Royal Decree 64/2006 Promulgating the Pesticides Law

Arabic

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

Royal Decree 46/95 Promulgating the System for the Circulation and Use of Chemicals,

and the decision of the Supreme Council of the Cooperation Council for the Arab States of the Gulf in its twenty-fifth session held in the Kingdom of Bahrain during the period from 20 to 21 December 2004 regarding the Law of Pesticides for the States of the Cooperation Council for the Arab States of the Gulf,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached Pesticides Law shall apply.

Article II

The Minister of Agriculture and Fisheries shall issue the executive regulation and decisions of the aforementioned law.

Article III

All that is contrary to this law is hereby repealed.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 62/2006 Establishing the Free Zone in Salalah

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Commercial Register Law promulgated by Royal Decree 3/74 and its amendments,

the Commercial Companies Law promulgated by Royal Decree 4/74 and its amendments,

the Companies Income Tax Law promulgated by Royal Decree 47/81 and its amendments,

the Law of the Profit Tax on Commercial and Industrial Enterprises promulgated by Royal Decree 77/89 and its amendments,

the Law of Free Zones promulgated by Royal Decree 56/2002,

and Royal Decree 67/2003 Implementing the Unified Customs Law of the Cooperation Council for the Arab States of the Gulf,

and in pursuance of public interest,

have decreed as follows

Article I

A free zone named the “Salalah Free Zone” is hereby established on the land area specified in the attached plan.

Article II

Salalah Free Zone Company SAOC shall be the operator of Salalah Free Zone.

Article III

The operator and the working company shall be granted the incentives, advantages, and facilities stipulated in the aforementioned Law of Free Zones and the attached list.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

the Commercial Law promulgated by Royal Decree 55/90 and its amendments,

the System of Public Authorities and Establishments promulgated by Royal Decree 116/91,

the Foreign Capital Investment Law promulgated by Royal Decree 102/94 and its amendments,

the Real Estate Register System promulgated by Royal Decree 2/98,

the Financial Law promulgated by Royal Decree 47/98 and its amendments,

the Statistics Law promulgated by Royal Decree 29/2001,

the Telecommunications Law promulgated by Royal Decree 30/2002,

the Governance of the Ownership of Real Estate by Nationals of the States of the Cooperation Council for the Arab States of the Gulf in Member States promulgated by Royal Decree 21/2004,

the Privatisation Law promulgated by Royal Decree 77/2004,

the Law on the Regulation and Privatisation of the Electricity and Related Water Sector promulgated by Royal Decree 78/2004,

the System of the Ownership of Real Estate by Non-Omanis in Integrated Tourism Complexes promulgated by Royal Decree 12/2006,

the agreement signed on 26 July 2005 regarding the Blue City Project made between the Government of the Sultanate of Oman represented by the Ministry of Tourism and Al-Sawadi Investment and Tourism LLC,

and the addendum to the agreement signed on 23 April 2006 between the Government of the Sultanate of Oman represented by the Ministry of Tourism and Al-Sawadi Investment and Tourism LLC,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached system hereby apply in regard to the Blue City Project in Sawadi area.

Article II

This decree must be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 39/2006 Implementing the Unified Law on Anti-Dumping and Countervailing and Safeguard Measures for the States of the Cooperation Council for the Arab States of the Gulf

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Law on the Regulation and Promotion of Industry promulgated by Royal Decree 1/79,

and the decision of the Supreme Council of the Cooperation Council for the Arab States of the Gulf issued in the meeting held in the State of Kuwait during the month of December 2003 adopting the Unified Law on Anti-Dumping and Countervailing and Safeguard Measures for the States of the Cooperation Council for the Arab States of the Gulf as a binding law and implementing it in the member states,

and in pursuance of public interest,

have decreed as follows

Article I

The attached Unified Law on Anti-Dumping and Countervailing and Safeguard Measures for the States of the Cooperation Council for the Arab States of the Gulf shall apply.

Article II

This decision shall be published in the Official Gazette, and comes into force on the date determined by the aforementioned decision of the Supreme Council of the Cooperation Council for the Arab States of the Gulf.

Royal Decree 98/2005 Promulgating the Law of Mediation and Conciliation

We, Qaboos bin Said, the Sultan of Oman

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

and the Judicial Authority Law promulgated by Royal Decree 90/99 and its amendments,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached law shall apply in regard to mediation and conciliation.

Article II

This decree shall be published in the Official Gazette, and comes into force after six months from the date of its publication.

Ministry of Manpower: Ministerial Decision 129/2005 regarding the Form of the Regulation for Penalties for Private Sector Workers and the Conditions for Imposing Them

Based on the Labour Law promulgated by Royal Decree 35/2003,

Ministerial Decision 78/94 regarding the Penalties Permitted to be Imposed on Private Sector Workers,

Ministerial Decision 79/94 regarding the Penalties Regulation for Private Sector Workers and the Conditions for Imposing Them

and in pursuance of public interest,

it is hereby decided

Article I

Every employer who employs fifteen workers or more shall prepare a penalties regulation and the conditions for imposing them, taking into account the general rules attached to this decision (Annex 2).

Article II

The approval of the Director General of Labour Welfare or the Director General of Manpower in the governorates and regions, each within his competence, is required to implement or amend the aforementioned regulation.

The employer shall, after the approval of the regulation, place it in a conspicuous place in the establishment, and it must be written in both Arabic and English.

Article III

The employer must be guided in preparing the penalties regulation by the form attached to this decision (Annex 1).

Article IV

The aforementioned Decisions 94/78 and 94/79 are hereby repealed.

Article V

This decision must be published in the Official Gazette, and comes into force on the date of its publication.

after perusal of the Basic Statute of the State promulgated by Royal Decree 101/96,

the Printed Material and Publishing Law promulgated by Royal Decree 49/84,

the Law on the Censorship of Artistic Works promulgated by Royal Decree 65/97 and its amendments,

the Telecommunications Law promulgated by Royal Decree 30/2002,

and in pursuance of public interest,

have decreed as follows

Article I

The provisions of the attached Law of Private Radio and Television Establishments shall apply.

Article II

Without prejudice to the provisions of the aforementioned Printed Material and Publishing Law and the Telecommunications Law, all that is contrary to the provisions of this law or in conflict with its provisions is hereby repealed.

Article III

The Minister of Information shall issue the executive regulation of this law.

Article IV

This decree shall be published in the Official Gazette, and comes into force on the date of its publication.
