Royal Decree 40/2015 Issuing the Law Governing Obligations of Employees of all State Institutions and Members of Appointed and Elected Councils

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of this law shall apply to every person who works or has been working in a state establishment, in private establishments or associations of public benefit, or any other body in which the state or one of its establishments contributes to its capital or financial resources in any manner whatsoever.

The provisions of this law shall also apply to every person who is a member or was a member of the appointed or elected councils or the boards of directors of the establishments, associations, or bodies referred to in the first paragraph.

Article II

Without prejudice to the obligations imposed by laws and decrees, the persons addressed by the provisions of this law are prohibited from the following:

1. Broadcasting or publishing any news, statements, or rumours that undermine the prestige of the state authorities, or weaken confidence in them, inciting to that, or facilitating that for others by any means.

2. Obstructing the implementation of projects implemented by the state or one of its establishments, inciting to that, or facilitating that for others.

3. Disclosing any confidential information, data, or documents that he has access to by virtue of his position, work, or membership, or using them in any way to achieve personal benefit for himself or for others, inciting to that, or facilitating that for others.

4. Insulting any public official or employee, by word, action, or gesture, or assaulting him while carrying out the duties of his office, the work of his position, or during his participation in such capacity in any forum whatsoever.

Article III

The persons addressed by the provisions of this law shall abide by the provisions of laws and royal decrees in force, international treaties and agreements that are part of the law of the country, and other systems, regulations, and decisions implementing them. They are also prohibited from violating them.

Article IV

Whoever violates the provisions of this law shall be punished with the maximum punishments prescribed for them in the laws and systems in force.

Article V

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Law on the Classification of State Records and the Governance of Protected Places promulgated by Royal Decree 118/2011,

and in pursuance of public interest,

have decreed as follows

Article I

The attached amendments are hereby made to the aforementioned Law on the Classification of State Records and the Governance of Protected Places.

Article II

All that is contrary to the attached amendments, or in conflict with their provisions, is hereby repealed.

Article III

This decree must be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 37/2015 Transferring Employees to the Foreign Ministry

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Law Governing the Foreign Ministry promulgated by Royal Decree 32/2008,

and in pursuance of public interest,

have decreed as follows

Article I

Nasser bin Mohammed bin Khalifa Al-Busaidi and Mohammed bin Ahmed bin Saleh Al-Balushi are hereby transferred from the Diwan of Royal Court to the Foreign Ministry and appointed with the rank of ambassador.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

the Oil and Gas Law promulgated by Royal Decree 8/2011,

Royal Decree 138/2008 Approving the Petroleum Agreement between the Government of the Sultanate of Oman,  Occidental Oman Gas Company LLC, Oman Oil Company SAOC, and Sixteenth Investment Company LLC for Block 62,

and the collection of documents by which Sixteenth Investment Company LLC agreed to assign its entire share and all its rights and obligations in the petroleum agreement signed on 22 November 2008 for Block 62 to Occidental Oman Gas LLC,

and in pursuance of public interest,

have decreed as follows

Article I

The assignment by Sixteenth Investment Company LLC of its entire share and all its rights and obligations in the aforementioned petroleum agreement signed on 22 November 2008 for Block 62 to Occidental Oman Gas LLC is hereby approved.

Article II

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

and in pursuance of public interest,

have decreed as follows

Article I

The attached amendments are hereby made to the aforementioned Civil Status Law.

Article II

All that is contrary to the attached amendments, or in conflict with their provisions, is hereby repealed.

Article III

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Royal Decree 32/2015 regarding the Promulgation of System of the Public Establishment for Industrial Estates

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Commercial Companies Law 4/74,

the Law Governing the Usufruct of the Lands of the Sultanate promulgated by Royal Decree 5/81,

the System of Public Authorities and Establishments promulgated by Royal Decree 116/91,

Royal Decree 4/93 Establishing the Public Establishment for Industrial Estates,

the Foreign Capital Investment Law promulgated by Royal Decree 102/94,

the Financial Law promulgated by Royal Decree 47/98,

the Law of Free Zones promulgated by Royal Decree 56/2002,

the Tender Law promulgated by Royal Decree 36/2008,

the State Financial and Administrative Audit Law promulgated by Royal Decree 111/2011,

and the Law on the Protection of Public Property and the Avoidance of Conflict of Interest promulgated by Royal Decree 112/2011,

and in pursuance of public interest,

have decreed as follows

Article I

The Public Establishment for Industrial Estates shall be subordinate to the Minister of Commerce and Industry, and the attached system shall apply in regard to it.

Article II

The headquarters of the Public Establishment for Industrial Estates shall be in the Governorate of Muscat, and branches or offices for it may be established inside or outside the Sultanate.

Article III

The Public Establishment for Industrial Estates shall enjoy legal personality and financial and administrative independence. It shall have—in order to achieve its objectives—the capacity to own, manage, and dispose of immovable and movable property; perform all disposals and carry out all actions necessary to achieve its objectives; and undertake any disposal necessary to achieve these objectives or that which is related or complementary to them.

Article IV

The Public Establishment for Industrial Estates shall undertake the collection of municipal services fees provided to companies, enterprises, commercial representation offices and their branches, whether Omani or foreign, and which are licensed to practise the authorised activities within the estates of the establishment.

Article V

The Board of Directors of the Public Establishment for Industrial Estates may—after the approval of the Council of Ministers—designate locations within the estates of the establishment, for the competent entities to provide the necessary services for the investment activities that are licensed to be established in them, whether relating to the issuance of licences, approvals, visas, recording or registering of the activities, or other services, provided that one or more employees shall undertake directly assuming the competences prescribed pursuant to the laws, royal decrees, and regulations governing the performance of those services within the scope of the estate. A decision governing the work of these entities shall be issued by the Minister of Commerce and Industry after coordination with them.

Article VI

It is permitted by a decision by the Council of Ministers—on the basis of a recommendation of the Board of Directors of the Public Establishment for Industrial Estates—to exclude some estates of the establishment or some of the investment activities in them from being subject to all or some of the provisions of the aforementioned Foreign Capital Investment Law and Commercial Companies Law and from the percentage of Omanisation prescribed in accordance with the rules in force; it is also permitted to grant them other exemptions and incentives not stipulated in this decree.

Article VII

The Public Establishment for Industrial Estates and the companies it owns, which are incorporated within its estates for the purpose of executing or managing the projects of public services and utilities and other basic projects in them, are excluded from being subject to the provisions of the Tender Law.

Article VIII

The Chairman of the Board of Directors of the Public Establishment for Industrial Estates shall issue the necessary regulations and decisions to implement the provisions of this decree and the attached system, after the approval of the Minister of Commerce and Industry, and until they are issued, the existing regulations, decisions, and systems in force continue to operate to the degree that they do not contradict with the provisions of this decree and the attached system.

Article IX

The Articles of Association of the Public Establishment for Industrial Estates attached to the aforementioned Royal Decree 4/93 is hereby repealed, as well as all that is contrary to this decree and the attached system, or in conflict with their provisions.

Article X

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.
