Royal Decree 22/2018 Amending the Competition Protection and Monopoly Prevention Law

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Competition Protection and Monopoly Prevention Law promulgated by Royal Decree 67/2014,

and Royal Decree 2/2018 Establishing the Competition Protection and Monopoly Prevention Centre and Issuing Its System,

and in pursuance of public interest,

have decreed as follows

Article I

The word “authority” in the Competition Protection and Monopoly Prevention Law is hereby replaced with the word “centre” wherever it occurs, as well as the definition of “Authority” in article 1 of this law with the following definition:

Centre: The Competition Protection and Monopoly Prevention Centre.

Article II

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article III

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 24/2018 Appointing an Advisor in the Foreign Ministry

have decreed as follows

Article I

Dr Salem bin Nasser Al-Ismaily is hereby appointed an advisor in the Foreign Ministry with the same rank and financial entitlements.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 26/2018 Establishing Oman Commercial Arbitration Centre

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Law of Arbitration in Civil and Commercial Disputes promulgated by Royal Decree 47/97,

and the System of Oman Chamber of Commerce and Industry promulgated by Royal Decree 45/2017,

and in pursuance of public interest,

have decreed as follows

Article I

A special centre named the “Oman Commercial Arbitration Centre” is hereby established under this decree subordinate to the Oman Chamber of Commerce and Industry, and it has legal personality and enjoys financial and administrative independence.

Article II

The Chairman of the Board of Directors of the Oman Chamber of Commerce and Industry shall issue the work system of Oman Commercial Arbitration Centre.

Article III

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 23/2018 Amending Some Provisions of Royal Decree 35/2012 Issuing the System of the Public Authority for Investment Promotion and Export Development

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Foreign Capital Investment Law promulgated by Royal Decree 102/94,

and the System of the Public Authority for Investment Promotion and Export Development promulgated by Royal Decree 35/2012,

and in pursuance of public interest,

have decreed as follows

Article I

The attached amendments to Royal Decree 35/2012 Issuing the System of the Public Authority for Investment Promotion and Export Development shall be implemented.

Article II

All that is contrary to the attached amendments, or in conflict with their provisions, is hereby repealed.

Article III

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 21/2018 Approving the Petroleum Agreement Signed between the Government of the Sultanate of Oman and Petroleb SAL for Block 57

Arabic We, Qaboos bin Said, the Sultan of Oman after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96, the Oil and Gas Law promulgated by Royal Decree 8/2011, and the petroleum agreement signed between the Government of the Sultanate of Oman and Petroleb SAL for Block 57 on 10 January 2018, and in pursuance of public interest,

have decreed as follows

Article I

The aforementioned petroleum agreement is hereby approved.

Article II

Royal Decree 20/2018 Transferring and Appointing in the Diplomatic Corps

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Law Governing the Foreign Ministry promulgated by Royal Decree 32/2008,

and in pursuance of public interest,

have decreed as follows

Article I

The ambassadors named below are hereby transferred to the headquarters of the Foreign Ministry:

1. Dr Badr bin Mohammed bin Zahir Al-Hinai, Our ambassador to the Republic of Austria.

2. Khalid bin Hashil bin Mohammed Al-Muslahi, Our ambassador to Japan.

Article II

Ambassador Dr Mohammed bin Said bin Khalifa Al-Busaidi is hereby appointed an ambassador extraordinary and plenipotentiary of Ours to Japan.

Article III

The following are hereby granted:

1. Minister Plenipotentiary Ahmed bin Said bin Omar Al-Katheeri the title of ambassador, and is hereby appointed an ambassador extraordinary and plenipotentiary of Ours to the Republic of Uzbekistan.

2. Minister Plenipotentiary Yousef bin Ahmed bin Hamad Al-Jabri the title of ambassador, and is hereby appointed an ambassador extraordinary and plenipotentiary of Ours to the Republic of Austria.

3. Minister Plenipotentiary Saif bin Hilal bin Ali Al-Maamari the title of ambassador, and is hereby appointed an ambassador extraordinary and plenipotentiary of Ours to the Islamic Republic of Mauritania.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 19/2018 Declaring Public Benefit Status to the Project for Developing Darrah and Tibat Villages in the Wilayat of Bukha in the Governorate of Musandam

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Law on the Expropriation for Public Benefit promulgated by Royal Decree 64/78,

and in pursuance of public interest,

have decreed as follows

Article I

The project for developing Darrah and Tibat villages in the Wilayat of Bukha in the Governorate of Musandamspecified in the attached note and masterplanis hereby deemed a public benefit project.

