Supreme Judicial Council: Decision 98/2023 Relocating the Seat of the Primary Court in Mussanah

Arabic Based on the Judicial Authority Law promulgated by Royal Decree 90/99, Royal Decree 35/2022 regarding the Governance of the Administration of Judicial Affairs, and Ministerial Decision 119/2001 Determining the Seats and Jurisdiction of the Primary Courts, and in pursuance of public interest,

it is hereby decided

Article I

The seat of the Primary Court in Mussanah shall be relocated from its current headquarters to its new headquarters in Taraif Area on the main road leading to the Governorate of Muscat near Mussanah Roundabout.

Article II

This decision comes into force from 16 April 2023.

Article III

This decision shall be published in the Official Gazette. Issued on: 15 Ramadan 1444 Corresponding to: 6 April 2023

Supreme Judicial Council: Decision 38/2023 Establishing an Office to Provide Public Notary Services in the Invest in Oman Lounge at the Building of the Civil Aviation Authority in the Wilayat of Seeb

Based on the Law Governing the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

Royal Decree 35/2022 regarding the Governance of the Administration of Judicial Affairs,

and the Law of Public Notaries promulgated by Royal Decree 40/2003,

and in pursuance of public interest,

it is hereby decided

Article I

An office for providing public notary services is hereby established in the “Invest in Oman Lounge” located in the building of the Civil Aviation Authority in the Wilayat of Seeb subordinate to the Directorate of the Public Notary in Seeb.

Article II

Records and stamps used in the office mentioned in article I shall be identified with the label “Directorate of the Public Notary in Seeb (B)”.

Article III

This decision shall be published in the Official Gazette, and comes into force after 30 (thirty) days from the date of its publication.

Supreme Judicial Council: Decision 234/2022 Determining the Fees Due on the Work of the Public Notary

Arabic

Based on the Financial Law promulgated by Royal Decree 47/98,

the Law of Public Notaries promulgated by Royal Decree 40/2003,

Royal Decree 35/2022 regarding the Governance of the Administration of Judicial Affairs,

Ministerial Decision 175/2016 regarding Determining the Fees Due on the Work of the Public Notary,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

The fees due on the work of the public notary are hereby determined in accordance with the attached annex.

Article II

All transactions conducted by the public notary for those enjoying social security shall be exempt from fees.

Article III

The aforementioned Ministerial Decision 175/2016 is hereby repealed, as well as all that is contrary to this decision or in conflict with its provisions.

Article IV

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Supreme Judicial Council: Decision 196/2022 Specifying the Circumstances and Controls for the Witnessing of Documents

Arabic Based on the Law of Public Notaries promulgated by Royal Decree 40/2003, and Royal Decree 35/2022 regarding the Governance of the Administration of Judicial Affairs, and in pursuance of public interest,

it is hereby decided

Article I

The circumstances in which the witnessing of documents is required are specified as follows:

– Powers of attorney including the sale, purchase, gift, or assignment of one or more real estate.

– Powers of attorney including the withdrawal or receipt of sums from banks.

– Acknowledgements of all kinds.

– Undertakings of all kinds.

– Contracts transferring ownership (contract of sale, contract of gift) which do not fall within the legal competences of other entities.

Article II

The controls for the witnessing of documents are specified as follows:

– That the witnessing is done by two persons.

– That the person witnessing is rational and adult.

– That the person witnessing understands the content of the document.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication. Issued on: 18 Rabi Al-Thani 1444 Corresponding to: 13 November 2022
