Royal Decree 76/2005 Granting Omani Nationality

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Law Governing Omani Nationality issued by Royal Decree 3/83 and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

Omani nationality is hereby granted to those named in the attached list, from the date stated next to each name.

Article II

This decree must be published in the Official Gazette.

Royal Decree 75/2005 Amending Some Provisions of the Omani Penal Law and the Criminal Procedures Law

Arabic We, Qaboos bin Said, the Sultan of Oman after perusal of the Basic Statute of the State issued by Royal Decree 101/96, the Omani Penal Law issued by Royal Decree 7/74 and its amendments, and the Criminal Procedures Law issued by Royal Decree 97/99 and its amendments, and in pursuance of public interest,

have decreed as follows

Article I

A paragraph is hereby added to article 163 of the Omani Penal Law, the text of which is as follows:

Every competent officer who wilfully refrains from, or obstructs, the execution of a judgment or order issued by a court, after the lapse of two weeks from his warning to execute it by a clerk, shall be punished by the same punishment stipulated in the preceding paragraph and by dismissal from office.

Article II

Article 4bis is hereby added to the Criminal Procedure Law, with the following text:

Without prejudice to the text of article 5, whoever suffers damage from the crime stipulated in the second paragraph of article 163 of the Omani Penal Law may directly summon the accused to appear before the competent misdemeanour court on the dates and in accordance with the procedures stipulated in articles 163 and 164, and the secretary of the court shall notify the Public Prosecution with a copy of the summons statement to appear to undertake the public lawsuit.

Article III

This decree must be published in the Official Gazette, and comes into force on the date of its publication. Issued on: 17 Jumada Al-Thani 1426 Corresponding to: 24 July 2005

Royal Decree 70/2005 Approving the Production Sharing Agreement of Mukhaizna Field

the Oil and Minerals Law issued by Royal Decree 42/74 and its amendments,

the Corporate Income Tax Law issued by Royal Decree 47/81 and its amendments,

the Foreign Capital Investment Law issued by Royal Decree 102/94 and its amendments,

Royal Decree 67/2003 Implementing the Unified Customs Law of the Cooperation Council for the Arab States of the Gulf,

and the Production Sharing Agreement of Mukhaizna Field signed between its parties on 21 June 2005,

and in pursuance of public interest,

have decreed as follows

Article I

The mentioned Production Sharing Agreement of Makhizna Field is hereby approved.

Article II

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 69/2005 Issuing the Law on Granting the Concession of the Wastewater Facility in the Governorate of Muscat

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

the Commercial Companies Law 4/74 and its amendments,

Royal Decree 8/92 Issuing the Muscat Municipality Law and its amendments,

Royal Decree 37/95 Granting the Concession to Build, Manage, and Operate the Wastewater Network in the Governorate of Muscat,

and Royal Decree 77/2004 Issuing the Privatisation Law,

and in pursuance of public interest,

have decreed as follows

Article I

The attached Law on Granting the Concession of the Wastewater Facility in the Governorate of Muscat hereby applies.

Article II

The government of the Sultanate of Oman in signing the agreements stipulated in the attached law is represented by the Minister of National Economy in signing the concession agreement, the Minister of Housing, Electricity, and Water in signing the usufruct agreement, and the Minister of the Diwan of Royal Court in signing the treated water sale and purchase agreement.

Article III

The Minister of National Economy—after coordination with the competent ministers—shall issue the local regulations and orders necessary to implement the provisions of the attached law.

Article IV

The aforementioned Royal Decree 37/95 is hereby repealed.

Article V

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 68/2005 Appointing an Undersecretary for the Ministry of Tourism
