Ministry of Housing and Urban Planning: Ministerial Decision 109/2022 Amending Some Provisions of the Executive Regulation of the System of the Ownership of Real Estate in Integrated Tourism Complexes

Based on the System of the Ownership of Real Estate in Integrated Tourism Complexes promulgated by Royal Decree 12/2006,

the Law on the Prohibition of the Ownership of Land and Real Estate by Non-Omanis in Certain Places promulgated by Royal Decree 29/2018,

the Executive Regulation of the System of the Ownership of Real Estate in Integrated Tourism Complexes Issued by Ministerial Decision 191/2007,

the Executive Regulation of the Law on the Prohibition of the Ownership of Land and Real Estate by Non-Omanis in Certain Places issued by Ministerial Decision 292/2020,

and Ministerial Decision 357/2020 regarding the Controls for the Sale of Residential Real Estate Units under the Usufruct System to Non-Omanis in Multi-Story Commercial Residential Buildings,

and in pursuance of public interest,

it is hereby decided

Article I

The text of article 2 of the aforementioned Executive Regulation of the System of the Ownership of Real Estate in Integrated Tourism Complexes is hereby replaced with the following text:

It is permitted for Omani and non-Omani natural or legal persons to own built units or plots of land intended for construction or exploitation in integrated tourism complexes for the purpose of residence or investment in accordance with the provisions of the system and this regulation. For non-Omanis in integrated tourism complexes in the Governorate of Musandam, it is only permitted to purchase units built under the usufruct system and for a period not exceeding 99 (ninety-nine) years.

Article II

All that is contrary to this decision, or in conflict with its provisions, is hereby repealed.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 29/2022 Ratifying the Cooperation Agreement in the Field of Maritime Transport between the Government of the Sultanate of Oman and the Government of the Islamic Republic of Iran

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Cooperation Agreement in the Field of Maritime Transport between the Government of the Sultanate of Oman and the Government of the Islamic Republic of Iran signed in the city of Tehran on 8 December 2019,

and after presentation to Majlis Al-Shura,

and in pursuance of public interest,

have decreed as follows

Article I

The aforementioned agreement is hereby ratified in the form attached.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 28/2022 Making Military Promotions and Appointments in the Ministry of Defence

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and Royal Decree 27/2022 Establishing the Strategic and Defence Studies Academy and Issuing Its System,

and in pursuance of public interest,

have decreed as follows

Article I

Air Vice-Marshal Saleh bin Yahya bin Masoud Al-Maskari is hereby appointed President of the Strategic and Defence Studies Academy.

Article II

Brigadier Hamid bin Ahmed bin Said Sakroon is hereby promoted to the rank of Major General and appointed Commandant of the National Defence College.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 27/2022 Establishing the Strategic and Defence Studies Academy and Issuing Its System

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 2/2013 Establishing the National Defence College and Issuing Its System,

and the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

and in pursuance of public interest,

have decreed as follows

Article I

An academy named the “Strategic and Defence Studies Academy” is hereby established. It shall have legal personality, and shall enjoy financial and administrative independence. It shall be subordinate to the Ministry of Defence, and the attached system shall apply to it.

Article II

The headquarters of the Strategic and Defence Studies Academy shall be in the Governorate of Muscat, and it is permitted to establish branches of it in other governorates by a decision by the board of trustees of the academy.

Article III

All allocations, assets, rights, obligations, and holdings of the National Defence College, the Joint Command and Staff College, and the Strategic and Defence Studies Centre are hereby transferred to the Strategic and Defence Studies Academy.

Article IV

The employees of the National Defence College, the Joint Command and Staff College, and the Strategic and Defence Studies Centre are hereby transferred to the Strategic and Defence Studies Academy with their same employment status and financial allocations.

Article V

The Chairman of the Board of Trustees of the Strategic and Defence Studies Academy shall issue the internal system of the academy and the necessary regulations and decisions for the implementation of the provisions of the attached system, and until they are issued, the existing regulations and decisions in force continue to operate to the degree that they do not contradict with the provisions of this decree and the attached system.

Article VI

The aforementioned Royal Decree 2/2013 is hereby repealed, as well as all that is contrary to this decree and the attached system, or is in conflict with their provisions.

Article VII

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 25/2022 Reinstating Omani Nationality

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Omani Nationality Law promulgated by Royal Decree 38/2014,

and in pursuance of public interest,

have decreed as follows

Article I

Omani nationality is hereby reinstated to those named in the attached list.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.
