Ministry of Interior: Ministerial Decision 182/2022 Determining the Voting Days for the Elections of the Members of Municipal Councils for the Third Term

Arabic

Based on the Municipal Councils Law promulgated by Royal Decree 126/2020,

and the Governance Regulation for the Elections of the Members of the Municipal Council issued by Ministerial Decision 92/2022,

and in pursuance of public interest,

it is hereby decided

Article I

The voting of electors outside the Sultanate of Oman for the elections of the members of municipal councils for the third term shall be held on Sunday, 18 December 2022.

Article II

The voting of electors within the Sultanate of Oman for the elections of the members of municipal councils for the third term shall be held on Sunday, 25 December 2022.

Article III

This decision shall be published in the Official Gazette.

Based on the System of Escrow Account for Real Estate Development Projects promulgated by Royal Decree 30/2018,

the Executive Regulation for the System of Escrow Account for Real Estate Development Projects issued by Ministerial Decision 72/2019,

the Regulation for the Values, Fees, and Prices Collected by the Ministry of Housing and Urban Planning issued by Ministerial Decision 92/2016,

and the approval of the Ministry of Finance,

and in pursuance of public interest,

it is hereby decided

The text of clause 2 of annex 12 attached to the aforementioned Regulation for the Values, Fees, and Prices Collected by the Ministry of Housing and Urban Planning is hereby replaced with the following text:

Ministry of Agriculture, Fisheries, and Water Resources: Ministerial Decision 211/2022 Designating the Ports for Unloading and Inspection Operations for Omani and Foreign Fishing Ships

Based on Royal Decree 26/2013 regarding the Accession of the Sultanate of Oman to the Agreement on Port State Measures to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated Fishing,

the Aquatic Living Resources Law promulgated by Royal Decree 20/2019,

and Ministerial Decision 16/2021 Designating Some Ports for Unloading and Inspection Operations for Foreign Fishing Ships,

and in pursuance of public interest,

it is hereby decided

Article I

The following ports are hereby designated for unloading and inspections operations for Omani and foreign commercial fishing ships requesting permission to enter the ports of the Sultanate of Oman:

1. Port of Salalah.

2. Port of Duqm.

3. Duqm Fishing Port.

Article II

The aforementioned Ministerial Decision 16/2021 is hereby repealed.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Royal Oman Police: Decision 195/2022 Amending Some Provisions of the Executive Regulation of the Foreigners Residency Law

Based on the Foreigners Residency Law promulgated by Royal Decree 16/95,

and the Executive Regulation of the Foreigners Residency Law issued by Decision 63/96,

and in pursuance of public interest,

it is hereby decided

Article I

The texts of clauses 2 and 3 of article 2 of the Executive Regulation of the Foreigners Residency Law are hereby replaced with the following texts:

2. Land ports: Sarfait, Mazyunah, Dibba, Darah, Khatam, Hamasa, Rawdah, Hadf, Sa’ara, Hafeet, Wajajah, Khatmat Milaha, Aswad, and Rub’ Al-Khali.

3. Sea ports: Port Sultan Qaboos, Mina Al-Fahal, Port of Salalah, Khasab Port, Sohar Port, Shinas Port, Suwaiq Port, Sur (Fishing Port), Qalhat Port, Masirah Port, and Port of Duqm.

Article II

All that is contrary to this decision, or in conflict with its provisions, is hereby repealed.

Article III

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Based on the System for the Collection of Taxes, Fees,and Other Amounts Due to Units of the Administrative Apparatus of the State promulgated by Royal Decree 32/94,

the Criminal Procedures Law promulgated by Royal Decree 97/99, the Income Tax Law promulgated by Royal Decree 28/2009,

the Excise Tax Law promulgated by Royal Decree 23/2019,

and the Value Added Tax Law promulgated by Royal Decree 121/2020,

and in pursuance of public interest,

it is hereby decided

Article I

Those occupying the positions provided in the attached schedule in the Tax Authority are hereby conferred–each within the scope of his competence—judicial enforcement status in the application of the provisions of the aforementioned System for the Collection of Taxes, Fees, and Other Amounts Due to Units of the Administrative Apparatus of the State, the aforementioned Income Tax Law, the aforementioned Excise Tax Law, the aforementioned Value Added Tax Law, and the regulations and decisions issued in the implementation of their provisions.

Article II

This decision shall be published in the Official Gazette, and comes into force on the day following the date of its publication.

Supreme Judicial Council: Decision 164/2022 Determining the Geographical Jurisdiction of Administrative Circuits

Arabic

Based on the Judicial Authority Law promulgated by Royal Decree 90/99,

the Civil and Commercial Procedures Law promulgated by Royal Decree 29/2002,

Royal Decrees 61/2006 and 118/2010 Establishing Two Primary Circuits for the Administrative Judiciary in Salalah and Sohar,

and Royal Decree 35/2022 regarding the Governance of the Administration of Judicial Affairs,

and in pursuance of the interest of work,

it is hereby decided

Article I

The geographical jurisdiction of the primary and appeal administrative circuits is hereby specified as follows:

– The Appeal Administrative Circuit of the Court of Appeal in Muscat:

The scope of its jurisdiction shall be all the governorates of the Sultanate.

– The Primary Administrative Circuit of the Primary Court in Muscat:

The scope of its jurisdiction shall be the governorates of Muscat, Dakhiliya, Batinah South, Sharqiyah North, Sharqiyah South, and Wusta.

– The Administrative Circuit of the Primary Court in Salalah:

The scope of its jurisdiction shall be the wilayat of the Governorate of Dhofar.

– The Primary Administrative Circuit of the Primary Court in Sohar:

The scope of its jurisdiction shall be the governorates of Batinah North, Musandam, Buraimi, and Dhahirah.

Article II

This decision shall be published in the Official Gazette, and comes into force on 1 October 2022.

Based on Royal Decree 107/2020 Establishing the Small and Medium Enterprises Development Authority, Determining Its Competences, and Adopting Its Organisational Structure,

and the Governance Regulation of Sanad Services Centres issued by Decision 16/2014,

Article I

The attached Governance Regulation of Sanad Service Centres shall apply.

Article II

The aforementioned decision 16/2014 is hereby repealed, as well as all that is contrary to the attached regulation or in conflict with its provisions.

Article III
