Royal Decree 42/2021 on Granting Government Land

Arabic

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 5/81 Governing the Usufruct of the Lands of the Sultanate,

Royal Decree 88/82 Adopting the Executive Regulation Governing the Usufruct of the Lands of the Sultanate,

and the Government Land Entitlement System promulgated by Royal Decree 81/84,

and in pursuance of public interest,

have decreed as follows

Article I

The grant of residential government lands shall be in accordance with the controls and conditions set out in the attached annex to this decree.

Article II

The grant of commercial, residential commercial, industrial, and agricultural government lands shall be by usufruct in accordance with the conditions and procedures stipulated in the aforementioned Royal Decree 5/81.

Article III

The controls and conditions stipulated in the attached annex to this decree shall apply to applications for the entitlement to residential government lands submitted to the Ministry of Housing and Urban Planning prior to the implementation of the provisions of this decree.

The conditions and procedures stipulated in the aforementioned Royal Decree 5/81 shall also apply to applications for the entitlement to commercial, residential commercial, industrial, and agricultural government lands submitted to the Ministry of Housing and Urban Planning prior to the implementation of the provisions of this decree.

Article IV

The Minister of Housing and Urban Planning shall issue the necessary decisions for implementing the provisions of this decree, and until they are issued, the existing decisions continue to operate to the degree that they do not contradict with its provisions.

Article V

The Government Land Entitlement System promulgated by the aforementioned Royal Decree 81/84 is hereby repealed as well as all that is contrary to this decree, or in conflict with its provisions.

Article VI

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 41/2021 Appointing Non-resident Ambassadors

Arabic We, Haitham bin Tarik, the Sultan of Oman after perusal of the Basic Statute of the State, and the Law Governing the Foreign Ministry promulgated by Royal Decree 32/2008, and in pursuance of public interest,

have decreed as follows

Article I

Dr Ahmed bin Salim bin Mohammed Baomar, Our ambassador to the Republic of Italy, is hereby appointed a non-resident ambassador extraordinary and plenipotentiary of Ours to the Republic of San Marino.

Article II

Saleh bin Sulaiman bin Ahmed Al-Harthi, Our ambassador to the Republic of Kenya, is hereby appointed a non-resident ambassador extraordinary and plenipotentiary of Ours to the Republic of Malawi.

Article III

Dr Mohammad bin Said bin Khalifa Al-Busaidi, Our ambassador to Japan, is hereby appointed a non-resident ambassador extraordinary and plenipotentiary of Ours to New Zealand.

Article IV

Saleh bin Mohammad bin Ahmed Al-Saqri, Our ambassador to the Socialist Republic of Vietnam, is hereby appointed a non-resident ambassador extraordinary and plenipotentiary of Ours to the Kingdom of Cambodia and the Lao People’s Democratic Republic.

Article V

Dr Sheikh Abdullah bin Salim bin Hamad Al-Harthi, Our ambassador to the Kingdom of the Netherlands, is hereby appointed a non-resident ambassador extraordinary and plenipotentiary of Ours to the Grand Duchy of Luxembourg.

Article VI

Royal Decree 40/2021 Amending the Annex Attached to Royal Decree 124/2008 Establishing the Oman Human Rights Commission and Determining Its Competences

after perusal of the Basic Statute of the State,

and Royal Decree 124/2008 Establishing the Oman Human Rights Commission and Determining Its Competences,

and in pursuance of public interest,

have decreed as follows

Article I

The text of article 1 of the annex attached to the aforementioned Royal Decree 124/2008 is hereby replaced with the following text:

The committee shall be formed of thirteen members as follows:

– Member of Majlis Al-Dawla.

– Member of Majlis Al-Shura.

– Member of Oman Chamber of Commerce and Industry.

– Member of the General Federation of Oman Workers.

– Member of the legal profession.

– Three members of national associations.

– Five members representing the following entities:

– Ministry of Interior.

– Foreign Ministry.

– Ministry of Social Development.

– Ministry of Labour.

– Environment Authority.

Article II

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article III

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 39/2021 regarding the Public Authority for Civil Defence and Ambulance

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

Royal Decree 3/2013 Establishing the Public Authority for Civil Defence and Ambulance,

and the System of the Public Authority for Civil Defence and Ambulance promulgated by Royal Decree 68/2014,

and in pursuance of public interest,

have decreed as follows

Article I

The name of the “Public Authority for Civil Defence and Ambulance” is hereby amended to the “Civil Defence and Ambulance Authority.”

