Royal Decree 4/2005 Amending Some Provisions of the Social Insurance Law and the System of Social Insurance of Omanis Working Abroad and Their Equivalent

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

the Social Insurance Law issued by Royal Decree 72/91,

and the System of Social Insurance of Omanis Working Abroad and Their Equivalent issued by Royal Decree 32/2000,

and in pursuance of public interest,

have decreed as follows

Article I

The text of article 21(1) of the Social Insurance Law issued by Royal Decree 72/91 and article 30(1) of the System of Social Insurance for Omanis Working Abroad and Their Equivalent issued by Royal Decree 32/2000 is hereby replaced with the following text:

1. The end of the service of the insured person upon reaching the age of sixty, or after, provided that the period of his contribution to the insurance is 180 months at least, or the insured female upon reaching the age of fifty-five, or after, when the period of her contribution to the insurance is 120 months at least.

Article II

The text of the last two paragraphs of article 21 of the mentioned Social Insurance Law is hereby replaced with the following text:

The periods during which the insured receives daily allowances in the event of his temporary inability to work due to a work injury are calculated within the period of contribution to the insurance referred to in the previous two clauses. The periods of absence without pay and the periods of suspension from work without pay must be included in the calculation of the periods stipulated in this article, provided that the prescribed contributions are paid for these periods.

Article III

Article 21(3) of the mentioned Social Insurance Law is hereby repealed.

Article IV

This decree must be published in the Official Gazette, and comes into force on the date of its publication.

Royal Decree 3/2005 Appointing an Undersecretary for the Ministry of Commerce and Industry for Commerce and Industry

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Civil Service Law promulgated by Royal Decree 8/80 and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

Engineer Ahmed bin Hassan bin Alawi Al-Dheeb Baomar is hereby appointed Undersecretary of the Ministry of Commerce and Industry for Commerce and Industry.

Article II

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 6/2005 Declaring Public Benefit Status for the Coastal Road Project in the Batinah Region

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

and the Law on the Expropriation for Public Benefit issued by Royal Decree 64/78 and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

The Batinah Coastal Road Project specified in the attached note and masterplan is hereby deemed a public benefit project.

Article II

The competent entities may seize, through direct execution, buildings and land necessary for the mentioned project, and all establishments on them, in accordance with the provisions of the mentioned Law on the Expropriation for Public Benefit.

Article III

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 116/2004 Ratifying the Framework Agreements on Economic Cooperation Between the Cooperation Council for the Arab States of the Gulf and Each of the Republic of India and the Islamic Republic of Pakistan

have decreed as follows

Article I

The mentioned agreements are hereby ratified.

Article II

Royal Decree 115/2004 Exempting Some Securities Brokerage Firms from Corporate Income Tax

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State issued by Royal Decree 101/96,

the Commercial Companies Law 4/74 and its amendments,

the Corporate Income Tax Law issued by Royal Decree 47/81 and its amendments,

and the Capital Market Law issued by Royal Decree 80/98 and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

Every public joint stock company whose capital is not less than five million Rial Omani and which is established from the merger of two or more securities brokerage firms existing on the date of entry into force of this decree and registered in accordance with the provisions of the mentioned Capital Market Law is hereby exempted from corporate income tax.

Article II

The exemption stipulated in article I of this decree applies for a period of five years starting from the date on which the merger decision becomes effective in application of the provisions of the mentioned Commercial Companies Law.

Article III

The minister supervising the Ministry of Finance—after coordination with the Minister of Commerce and Industry—shall issue the necessary regulations and decisions to implement the provisions of this decree.

Article IV

All that is contrary to this decree is hereby repealed.

Article V

This decree must be published in the Official Gazette, and comes into force on the date of its publication.
