Environment Authority: Decision 79/2023 Issuing the Regulation for Radiation Protection and Safety and Security of Radiation and Radioactive Material

Arabic

Based on the Law on Environment Protection and Pollution Prevention promulgated by Royal Decree 114/2001,

Royal Decree 106/2020 Establishing the Environment Authority, Determining Its Competences, and Adopting Its Organisational Structure,

the Regulation on the Control and Management of Radioactive Materials issued by Ministerial Decision 249/97,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to radiation protection and the security and safety of radiation sources and nuclear materials.

Article II

The aforementioned Ministerial Decision 249/97 is hereby repealed, as well as all that is contrary to this decision and the attached regulation or in conflict with their provisions.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Arabic The Foreign Ministry notes that a material error occurred when publishing Royal Decree 9/2023 Appointing Non-resident Ambassadors, published in Official Gazette 1480, issued on 21 Rajab 1444, corresponding to 12 February 2023, as article III was provided as follows:

Royal Decree 43/2023 Ratifying the Agreement between the Government of the Sultanate of Oman and the Government of the Arab Republic of Egypt on the Elimination of Double Taxation with Respect to Taxes on Income and the Prevention of Tax Evasion and Avoidance

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Agreement between the Government of the Sultanate of Oman and the Government of the Arab Republic of Egypt on the Elimination of Double Taxation with Respect to Taxes on Income and the Prevention of Tax Evasion and Avoidance signed in Cairo on 22 May 2023,

and after presentation to Majlis Al-Shura,

and in pursuance of public interest,

have decreed as follows

Article I

The aforementioned agreement is hereby ratified in the form attached.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 42/2023 Issuing a Class I Licence to Starlink Muscat SPC to Build and Operate a Satellite Communication System to Provide Fixed Public Telecommunications Services

after perusal of the Basic Statute of the State,

and the Telecommunications Law promulgated by Royal Decree 30/2002,

and in pursuance of public interest,

have decreed as follows

Article I

A Class I Licence for Starlink Muscat SPC to build and operate a satellite communication system to provide fixed public telecommunications services is hereby issued in accordance with the provisions of the attached licence.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 40/2023 Issuing the Law on the Regulation of the Water and Wastewater Sector

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the Law on Granting the Concession of the Wastewater Facility in the Governorate of Dhofar promulgated by Royal Decree 16/2004,

the Law on the Regulation and Privatisation of the Electricity and Related Water Sector promulgated by Royal Decree 78/2004,

the Law on Granting the Concession of the Wastewater Facility in the Governorate of Muscat promulgated by Royal Decree 69/2005,

Royal Decree 118/2007 regarding the Transfer of the Assets and Liabilities of the Seawater Extraction and Return Facility and the Potable Water and Sewage Networks Located in Sohar Industrial Port to Majis Industrial Services Company SAOC,

Royal Decree 78/2020 Amending the Name of the Electricity and Related Water Sector Regulation Authority to the Authority for Public Services Regulation and Assigning Some Competences to It,

Royal Decree 92/2020 Amending the Name of the Ministry of Agriculture and Fisheries to the Ministry of Agriculture, Fisheries, and Water Resources, Determining Its Competences, and Adopting Its Organisational Structure,

and Royal Decree 131/2020 regarding the Water and Wastewater Sector,

and after presentation to Majlis Oman,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached Law on the Regulation of the Water and Wastewater Sector shall apply.

Article II

The Chairman of the Board of the Authority for Public Services Regulation shall issue the necessary regulations and decisions for implementing the provisions of the attached law, and until they are issued, the regulations and decisions in force continue to operate to the degree that they do not contradict with its provisions.

Article III

All those who practise any of the activities subject to regulation by virtue of the provisions of the attached law shall rectify their status in compliance with its provisions within 6 (six) months from the date of its entry into force, and this period may be extended by a decision by the Board of Directors of the Authority for Public Services Regulation for an additional 6 (six) months period.

Article IV

All that is contrary to this decree and the attached law, or in conflict with their provisions, is hereby repealed.

Article V

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

after perusal of the Basic Statute of the State,

and the General Agreement for Connecting the States of the Cooperation Council for the Arab States of the Gulf to the Railway Project,

and in pursuance of public interest,

have decreed as follows

Article I

The accession of the Sultanate of Oman to the General Agreement for Connecting the States of the Cooperation Council for the Arab States of the Gulf to the Railway Project is hereby approved in the form attached.

Article II

Competent entities shall deposit the instrument of accession for the aforementioned agreement in accordance with its provisions.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Arabic Based on Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, Determining Its Competences, and Adopting Its Organisational Structure, Ministerial Decision 13/2012 Determining the Fees for Services, Tests, and Analyses Performed by the Directorate General of Standards and Metrology, and the approval of the Ministry of Finance, and in pursuance of public interest,

it is hereby decided

Article I

A new clause numbered 8 is hereby added to “First: Issuance of Certificates and Documents” of Schedule 1 “Fees for Services Performed by the Quality Control Directorate and the Standards and Metrology Directorates and Sections” attached to the aforementioned Ministerial Decision 13/2012, as follows:
No Service Fees in Rial Omani
8 Issuance/renewal of energy efficiency card annually for each model 60

Article II

New clauses numbered 7, 8, and 9 are hereby added to “Fourth: Miscellaneous Services” from Schedule 1 “Fees for Services Performed by the Quality Control Directorate and the Standards and Metrology Directorates and Sections” attached to the aforementioned Ministerial Decision 13/2012, as follows:
No Service Fees in Rial Omani
7 Permit to import air conditioning and refrigeration equipment for one year or until the quantity is exhausted for 1–5000 equipment 20
8 Permit to import air conditioning and refrigeration equipment for one year or until the quantity is exhausted for more than 5,000 to 10,000 equipment 30
9 Permit to import air conditioning and refrigeration equipment for one year or until the quantity is exhausted for more than 10,000 equipment 50

Article III
