Environment Authority: Administrative Decision 50/2023 Issuing the Regulation Governing Hazardous Chemicals

Based on the System for the Handling and Use of Chemicals promulgated by Royal Decree 46/95,

Royal Decree 117/2004 Ratifying the Stockholm Convention on Persistent Organic Pollutants (POPs),

the Regulation of Registering Chemicals and Their Permits issued by Ministerial Decision 248/97,

the Regulation on the Requirements for Packing, Packaging, and Placing Data and Labels for Hazardous Chemicals issued by Ministerial Decision 317/2001,

Ministerial Decision 14/2017 Determining the Fees for Granting Permits to Handle Chemicals,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

Article I

The provisions of the attached regulation shall apply in regard to the governance of hazardous chemicals.

Article II

Ministerial Decisions 248/97, 317/2001, and 14/2017 are hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Ministry of Housing and Urban Planning: Ministerial Decision 90/2023 Granting Small and Medium Enterprises Usufruct Right to Lands Owned by the State

Arabic Based on the Land Law promulgated by Royal Decree 5/80, Royal Decree 5/81 Governing the Usufruct of the Lands of the Sultanate of Oman, the Executive Regulation Governing the Usufruct of the Lands of the Sultanate of Oman promulgated by Royal Decree 88/82, the Real Estate Register System promulgated by Royal Decree 2/98, the Executive Regulation of the Real Estate Register issued by Ministerial Decision 29/99, Ministerial Decision 12/2016 Granting Small and Medium Enterprises Usufruct Right to Land Owned by the State, and the approval of the Council of Ministers, and in pursuance of public interest,

it is hereby decided

Article I

Small and medium enterprises shall be granted usufruct right to lands owned by the state in accordance with the provisions and controls provided in the Law Governing the Usufruct of the Lands of the Sultanate of Oman and its executive regulation.

Article II

The Ministry of Housing and Urban Planning shall allocate no less than 10% (ten percent) of the lands in commercial, industrial, agricultural, and tourism masterplans that are ready for distribution and by the system of usufruct.

Article III

The following is required for granting small and medium enterprises usufruct right to lands owned by the state:

1. That the enterprise is wholly owned by an Omani national.

2. That the main headquarters of the enterprise is in the Sultanate of Oman.

3. That the owner of the enterprise manages it on a full-time basis.

4. That the owner of the enterprise is registered with the Ministry of Labour as an employer.

5. That the enterprise is registered with the Small and Medium Enterprises Development Authority, and holds the Riyada card.

Article IV

The small and medium enterprise shall have the usufruct right to one land only. Preference between the enterprises shall be in accordance with the nature and importance of the project and its economic feasibility, followed by the enterprise achieving the highest Omanisation rate, and followed by the enterprise with the earlier application.

Article V

The aforementioned Ministerial Decision 12/2016 is hereby repealed, as well as all that is contrary to this decision or in conflict with its provisions.

Article VI

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication. Issued on: 6 Shawwal 1444 Corresponding to: 27 April 2023

Royal Decree 24/2023 Amending Some Provisions of the Law on Combating Narcotic Drugs and Psychotropic Substances

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Law on Combating Narcotic Drugs and Psychotropic Substances promulgated by Royal Decree 17/99,

and in pursuance of public interest,

have decreed as follows

Article I

The attached amendments to the aforementioned Law on Combating Narcotic Drugs and Psychotropic Substances shall be implemented.

Article II

All that is contrary to the attached amendments, or in conflict with their provisions, is hereby repealed.

Article III

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Decree 23/2023 regarding the Marriage of Omanis to Foreigners

Arabic We, Haitham bin Tarik, the Sultan of Oman after perusal of the Basic Statute of the State, the Personal Status Law promulgated by Royal Decree 32/97, the Law of Public Notaries promulgated by Royal Decree 40/2003, the Omani Nationality Law promulgated by Royal Decree 38/2014, Royal Decree 58/93 Delegating in the Issuance of the Provisions Governing the Marriage of Omanis to Foreigners and Amending the Law Governing Omani Nationality, and Royal Decree 37/2022 Determining the Competences of the Ministry of Interior and Adopting Its Organisational Structure, and in pursuance of public interest,

have decreed as follows

Article I

The aforementioned Royal Decree 58/93 and the decisions issued in the implementation of its provisions are hereby repealed.

Article II

The provisions of this royal decree shall not prejudice the provisions of Islamic Sharia or public order, or any provision in applicable laws, royal decrees, and systems stipulating non-marriage to a foreigner as a condition for assuming and continuing in some public offices of special importance or nature.

Article III

Documents proving the marriage of Omanis to foreigners that takes place in the Sultanate of Oman shall be documented in accordance with the provisions of the relevant laws and royal decrees. Foreign documents proving such marriage shall be treated as official Omani documents after their attestation by the competent entities in the foreign state and the Omani Foreign Ministry.

Article IV

Documents proving the marriage of Omanis to foreigners issued by foreign official entities before the date of the entry into force of this royal decree in violation of the provisions governing the marriage of Omanis to foreigners applicable at the time shall be relied upon after their attestation by the Omani Foreign Ministry, to the degree they do not conflict with the provisions of article II of this decree.

Article V

The units of the administrative apparatus of the state and other public legal persons shall implement the provisions of this decree each in regard to its competence.

Article VI

All that is contrary to this decree, or in conflict with its provisions, is hereby repealed.

Article VII

This decree shall be published in the Official Gazette, and comes into force on the day following the date of its publication. Issued on: 25 Ramadan 1444 Corresponding to: 16 April 2023

Royal Decree 22/2023 Declaring Public Benefit Status for the Project to Construct a Dam to Protect against Flood Risks (Z4C) in Wadi Al-Zuhaimi in the Wilayat of Liwa in the Governorate of Batinah North

We, Haitham bin Tarik, the Sultan of Oman

after perusal of the Basic Statute of the State,

and the Law on the Expropriation for Public Benefit promulgated by Royal Decree 64/78,

and in pursuance of public interest,

have decreed as follows

Article I

The project for the construction of a dam to protect against flood risks (Z4C) in Wadi Al-Zuhaimi in the Wilayat of Liwa in the Governorate of Batinah North—specified in the attached note and masterplan—is hereby deemed a public benefit project.

Article II

The competent entities may seize, through direct execution, real estate and land necessary for the project specified in article I, and all establishments on them, in accordance with the provisions of the aforementioned Law on the Expropriation for Public Benefit.

Article III

This decree shall be published in the Official Gazette, and comes into force on the date of its issuance.
