Ministry of Justice and Legal Affairs: Ministerial Decision 129/2022 Conferring Enforcement Status on Some Officials of the Tax Authority

Based on the System for the Collection of Taxes, Fees, and Other Amounts Due to Units of the Administrative Apparatus of the State promulgated by Royal Decree 32/94,

the Criminal Procedures Law promulgated by Royal Decree 97/99,

the Income Tax Law promulgated by Royal Decree 28/2009,

the Excise Tax Law promulgated by Royal Decree 23/2019,

and the Value Added Tax Law promulgated by Royal Decree 121/2020,

and in pursuance of public interest,

it is hereby decided

Article I

Those occupying the positions provided in the attached schedule in the Tax Authority are hereby conferred–each within the scope of his competence—judicial enforcement status in the application of the provisions of the aforementioned System for the Collection of Taxes, Fees, and Other Amounts Due to Units of the Administrative Apparatus of the State, the aforementioned Income Tax Law, the aforementioned Excise Tax Law, the aforementioned Value Added Tax Law, and the regulations and decisions issued in the implementation of their provisions.

Article II

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

National Committee for Counter-Terrorism: Decision 1/2022 Issuing the Regulation of the Procedures for the Implementation of Security Council Resolutions Issued under Chapter VII of the United Nations Charter on the Prevention and Suppression of Terrorism and Its Financing, and the Prevention, Suppression, and Obstruction of the Proliferation of Weapons of Mass Destruction and Their Financing

Based on the Criminal Procedures Law promulgated by Royal Decree 97/99,

the Law on Combating Terrorism promulgated by Royal Decree 8/2007,

the Law of Anti-money Laundering and Counter-terrorist Financing promulgated by Royal Decree 30/2016,

and the Decision of the National Committee for Counter-terrorism 1/2021 issuing the Regulation of the Procedures for the Implementation of Security Council Resolutions Issued under Chapter VII of the United Nations Charter on the Prevention and Suppression of Terrorism and Its Financing, and the Prevention, Suppression, and Obstruction of the Proliferation of Weapons of Mass Destruction and Their Financing,

and in pursuance of public interest,

it is hereby decided

Article I

The procedures for the implementation of Security Council resolutions issued under Chapter VII of the United Nations Charter on the prevention and suppression of terrorism and its financing and the prevention, suppression, and obstruction of the proliferation of weapons of mass destruction and their financing shall be governed by the provisions of the attached regulation.

Article II

The aforementioned Decision 1/2021 is hereby repealed, as well as all that is contrary to this decision and the attached regulation or in conflict with their provisions.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 94/2022 Appointing to Some Positions

Arabic We, Haitham bin Tarik, the Sultan of Oman after perusal of the Basic Statute of the State, and the Civil Service Law promulgated by Royal Decree 120/2004, and in pursuance of public interest,

have decreed as follows

Article I

Those named below are hereby appointed each to the position following their name:

– Dr Wael bin Saif bin Salim Al-Harrasi Undersecretary of the Ministry of Endowments and Religious Affairs.

– Dr Saeed bin Harib bin Manaa Al-Lamki Undersecretary of the Ministry of Health for Health Affairs.

– Mohsin bin Hamad bin Saif Al-Hadhrami Undersecretary of the Ministry of Energy and Minerals.

– Sayyid Dr Munther bin Bader bin Hilal Al-Busaidi Deputy Chairman of the Oman Vision 2040 Implementation Follow-Up Unit with the special grade.

Article II

Ministry of Labour: Ministerial Decision 479/2022 Amending Some Provisions of the Governance Regulation of the Electoral Committees of the General Federation for the Workers of the Sultanate of Oman

Based on the Labour Law promulgated by Royal Decree 35/2003,

the Governance Regulation of the Electoral Committees for the General Federation for Workers of the Sultanate of Oman issued by Ministerial Decision 413/2018,

and Ministerial Decision 500/2018 regarding the System for the Formation, Registration, and Work of Labour Unions, Labour Federations, and the General Federation for Workers of the Sultanate of Oman,

and in pursuance of public interest,

it is hereby decided

Article I

The text of article II of the aforementioned decision 413/2018 is hereby replaced with the following text:

The primary committee for the elections of the members of the Board of Directors of the General Federation for Workers in the Sultanate of Oman shall set the draft budget for the electoral process, which shall be presented to the Minister of Labour for approval.

