Royal Decree 5/2024 Amending Some Provisions of the System of the Tax Authority

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the System of the Tax Authority and the Adoption of its Organisational Structure promulgated by Royal Decree 42/2020,

and the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

and in pursuance of public interest,

have decreed as follows

Article I

The text of article 6 of the aforementioned System of the Tax Authority is hereby replaced with the following text:

The authority shall have a chairman appointed by royal decree.

Article II

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

and the Air Services Agreement between the Government of the Sultanate of Oman and the Government of the Republic of Rwanda signed in Riyadh on 4 December 2023,

and in pursuance of public interest,

have decreed as follows

Article I

The aforementioned agreement is hereby ratified in the form attached.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 3/2024 Ratifying the Air Services Agreement between the Government of the Sultanate of Oman and the Government of the Federative Republic of Brazil

Royal Decree 2/2024 Establishing the National Fund for Emergency Cases

Arabic We, Haitham bin Tarik, the Sultan of Oman after perusal of the Basic Statute of the State, the Civil Defence Law promulgated by Royal Decree 76/91, the Financial Law promulgated by Royal Decree 47/98, the Tender Law promulgated by Royal Decree 36/2008, the State Financial and Administrative Audit Law promulgated by Royal Decree 111/2011, the Penal Law promulgated by Royal Decree 7/2018, the System for the Collection of Taxes, Fees, and Other Amounts Due to Units of the Administrative Apparatus of the State promulgated by Royal Decree 32/94, and Royal Decree 84/2020 regarding the Secretariat General of the Tender Board, and in pursuance of public interest,

have decreed as follows

Article I

An independent fund named the “National Fund for Emergency Cases” is hereby established in the Ministry of Finance with the aim of addressing emergency cases and natural disasters such as climatic conditions, floods, earthquakes, and other risks to the state that harm public facilities and infrastructure through the following:

1. Supporting the achievement of the public policy relating to the procedures necessary for managing emergency cases.

2. Providing the necessary financing in accordance with the actual requirements to ensure the resumption of normal life after the occurrence of an emergency case.

Article II

The resources of the National Fund for Emergency Cases consist of the following:

1. Appropriations allocated to the fund in the General Budget of the State.

2. Gifts, donations, and contributions accepted by the Minister of Finance.

3. Returns on the investment of the property of the fund.

4. Any other resources approved by the Council of Ministers.

Article III

The Minister of Finance shall issue the necessary decisions to govern the National Fund for Emergency Cases. He shall have all the powers necessary to manage the fund and work to achieve its objectives, and he shall have the following powers in particular:

1. Setting the public policy of the fund and following up on its implementation.

2. Managing the property of the fund, approving investment plans for its funds within the framework of the investment policies in force, and approving the rules governing the investment of its funds.

3. Forming standing and temporary committees in a manner that achieves the objectives of the fund.

4. Establishing the rules and controls for the assignment of projects necessary to achieve the objectives of the fund.

5. Approving the reports relating to the financial position of the fund.

6. Preparing a report on the emergency case after its lapse, handling it, and coordinating with the relevant entities for research purposes and studies to benefit from the experiences relating to it in order to mitigate future risks.

7. Governing the receipt of cash donations from companies, establishments, and individuals during and after the occurrence of emergency cases and natural disasters.

8. Opening one or more accounts in licensed banks in the Sultanate of Oman or abroad for the purpose of depositing the funds allocated to the fund from the General Budget of the State and from donations, and disbursing from such accounts.

Article IV

The funds of the National Fund for Emergency Cases shall have an independent annual budget, the surpluses of which are carried over from year to year and are not transferred to the public treasury of the state.

Article V

The property of the fund is deemed public property, and the provisions of the Penal Law; the State Financial and Administrative Audit Law; and the System for the Collection of Taxes, Fees, and Other Amounts Due to Units of the Administrative Apparatus of the State apply to it.

Article VI

Without prejudice to the provisions of article V of this decree, decisions issued by the Minister of Finance and contracts entered into by him within the framework of immediate and direct handling of an emergency case in order to achieve the objectives of the National Fund for Emergency Cases are exempt from all general and special provisions stipulated in the laws and royal decrees.

Article VII

It is not permitted to disburse the funds of the National Fund for Emergency Cases for purposes other than those for which it is established.

