Royal Decree 73/2022 Adopting the Organisational Structure of the State Financial and Administrative Audit Institution

Arabic

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

the State Financial and Administrative Audit Law promulgated by Royal Decree 111/2011,

Royal Decree 6/2012 Adopting the Organisational Structure of the State Financial and Administrative Audit Institution,

and the System of the Administrative Apparatus of the State promulgated by Royal Decree 75/2020,

and in pursuance of public interest,

have decreed as follows

Article I

The organisational structure of the State Financial and Administrative Audit Institution is hereby adopted in accordance with the attached annex.

Article II

The aforementioned Royal Decree 6/2012 is hereby repealed, as well as all that is contrary to this decree or in conflict with its provisions.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Based on Royal Decree 88/2020 Merging the Ministry of Justice and the Ministry of Legal Affairs into One Ministry Named the Ministry of Justice and Legal Affairs, Determining Its Competences, and Adopting Its Organisational Structure,

and the Regulation Governing Expert Undertakings issued by Ministerial Decision 52/2022,

and in pursuance of public interest,

it is hereby decided

Article I

The attached Code of Conduct for Experts and Bankruptcy Experts shall apply.

Article II

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Supreme Judicial Council: Decision 196/2022 Specifying the Circumstances and Controls for the Witnessing of Documents

Arabic Consolidated Text Based on the Law of Public Notaries promulgated by Royal Decree 40/2003, and Royal Decree 35/2022 regarding the Governance of the Administration of Judicial Affairs, and in pursuance of public interest,

it is hereby decided

Article I

The circumstances in which the witnessing of documents is required are specified as follows:

– Powers of attorney including the sale, purchase, gift, or assignment of one or more real estate.

– Powers of attorney including the withdrawal or receipt of sums from banks.

– Acknowledgements of all kinds.

– Undertakings of all kinds.

– Contracts transferring ownership (contract of sale, contract of gift) which do not fall within the legal competences of other entities.

Article II

The controls for the witnessing of documents are specified as follows:

– That the witnessing is done by two persons.

– That the person witnessing is rational and adult.

– That the person witnessing understands the content of the document.

Article III

Royal Decree 72/2022 Approving the Accession of the Sultanate of Oman to the Convention on the Suppression of Unlawful Acts Relating to International Civil Aviation

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Convention on the Suppression of Unlawful Acts Relating to International Civil Aviation done at Beijing on 10 September 2010,

and in pursuance of public interest,

have decreed as follows

Article I

The accession of the Sultanate of Oman to the Convention on the Suppression of Unlawful Acts Relating to International Civil Aviation is hereby approved in the form attached.

Article II

Competent bodies shall deposit the instrument of accession for the aforementioned convention in accordance with its provisions.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.

Based on the Foreign Capital Investment Law promulgated by Royal Decree 50/2019,

Royal Decree 97/2020 Amending the Name of the Ministry of Commerce and Industry to the Ministry of Commerce, Industry, and Investment Promotion, Determining Its Competences, and Adopting Its Organisational Structure,

and the Executive Regulation of the Foreign Capital Investment Law promulgated by Ministerial Decision 72/2020,

 and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the governance of foreign investor applications approval offices.

Article II

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 71/2022 Declaring Public Benefit Status to the Project to Develop and Produce Mines in Block A1-12 in the Wilayat of Yanqul in the Governorate of Dhahirah

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

 and the Law on Expropriation for Public Benefit promulgated by Royal Decree 64/78,

 and in pursuance of public interest,

have decreed as follows

Article I

The project for the development and production of mines in Block A1-12 in the Wilayat of Yanqul in the Governorate of Dhahirah, specified in the attached note and masterplan, is hereby deemed a public benefit project.

Article II

The competent entities may seize, through direct execution, real estate and land necessary for the aforementioned project, and all establishments on them, in accordance with the provisions of the aforementioned Law on the Expropriation for Public Benefit.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.