Article II

The text of the second paragraph of article 4 of the aforementioned Royal Decree 3/2013 is hereby replaced with the following text:

The implementation of the transfer must be in accordance with the mechanism agreed upon by the chairman of the authority and the Inspector General of Police and Customs, provided that a committee is formed of the Royal Oman Police, the Ministry of Finance, and the Civil Defence and Ambulance Authority to compile and transfer all immovable and movable assets, records, rights, and obligations of the civil defence and ambulance sectors within a maximum period of 60 (sixty) days from the date of issuance of this decree.

Article III

The text of article II of the aforementioned Royal Decree 68/2014 is hereby replaced with the following text:

The Chairman of the Board of Directors of the Civil Defence and Ambulance Authority shall issue the regulations and decisions necessary for implementing the provisions of the attached system within a period not exceeding 90 (ninety) days from the date of issuance of this decree, and until they are issued, the regulations and decisions in force continue to operate to the degree that they do not contradict with its provisions.

Article IV

The attached amendments to the aforementioned System of the Civil Defence and Ambulance Authority shall be implemented.

Article V

All that is contrary to this decree and the attached amendments, or in conflict with their provisions, is hereby repealed.

Article VI

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 37/2021 Approving the Accession of the Sultanate of Oman to the Arab Framework Agreement on the Liberalisation of Trade in Services among the Arab States

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Arab Framework Agreement on the Liberalisation of Trade in Services among the Arab States approved by the Economic and Social Council of the Arab League by Decision 1485 on 18 September 2003,

and after presentation to Majlis Al-Shura,

and in pursuance of public interest,

have decreed as follows

Article I

The accession of the Sultanate of Oman to the Arab Framework Agreement on the Liberalisation of Trade in Services among the Arab States is hereby approved in the form attached, subject to the reservation on article six of the agreement.

Article II

Competent bodies shall deposit the instrument of accession to the aforementioned agreement in accordance with its provisions, subject to the aforementioned reservation.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 33/2021 regarding the Systems for Pension and Social Protection

have decreed as follows

Article I

A fund named the “Social Protection Fund” is hereby established. It shall have legal personality, shall enjoy financial and administrative independence, and shall be subordinate to the Council of Ministers. Its system shall be issued by a royal decree.

Article II

A fund named the “Military and Security Services Pension Fund” is hereby established. It shall have legal personality, shall enjoy financial and administrative independence, and shall be subordinate to the Council of Ministers. Its system shall be issued by a royal decree.

Article III

The committee formed by a decision of the Council of Ministers shall supervise the setting of the necessary controls and complete all procedures relating to transferring the tasks, competences, assets, rights, obligations, holdings, and financial liabilities of each of the Civil Service Employees Pension Fund, the Public Authority for Social Insurance, the Royal Guard of Oman Pension Fund, the Royal Office Pension Fund, the Internal Security Service Pension Fund, the Sultan’s Special Force Pension Fund, the Omani Employees of the Diwan of Royal Court Pension Fund, the Royal Oman Police Pension Fund, the Ministry of Defence Pension Fund, the Employees of the Central Bank of Oman Pension Fund, and the Employees of Petroleum Development Oman Pension Fund, to the two funds stipulated in article I and article II of this decree, as the case may be. The aforementioned committee shall also undertake the setting of controls and procedures for restructuring the systems for pension and social protection, preparing the drafts of the fund systems stipulated in articles I and II of this decree, and preparing a social protection draft law that includes the pension systems to be applied to all employees and workers, and the provisions relating to the social protection system, within 12 (twelve) months from the date of the issuance of this decree.

Article IV

The boards of directors of the pension funds and the aforementioned Public Authority for Social Insurance and its executive management shall continue to exercise their tasks in accordance with the controls and procedures approved by the committee stipulated in article III of this decree.

Article V

The minimum years of service required for optional retirement entitlement in all applicable laws, systems, and regulations shall be 30 (thirty) years of service, and this provision shall not apply to those who have completed 20 (twenty) years of service on the date of the issuance of the Social Protection Law.

Article VI

The employees transferred under the royal decrees relating to the restructuring of the administrative apparatus of the state, who completed two-thirds of the contribution period required for pension entitlement on the date those decrees came into force shall continue to be treated in accordance with the provisions of the pension laws, systems, and regulations to which they are subject before their transfer. Their contributions shall be paid and their rights shall be settled in accordance with the same provisions, without prejudice to the provision of article V of this decree.

Article VII

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article VIII

This decree shall be published in the Official Gazette and comes into force on the date of its issuance, with the exception of article VI, which shall come into force on the date of the issuance of the royal decrees relating to the restructuring of the administrative apparatus of the state.
