Ministry of Justice and Legal Affairs: Ministerial Decision 100/2022 Conferring Enforcement Status on Some Officials of the Tax Authority

Based on the System for the Collection of Taxes, Fees,and Other Amounts Due to Units of the Administrative Apparatus of the State promulgated by Royal Decree 32/94,

the Criminal Procedures Law promulgated by Royal Decree 97/99, the Income Tax Law promulgated by Royal Decree 28/2009,

the Excise Tax Law promulgated by Royal Decree 23/2019,

and the Value Added Tax Law promulgated by Royal Decree 121/2020,

and in pursuance of public interest,

it is hereby decided

Article I

Those occupying the positions provided in the attached schedule in the Tax Authority are hereby conferred–each within the scope of his competence—judicial enforcement status in the application of the provisions of the aforementioned System for the Collection of Taxes, Fees, and Other Amounts Due to Units of the Administrative Apparatus of the State, the aforementioned Income Tax Law, the aforementioned Excise Tax Law, the aforementioned Value Added Tax Law, and the regulations and decisions issued in the implementation of their provisions.

Article II

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Oman Police: Decision 195/2022 Amending Some Provisions of the Executive Regulation of the Foreigners Residency Law

Arabic Based on the Foreigners Residency Law promulgated by Royal Decree 16/95, and the Executive Regulation of the Foreigners Residency Law issued by Decision 63/96, and in pursuance of public interest,

it is hereby decided

Article I

The texts of clauses 2 and 3 of article 2 of the Executive Regulation of the Foreigners Residency Law are hereby replaced with the following texts:

2. Land ports: Sarfait, Mazyunah, Dibba, Darah, Khatam, Hamasa, Rawdah, Hadf, Sa’ara, Hafeet, Wajajah, Khatmat Milaha, Aswad, and Rub’ Al-Khali.

3. Sea ports: Port Sultan Qaboos, Mina Al-Fahal, Port of Salalah, Khasab Port, Sohar Port, Shinas Port, Suwaiq Port, Sur (Fishing Port), Qalhat Port, Masirah Port, and Port of Duqm.

Article II

All that is contrary to this decision, or in conflict with its provisions, is hereby repealed.

Article III

General Secretariat of the Council of Ministers: Decision 330/2022 Amending the Organisational Structure of the General Secretariat of the Council of Ministers

Based on Royal Decree 31/2014 Adopting the Organisational Structure of the Secretariat General of the Council of Ministers,

the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

and the approval of the Council of Ministers to amend the name of the “General Directorate of Information and Studies” in the General Secretariat of the Council of Ministers to the “Decision-Making Support Unit”,

and in pursuance of public interest,

it is hereby decided

Article I

The name of the “Directorate General of Information and Studies” in the General Secretariat of the Council of Ministers is hereby amended to the “Decision-Making Support Unit”, and its subordination is hereby transferred to the deputy secretary general.

Article II

All that is contrary to this decision, or in conflict with its provisions, is hereby repealed.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Small and Medium Enterprises Development Authority: Decision 443/2022 Issuing the Governance Regulation of Sanad Service Centres

Based on Royal Decree 107/2020 Establishing the Small and Medium Enterprises Development Authority, Determining Its Competences, and Adopting Its Organisational Structure,

and the Governance Regulation of Sanad Services Centres issued by Decision 16/2014,

and in pursuance of public interest,

it is hereby decided

Article I

The attached Governance Regulation of Sanad Service Centres shall apply.

Article II

The aforementioned decision 16/2014 is hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Supreme Judicial Council: Decision 164/2022 Determining the Geographical Jurisdiction of Administrative Circuits (Repealed)

Based on the Judicial Authority Law promulgated by Royal Decree 90/99,

the Civil and Commercial Procedures Law promulgated by Royal Decree 29/2002,

Royal Decrees 61/2006 and 118/2010 Establishing Two Primary Circuits for the Administrative Judiciary in Salalah and Sohar,

and Royal Decree 35/2022 regarding the Governance of the Administration of Judicial Affairs,

and in pursuance of the interest of work,

it is hereby decided

Article I

The geographical jurisdiction of the primary and appeal administrative circuits is hereby specified as follows:

– The Appeal Administrative Circuit of the Court of Appeal in Muscat:

The scope of its jurisdiction shall be all the governorates of the Sultanate.