Article II

The attached amendments are hereby implemented to the aforementioned Governance Regulation of the Electoral Committees for the General Federation for Workers of the Sultanate of Oman.

Article III

All that is contrary to this decision and the attached amendments, or in conflict with their provisions, is hereby repealed.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Ministry of Commerce, Industry, and Investment Promotion: Ministerial Decision 619/2022 Issuing the Regulation Governing the Practice of the Activity of Marketing and Promotion on Internet Websites and Social Media

Arabic

Based on the Commercial Register Law 3/74,

the Commercial Law promulgated by Royal Decree 55/90,

and Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, Determining Its Competences, and Adopting Its Organisational Structure,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the governance of the practice of the activity of marketing and promotion on internet websites and social media.

Article II

Those addressed by the provisions of the attached regulation shall rectify their status in accordance with its provisions within 6 (six) months from the date of its entry into force.

Article III

This decision shall be published in the Official Gazette, and comes into force after 90 (ninety) days from the date of its publication.

Supreme Judicial Council: Decision 234/2022 Determining the Fees Due on the Work of the Public Notary

Based on the Financial Law promulgated by Royal Decree 47/98,

the Law of Public Notaries promulgated by Royal Decree 40/2003,

Royal Decree 35/2022 regarding the Governance of the Administration of Judicial Affairs,

Ministerial Decision 175/2016 regarding Determining the Fees Due on the Work of the Public Notary,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

The fees due on the work of the public notary are hereby determined in accordance with the attached annex.

Article II

All transactions conducted by the public notary for those enjoying social security shall be exempt from fees.

Article III

The aforementioned Ministerial Decision 175/2016 is hereby repealed, as well as all that is contrary to this decision or in conflict with its provisions.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 92/2022 Making Military Appointments and Promotions in the Ministry of Defence

Arabic We, Haitham bin Tarik, the Sultan of Oman after perusal of the Basic Statute of the State, and Royal Decree 27/2022 Establishing the Strategic and Defence Studies Academy and Issuing Its System, and in pursuance of public interest,

have decreed as follows

Article I

Major General Hamed bin Ahmed bin Said Sakrun is hereby appointed President of the Strategic and Defence Studies Academy.

Article II

Commodore Ali bin Abdullah bin Mohammed Al-Shidi is hereby promoted to the rank of Major General and appointed Commandant of the National Defence College.

Article III

Royal Decree 93/2022 regarding the Sultan’s Armed Forces Day

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 49/76  “Armed Forces Day”,

and in pursuance of public interest,

have decreed as follows

Article I

The eleventh day of December of each year is called “Sultan’s Armed Forces Day.”

Article II

The aforementioned Sultan’s Armed Forces Day shall be an official holiday for all members of the Sultan’s Armed Forces throughout the Sultanate of Oman.

Article III

The aforementioned Royal Decree 49/76 is hereby repealed, as well as all that is contrary to this decree or in conflict with its provisions.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

the Executive Regulation of the Telecommunications Law issued by Decision 144/2008,

the Governance Regulation of the National Numbering Plan issued by Decision 22/2014,

the Regulation Governing the Allocation of Telecommunications Numbers issued by Decision 1/2018,

the approval of the Ministry of Finance,

and the approval of the Board of Directors of the Telecommunications Regulatory Authority,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the governance of the allocation of telecommunications numbers.

Article II

The aforementioned Regulation Governing the Allocation of Telecommunications Numbers is hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article III

This decision shall be published in the Official Gazette, and comes into force after the lapse of 6 (six) months from the date of its publication.

Royal Decree 91/2022 Determining the Competences of the Ministry of Finance and Adopting Its Organisational Structure

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 39/96 Determining the Competences of the Ministry of Finance and Adopting Its Organisational Structure,

the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

and Royal Decree 108/2020 Abolishing Some Specialised Councils,

and in pursuance of public interest,

have decreed as follows

Article I

The competences of the Ministry of Finance are hereby determined in accordance with the attached Annex 1.

Article II

The organisational structure of the Ministry of Finance is hereby adopted in accordance with the attached Annex 2.

Article III

The aforementioned Royal Decree 39/96 is hereby repealed, as well as all that is contrary to this decree, or in conflict with its provisions.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.