Article VIII

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article IX

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication. Issued on: 18 Jumada Al-Akhira 1445 Corresponding to: 1 January 2024

Royal Decree 1/2024 Ratifying the General Budget of the State for Fiscal Year 2024

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Financial Law promulgated by Royal Decree 47/98,

and after presentation to Majlis Oman,

and in pursuance of public interest,

have decreed as follows

Article I

The General Budget of the State for Fiscal Year 2024 is hereby ratified in accordance with the attached tables.

Article II

All units of the administrative apparatus of the state and other public legal persons shall implement the provisions of this decree each within its competence.

Article III

This decree shall be published in the Official Gazette and comes into force on 1 January 2024.

and in pursuance of public interest,

have decreed as follows

Article I

 The aforementioned agreement and the protocol attached to it are hereby ratified in the form attached.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

and the Agreement Establishing the Islamic Corporation for the Development of the Private Sector signed in Jeddah on 3 November 1999,

have decreed as follows

The aforementioned agreement is hereby ratified in the form attached.

Article II

Competent entities shall deposit the instrument of ratification for the aforementioned agreement in accordance with its provisions.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 87/2023 Determining the Competences of the Secretariat General for National Celebrations and Adopting Its Organisational Structure

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and Royal Decree 6/2020 regarding the Secretariat General for National Celebrations,

and in pursuance of public interest,

have decreed as follows

Article I

The competences of the Secretariat General for National Celebrations are hereby determined in accordance with the attached Annex 1.

Article II

The organisational structure of the Secretariat General for National Celebrations is hereby adopted in accordance with the attached Annex 2.

Article III

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 84/2023 Restructuring Oman Development Bank SAOC

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the Commercial Register Law promulgated by Royal Decree 3/74,

Royal Decree 33/74 regarding Companies Established by Royal Decree,

Royal Decree 18/97 Establishing an Omani Closed Joint Stock Company Named Oman Development Bank,

the Banking Law promulgated by Royal Decree 114/2000,

the Civil and Commercial Procedures Law promulgated by Royal Decree 29/2002,

and the Commercial Companies Law promulgated by Royal Decree 18/2019,

and in pursuance of public interest,

have decreed as follows

Article I

The name of “Oman Development Bank SAOC” is hereby amended to “Development Bank SAOC”, and the provisions of the attached system shall apply in regard to it.

Article II

Development Bank SAOC shall prepare its articles of association in accordance with the provisions of the aforementioned Commercial Companies Law.

Article III

The provisions of this decree and the attached system do not prejudice the rights and obligations arising before the date of its entry into force.

Article IV

The Minister of Finance shall issue the executive regulation of the attached system and the decisions necessary for its implementation. Until they are issued, the existing regulations and decisions continue to operate to the degree that they do not contradict with the provisions of this decree and the attached system.

Article V

All that is contrary to this decree and the attached system, or in conflict with their provisions, is hereby repealed.

Article VI

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 86/2023 Approving the Assignment of a Percentage of the Rights and Obligations in the Petroleum Agreement for Concession Block 60

Arabic We, Haitham bin Tarik, the Sultan of Oman after perusal of the Basic Statute of the State, the Oil and Gas Law promulgated by Royal Decree 8/2011, Royal Decree 56/2011 Approving the Petroleum Agreement between the Government of the Sultanate of Oman and Oman Oil Company Exploration and Production LLC for Concession Block 60, and the collection of documents by which OQ Exploration and Production LLC (formerly Oman Oil Company Exploration and Production LLC) assigned 20% of its rights and obligations in the petroleum agreement signed on 19 March 2011 for Concession Block 60 to MedcoEnergi Oman Block 60 Limited (Oman Branch), and 20% of its rights and obligations in this Agreement to Medco Daya Oman Block 60 Pte Ltd (Oman Branch), and in pursuance of public interest,

have decreed as follows

Article I

The assignment by OQ Exploration and Production LLC of 20% of its rights and obligations in the petroleum agreement signed on 19 March 2011 for Concession Block 60 to MedcoEnergi Oman Block 60 Limited (Oman Branch) is hereby approved.

Article II

The assignment by OQ Exploration and Production LLC of 20% of its rights and obligations in the petroleum agreement signed on 19 March 2011 for Concession Block 60 to Medco Daya Oman Block 60 Pte Ltd (Oman Branch) is hereby approved.

Article III

The final shares of the parties to the agreement are hereby as follows:

– 60% for OQ Exploration and Production LLC.

– 20% for MedcoEnergi Oman Block 60 Limited (Oman Branch).

– 20% for Medco Daya Oman Block 60 Pte Ltd (Oman Branch).

Article IV