– The Primary Administrative Circuit of the Primary Court in Muscat:

The scope of its jurisdiction shall be the governorates of Muscat, Dakhiliya, Batinah South, Sharqiyah North, Sharqiyah South, and Wusta.

– The Administrative Circuit of the Primary Court in Salalah:

The scope of its jurisdiction shall be the wilayat of the Governorate of Dhofar.

– The Primary Administrative Circuit of the Primary Court in Sohar:

The scope of its jurisdiction shall be the governorates of Batinah North, Musandam, Buraimi, and Dhahirah.

Article II

This decision shall be published in the Official Gazette, and comes into force on 1 October 2022.

Ministry of Commerce, Industry, and Investment Promotion: Ministerial Decision 527/2022 Issuing the Regulation for Organising and Managing Exhibitions

Based on the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, and Adopting Its Organisational Structure,

and Ministerial Decision 182/2017 Issuing the Regulation for Organising and Managing Exhibitions,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to organising and managing exhibitions.

Article II

Commercial establishments engaged in the activity of organising and managing exhibitions shall reconcile their status in accordance with the provisions of the attached regulation within a period not exceeding 6 (six) months from the date of its entry into force.

Article III

The aforementioned Ministerial Decision 182/2017 is hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Ministry of Housing and Urban Planning: Ministerial Decision 192/2022 regarding the Usufruct of Land Designated for the Construction of Private School Establishments

Arabic Based on the Land Law promulgated by Royal Decree 5/80, Royal Decree 5/81 Governing the Usufruct of the Lands of the Sultanate of Oman, Royal Decree 93/2020 Amending the Name of the Ministry of Housing to the Ministry of Housing and Urban Planning, Determining Its Competences, and Adopting Its Organisational Structure, the Executive Regulation of Royal Decree 5/81 Governing the Usufruct of the Lands of the Sultanate of Oman promulgated by Royal Decree 88/82, and the Regulation of the Values, Fees, and Prices Collected by the Ministry of Housing and Urban Planning issued by Decision 92/2016, and in pursuance of public interest,

it is hereby decided

Article I

The Ministry of Housing and Urban Planning, in coordination with the relevant entities in the governorates and wilayat, shall determine the sites of the lands designated for the construction of private school establishments, taking into account the geographical nature of the site and its suitability from a technical, health, and environmental perspective. The ministry shall issue the schematic drawings of the sites and the detailed cadastral drawings of the plots.

Article II

The areas of land designated for the construction of private school establishments in the governorates and the wilayat are hereby determined as follows:

1. 3,000 m2 (three thousand square metres) to 5,000 m2 (five thousand square metres) for the preschool education stage.

2. 7,000 m2 (seven thousand square metres) as a maximum limit for the preschool education stage and the first cycle.

3. 10,000 m2 (ten thousand square metres) as a maximum limit for the preschool education stage and the first and second cycles.

4. 15,000 m2 (fifteen thousand square metres) as a maximum limit for the preschool education stage, the first and second cycles, and the eleventh and twelfth grades.

As an exception to the aforementioned clauses, it is permitted for the area of land designated for the construction of private school establishments to be less than 3,000 m2 (three thousand square metres) in the governorates of Muscat and Musandam and in the wilayat of Salalah and Buraimi.

Article III

It is required for the usufruct of land designated for the construction of private school establishments to obtain the preliminary approval of the Ministry of Education to construct a private school establishment.

Article IV

The application for the usufruct of land designated for the construction of private school establishments shall be submitted to the competent directorates and departments in the Ministry of Housing and Urban Planning on the form prepared for this purpose.

Article V

The Ministry of Housing and Urban Planning shall conclude with the usufructuary a usufruct contract for a plot of land designated for the construction of a private school establishment, provided that the period of usufruct shall be 30 (thirty) years, renewable for an identical period, including a preliminary stage period for the execution of the project having a duration of 2 (two) years exempt from payment in consideration for the usufruct.

Article VI

The usufructuary shall pay the annual consideration of the usufruct of government lands stipulated in annex 5 attached to the aforementioned Values, Fees, and Prices collected by the Ministry of Housing and Urban Planning Regulation.

Article VII