Article II

Competent bodies may seize, through direct execution, real estate and land necessary for the aforementioned project, and all establishments on them, in accordance with the provisions of the aforementioned Law on the Expropriation for Public Benefit.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 18/2018 Establishing the Oman College of Health Sciences and the Higher Institute of Health Specialties and Issuing Their System

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

Royal Decree 55/93 Regarding the Systems of Education Institutes of the Ministry of Health,

Royal Decree 48/2012 Establishing the Education Council and Issuing Its System,

Royal Decree 33/2013 Regarding the Medical and Allied Health Professions in Government Medical Establishments (Civil and Military),

and Royal Decree 36/2014 Determining the Competences of the Ministry of Health and Adopting Its Organisational Structure,

and in pursuance of public interest,

have decreed as follows

Article I

A university college of health sciences named the "Oman College of Health Sciences", and a higher institute of health specialties named the "Higher Institute of Health Specialties" are hereby established, both subordinate to the Ministry of Health, and governed by the provisions of the attached system.

Article II

The Oman College of Health Sciences and the Higher Institute of Health Specialties have legal personality and enjoy financial and administrative independence. Their headquarters shall be in the Governorate of Muscat, and branches for them may be established in other governorates, after approval by the Education Council and the concerned bodies.

Article III

Competences, allocations, assets, rights, and records for each of: the Institute of Health Sciences, the Oman Assistant Pharmacy Institute, the Oman Institute of Public Health, the Oman Nursing Institute, the Oman Institute for Health Information Management, and the nursing institutes of the Ministry of Health in the governorates are hereby transferred to the Oman College of Health Sciences. The nursing institutes of the Ministry of Health in the governorates are hereby made branches for the college.

Article IV

Competences, allocations, assets, rights, and records of the Oman Specialised Nursing Institute of the Ministry of Health are hereby transferred to the Higher Institute of Health Specialties.

Article V

Administrative employees of the institutes mentioned in articles III and IV of this decree are hereby transferred to the Oman College of Health Sciences and the Higher Institute of Health Specialties with the same financial grades, and the provisions of the Civil Service Law shall apply to them. Faculty employees in these institutes are also transferred with the same financial grades.

Article VI

The grades, salaries, allowances, and periodic increments due to faculty employees at the college and the institute are determined in accordance with table 5 of the attached Annex 2 to the aforementioned Royal Decree 33/2013.

Article VII

The Oman College of Health Sciences and the Higher Institute of Health Specialties shall be subject to the laws, royal decrees, and regulations governing higher education in regard to that which is not governed by a special text in this decree and the system attached to it.

Article VIII

The Chairman of the Board of Trustees of the Oman College of Health Sciences and the Higher Institute of Health Specialties shall issue the necessary regulations and decisions for implementing the provisions of this decree and the attached system, and until they are issued, the provisions of the regulations and decisions in force continue to operate to the degree that they do not contradict with their provisions.

Article IX

The aforementioned Royal Decree 55/93 is hereby repealed as well as all that is contrary to this decree and the attached system, or in conflict with their provisions.

Article X

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 17/2018 Issuing the Law of Weapons, Ammunition, and Explosives Related to Military and Security Bodies

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached Law of Weapons, Ammunition, and Explosives Related to Military and Security Bodies shall apply.

Article II

The Minister Responsible for Defence Affairs shall issue the necessary regulations and decisions for implementing the provisions of this law, and until they are issued, the regulations and decisions in force shall continue to operate to the degree that they do not contradict with the provisions of this law.

Article III

Those subject to the provisions of this law shall rectify their status in compliance with its provisions within 6 (six) months from the date of its implementation. Licences that are valid prior to the entry into force of the provisions of this law shall continue to operate until they expire.

Article IV

All that is contrary to this law, or in conflict with its provisions, is hereby repealed.

Article V

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 16/2018 Issuing Amendments to Some Provisions of the Military Judiciary Law

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Military Judiciary Law promulgated by Royal Decree 110/2011,

and in pursuance of public interest,

have decreed as follows

Article I

The attached amendments to the aforementioned Military Judiciary Law shall be implemented.

Article II

All that is contrary to the attached amendments, or in conflict with their provisions, is hereby repealed.

Article III

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.
