving the Accession of the Sultanate of Oman to the Convention on Combating Bribery of Foreign Public Officials in International Business Transactions

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Convention on Combating Bribery of Foreign Public Officials in International Business Transactions,

and in pursuance of public interest,

have decreed as follows

Article I

The accession of the Sultanate of Oman to the aforementioned agreement is hereby approved in the form attached.

Article II

Competent entities shall deposit the instruments of accession to the aforementioned convention in accordance with its provisions.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 40/2016 Determining the Competences of the Ministry of Heritage and Culture and Adopting Its Organisational Structure

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and Royal Decree 24/2005 Determining the Competences of the Ministry of Heritage and Culture and Adopting Its Organisational Structure,

and in pursuance of public interest,

it is hereby decided,

Article I

The competences of the Ministry of Heritage and Culture are hereby determined in accordance with the attached annex 1.

Article II

The organisational structure of the Ministry of Heritage and Culture is hereby adopted in accordance with the attached annex 2.

Article III

The aforementioned Royal Decree 24/2005 is hereby repealed, as well as all that is contrary to this decree or in conflict with its provisions.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 39/2016 Promulgating the Law on the Continuation of the Validity of Licences for Foreign Accounting and Auditing Companies and Exempting Owners of Omani Offices from the Full-Time Requirement

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Law Regulating the Accounting and Auditing Profession promulgated by Royal Decree 77/86,

and Royal Decree 21/2011 on the Law on the Continuation of the Validity of Licences for Foreign Accounting and Auditing Companies and Exempting Owners of Omani Offices from the Full-Time Requirement,

and after presentation to Majlis Oman,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached Law on the Continuation of the Validity of Licences for Foreign Accounting and Auditing Companies and Exempting Owners of Omani Offices from the Full-Time Requirement shall apply.

Article II

This decree shall be published in the Official Gazette.

Ministry of Manpower: Ministerial Decision 217/2016 regarding the System for Employing Juveniles and the Jobs and Occupations in Which They May Be Employed

Based on the Labour Law promulgated by Royal Decree 35/2003,

 and Royal Decree 76/2004 Determining the Competences of the Ministry of Manpower and Adopting Its Organisational Structure,

 and in pursuance of public interest,

it is hereby decided

Article I

The employer shall not employ a juvenile before obtaining the written consent of the person responsible for his care, upbringing, and development, such as the wali, legal guardian, and the entities mandated with providing alternative care.

Article II

Without prejudice to the provisions on the employment of juveniles stipulated in the aforementioned Labour Law, the employer shall comply with the following:

1. Informing the Inspection Directorate in the Directorate General of Labour Welfare or the Labour Welfare Directorate in the Directorates General of Manpower in the governorates of the names and ages of the juveniles before employing them as well as the persons employed to monitor their work.

2. Registering the juvenile worker with the Public Authority for Social Insurance, in accordance with the laws and systems in force in this regard.

3. Training the juvenile worker on how to use occupational health and safety means.

4. Monitoring the application by the juvenile worker of occupational safety and health means, and guaranteeing that they benefit from them.

5. Notifying the juvenile worker of the risks of his occupation and the means of preventing them, and taking the necessary precautions to prevent occupational accidents and diseases.

Article III

The employer shall, at his expense, conduct a medical examination of the juvenile before he joins work periodically every 6 (six) months during the period of his service and at the end of his service, in order to verify his medical fitness for the job he occupies and that he is free of diseases and work injuries.

The medical examination is proven by a medical certificate approved by the competent health entity.

Article IV

Wages and leaves shall be granted to the juvenile worker in accordance with the provisions of the Labour Law.

Article V

It is not permitted to employ juveniles in jobs and occupations other than those mentioned in the list attached to this decision.

Article VI

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.
