Case Summary: Supreme Court (Commercial Circuit B) Contestation 58/2021 (Limitation of Carrier Liability for Undeclared Valuable Cargo)

The Supreme Court ruled that the value of valuable cargo must be explicitly declared in the bill of lading to hold a carrier fully liable for its loss. A customs declaration does not substitute this requirement, as the carrier must be notified via the bill of lading to charge the appropriate special carriage fees. Without such declaration, the cargo is treated as ordinary goods, and compensation is limited to weight-based calculations under the Commercial Law.

Royal Decree 65/2021 Issuing Class I Licence for Oman Future Telecommunications Company to Build and Operate the System for Providing International Public Telecommunication Services

We, Haitham bin Tarik, Sultan of Oman

after perusal of the Basic Statute of the State,

and the Telecommunications Law promulgated by Royal Decree 30/2002,

and in pursuance of public interest,

have decreed as follows

Article I

A Class I Licence is hereby issued to Oman Future Communications Company to build and operate a system for providing international public telecommunications services, in accordance with the provisions of the attached licence.

Article II

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

after perusal of the Basic Statute of the State,

and the Agreement between the Government of the Sultanate of Oman and the Government of the Hellenic Republic on the Exemption from Visa Requirements for Holders of Diplomatic, Service and Special Passports signed in the city of Muscat on 20 October 2021,

and in pursuance of public interest,

have decreed as follows

Article I

The aforementioned agreement is hereby ratified in the form attached.

Article II

This decree must be published in the Official Gazette, and comes into force on the date of its issuance.

Case Summary: Supreme Court (Commercial Circuit A) Contestations 573, 627, 631, and 632/2020 (Force Majeure Exclusions and Procedural Requirements for Joining Third Parties)

The Supreme Court held that where the parties have agreed on their own definition of force majeure, that contractual definition governs, because the Civil Transactions Law does not lay down a precise definition of force majeure. A party therefore cannot invoke force majeure for an event that the contract expressly excludes. The court also held that joining a third party, including a guarantor, to a lawsuit must follow the ordinary procedures for filing a claim, and that a request made only in a defence memorandum or orally at a hearing is insufficient to validly join that party.
